CITY COUNCIL AGENDA REPORT
City of Anaheim
HUMAN RESOURCES DEPARTMENT
DATE: OCTOBER 17, 2023
FROM: HUMAN RESOURCES DEPARTMENT
SUBJECT: CREATION OF A CLASSIFICATION ASSIGNED TO NON-
REPRESENTED MANAGEMENT, ASSIGNMENT OF THE
CLASSIFICATION TO A SALARY RANGE, AND APPROVAL OF
A RELATED AMENDMENT TO APPENDIX B OF THE
PERSONNEL RULES AND POLICIES COVERING NON-
REPRESENTED FULL-TIME AND PART-TIME EMPLOYEES
EFFECTIVE OCTOBER 27, 2023
ATTACHMENT (Y/N): YES ITEM # 17
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Resolution, approve the creation of a Non-Represented Management classification titled Assistant City Attorney – Confidential, assignment of the classification to salary range XCR23 ($156,264 to $234,396), and related amendment to Appendix B of the Personnel Rules and Policies Covering Non- Represented Full-Time and Part-Time Employees effective October 27, 2023.
DISCUSSION:
Chapter 1.05 of the Anaheim Municipal Code establishes the City’s Personnel System and vests the Human Resources Director with the responsibility for ensuring the appropriateness of classifications based upon the type and level of duties and responsibilities performed.
In concurrence with a request from the City Attorney’s Office, the Human Resources Director recommends creation of a Non-Represented Management classification titled Assistant City Attorney – Confidential, and assigning the classification to salary range XCR23 ($156,264 - $234,396), consistent with the represented classification Assistant City Attorney. The creation of the non-represented Assistant City Attorney - Confidential classification will allow the department greater operational flexibility in the assignment of duties, specifically allowing the position to be tasked with legal services in support of the City’s employee relations functions as well as provide greater opportunities for employee advancement. Currently, employee relations function is primarily assigned to the Deputy City Attorney – Confidential classification.
Creation of Assistant City Attorney – Confidential Classification October 17, 2023
There will be no increase in the total budgeted positions in the department related to the proposed action.
No changes to the Personnel Rules and Policies Covering Non-Represented Full-Time and Part-Time Employees are required to implement this recommendation other than an amendment to Appendix B to reflect the addition of the classification and assigned salary range.
Human Resources has consulted with the American Federation of State, County, and Municipal Employees, Local 2002, the bargaining unit representing the equivalent Assistant City Attorney classification and they concur with this recommendation.
IMPACT ON BUDGET:
The recommended changes will not result in a budget impact.
Respectfully submitted,
Linda N. Andal
Human Resources Director
