CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: OCTOBER 17, 2023
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: CONTRACT CHANGE ORDER NO. 1 FOR THE ALLEY
SANITARY SEWER IMPROVEMENT PROJECT: NORTH OF

BROADWAY FROM WALNUT STREET TO OHIO STREET AND

WALNUT STREET FROM BROADWAY TO THE ALLEY

NORTH OF BROADWAY
ATTACHMENT (Y/N): YES ITEM # 06
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Motion, approve Contract Change Order No. 1, with Gentry General Engineering, Inc. in the amount of $56,695.70 for the Alley Sanitary Sewer Improvement Project 2018 in the alley north of Broadway from Ohio Street to Walnut Street and at Walnut Street from the alley north of Broadway to Broadway (Project), and authorize and direct the Director of Public Works, on behalf of the City, to execute the Contract Change Order and any related documents.

DISCUSSION:

On July 28, 2020, the City Council awarded the Project in the amount of $1,924,055. On September 21, 2020, Public Works issued the corresponding Notice to Proceed to Gentry General Engineering, Inc. The improvements included removing and reconstructing sanitary sewer pipe and manholes, driveway approaches, Portland Cement Concrete (PCC) alleyways, and other items of work.

This change order will utilize the favorable unit pricing received through the competitive public bid process for similar work in the original project scope and includes adjustments of the drainage improvements on a public alley north of Broadway Avenue between Walnut Street and Ohio Street. Amending the original City project scope to include these additional alley adjustments will improve the existing drainage conditions and address concerns of the residents adjacent to the project.

The work completed includes the original contract amount of $1,924,055 and extra work in the amount of $185,082.38. Approval of Contract Change Order No. 1, in the amount of $56,695.70 will increase the approved contract amount to $2,165,833, which is 2.57% over the Public Works Director authority of 10%. The cumulative change order amount is $241,778.08 and 12.57% of the total contract price. No further work is expected once the scope of Change Order No. 1 is completed by the contractor.

COMMUNITY WORKFORCE AGREEMENT (CWA):

This Project is covered “Project Work” as defined in the CWA the City entered into with the Los Angeles/Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions. Project Work covered by the CWA is defined and limited to all construction and major rehabilitation work listed on the Project List (Attachment F to the CWA).

The CWA was approved by the City Council on December 3, 2019 and amended and restated on October 5, 2021. The intent of the Project List is that larger projects be included due to the additional administrative activities associated with the CWA and minimize the impact of the additional administrative functions and costs for the City and for smaller construction firms.

IMPACT ON BUDGET:

Sufficient funds are available in the Public Works Fiscal Year 2023/2024 budget in the Sanitation Fund.

Respectfully submitted,
Rudy Emami
Director of Public Works
