CITY COUNCIL AGENDA REPORT
City of Anaheim
CITY ATTORNEY’S OFFICE
DATE: OCTOBER 24, 2023
FROM: CITY ATTORNEY’S OFFICE
SUBJECT: DISCUSSION OF POTENTIAL REVISIONS TO REVOLVING

DOOR PROVISIONS OF SUNSHINE ORDINANCE
ATTACHMENT (Y/N): NO ITEM # 20
GOVERNMENT CODE § 84308 APPLIES: NO
REQUESTED ACTION:

That the City Council consider and discuss potential revisions to Anaheim Municipal Code Section 1.11.080.030 to require lobbyists who act as advisors to City officials to report their advisory contacts to the City.

DISCUSSION:

At the September 26, 2023 City Council meeting, Mayor Pro Tem Natalie Rubalcava requested a discussion item regarding a consultant engagement ordinance. The Mayor Pro Tem’s intent was to present an item, in part, to prevent lobbyists from parlaying their access to City Hall to advance their lobbying businesses.

Based on that direction, staff is presenting a potential modification that would require lobbyists who are acting as advisors to City Official(s) to report their advisory contacts to the same extent and in the same manner they report lobbying activity. This requirement would apply during the time someone is a registered lobbyist, and for two years after they cease their lobbying activity in the City. One item for discussion is whether the requirement should be limited to contacts with elected officials or have broader application (for example, encompassing Board/Commission or Executive Team members).

The proposed modifications to the Municipal Code are in red:

1.11.080.030 Restrictions on Employment and Utilization of Lobbyists. The City shall not employ any person required to register as a Lobbyist under section

1.11.070 who engages in Lobbying the City of Anaheim for a period of two years following the person's Lobbying of Anaheim. Nor shall any person required to register as a Lobbyist under Section 1.11.070 serve as an advisor, paid or unpaid, to any City Official for a period of two years following the person's Lobbying of Anaheim, unless all contacts as an advisor are reported to the City Clerk, consistent with Section 1.11.070.020. For purposes of this section, “advisor” means one who provides input by way of advice, guidance, information, or speaking points on matters relevant to the City.
