CITY COUNCIL AGENDA REPORT
City of Anaheim
POLICE DEPARTMENT
DATE: NOVEMBER 7, 2023
FROM: POLICE DEPARTMENT
SUBJECT: PROPOSED RESCISSION OF RESOLUTION NO. 97R-14
REGARDING “NO PARKING” IN THE AREA LOCATED
ON BALSAM AVENUE WEST OF EAST STREET
ATTACHMENT (Y/N): YES ITEM # 15
GOVERNMENT CODE § 84308 APPLIES:
RECOMMENDATION:
That the City Council, by Resolution, rescind Resolution No. 97R-14 regarding a “No Parking” area of Balsam Avenue, west of East Street.
DISCUSSION:
The City Council passed a resolution in February 1997 restricting on-street parking to address a variety of illegal activities occurring in and around vehicles parked on the street in the Balsam Avenue neighborhood. At recent community meetings, residents, apartment managers, and owners expressed their desire to reinstate parking in the neighborhood.
Resolution No. 97R-14 served to accomplish the mission for which it was adopted.
Some 25 years later the neighborhood has changed, and surrounding neighborhoods have implemented permit parking, which severely limits where residents in the Balsam Avenue neighborhood can park. Residents are now left with the choice of illegally parking on the streets or alleys, knowing they may be cited, or parking several blocks away from their homes and walking considerable distances, often late at night.
Several meetings were held with the community to discuss parking and potentially rescinding the resolution:
10/11/2022: A Meeting was held with Property Owners to discuss the possibility of restoring on-street parking. Discussion included considering Permit Parking.
11/9/2023: A Meeting was held with Residents to discuss the possibility of restoring on-street parking. Discussion included considering Permit Parking. 3/10/2023: Permit Parking Surveys were mailed to the Balsam neighborhood.
Proposed Rescission of Resolution No. 97R-14 regarding “No Parking” in the Area Located on Balsam Avenue West of East Street November 7, 2023
4/10/2023: Permit Parking survey period ended and the required 75% minimum support rate was not obtained (only 45% support was obtained) Community members have expressed an understanding of what led to the parking restriction years ago. However, they are confident the resolution can be rescinded to allow parking and, through collaborative efforts between the community, Police Department, and other city resources, still maintain a safe environment for everyone to enjoy. Permit parking was an option provided to the neighborhood through a survey which resulted in the neighborhood not wanting permit parking. Should the Council adopt this Resolution, the City will be making the necessary signage changes to allow street parking within 30 days. The impacts on the community will be closely monitored to ensure the public safety issues do not return as a result of rescinding the Resolution.
IMPACT ON BUDGET:
There are sufficient funds in the Fiscal Year 2023/24 Public Works budget for signage and striping. There will be no impact to costs associated with police service.
Respectfully submitted, Concurred by,
Rick P. Armendariz Rudy Emami
Chief of Police Director of Public Works
