CITY COUNCIL AGENDA REPORT
City of Anaheim

POLICE DEPARTMENT
DATE: NOVEMBER 28, 2023
FROM: POLICE DEPARTMENT
SUBJECT: SECOND AMENDMENT TO AGREEMENT WITH CALIFORNIA
FORENSIC PHLEBOTOMY, INC. FOR FORENSIC

PHLEBOTOMY SERVICES
ATTACHMENT (Y/N): YES ITEM # 23
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Motion, waive Council Policy 4.1 and approve the Second Amendment to the Agreement between the City of Anaheim and California Forensic Phlebotomy, Inc. (CFP), to increase the hourly rate to CFP by 3.7% due to an increase of cost of living increases and compensation, from a total amount not-to-exceed of $250,000 to $500,000, to perform forensic phlebotomy services; and authorize the Chief of Police, or designee, to administer the agreement and execute and administer any future amendments with non-substantive changes to the agreement, as determined by the Office of the City Attorney.

DISCUSSION:

The Police Department (Department) requires a forensic phlebotomy service for the collection of evidence in criminal prosecutions. The Department averages over 100 call- outs per month and requires the forensic phlebotomy service to obtain and preserve the chemical evidence.

The contractor is required to respond within one hour to any Orange County location requested by the Department. California Forensic Phlebotomy, Inc. charges $101.07 per response to take blood samples, conduct breath tests as necessary, and maintain chain of custody in accordance with standard rules of evidence. The contractor will appear in court or elsewhere at the request of the Department to discuss or testify regarding the taking of samples, tests made, and results thereof at no cost to the Department. CFP, Inc. has been performing this service for the Department and all Orange County law enforcement agencies for the past 41 years.

On November 24, 2020, City of Anaheim and CFP entered into a first amendment to the original agreement which reduced the hourly rate for the first renewal term of the agreement by 10% considering the economic crisis caused by COVID-19 and added one optional renewal to the term of the agreement. The initial term of the agreement was for a one-year period with options to renew for four one-year terms at a negotiated price.

Any negotiated increases shall not exceed the Consumer Price Index (CPI) for medical care services for U.S. cities. Under the Second Amendment, City of Anaheim will pay CFP for professional services the rate of $101.07 per response. All provisions of the original agreement and first amendment to agreement will remain in full force and effect. The second amended agreement integrates all the terms and conditions and supersedes all negotiations or previous agreements between the City of Anaheim and CFP.

IMPACT ON BUDGET:

Sufficient funds are available in the Police Department's FY 2023/24 budget. Subsequent years’ renewals will be subject to City Council approval of budget appropriations.

Respectfully submitted,
Rick P. Armendariz
Chief of Police
