CITY COUNCIL AGENDA REPORT
City of Anaheim
POLICE DEPARTMENT
DATE: NOVEMBER 28, 2023
FROM: POLICE DEPARTMENT
SUBJECT: AGREEMENT WITH GARET BONHAM, DBA GNB
CONSULTING, INC. FOR DATA RELEASE PURSUANT TO
CALIFORNIA STATE LAWS
ATTACHMENT (Y/N): YES ITEM # 22
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Motion, waive Council Policy 4.1 and approve the Agreement with Garet Bonham, dba GNB Consulting Inc., in an amount not to exceed $150,000, annually, to prepare, redact, and produce documents and video/audio data for public release pursuant to California State Laws, for a one year term with four one-year optional renewals; and authorize the Chief of Police, or designee, to administer the agreement and execute and administer any amendments or renewal options.
DISCUSSION:
In October 2018, California Senate Bill 1421 and California Assembly Bill 748 were signed into law and were made effective January 1, 2019 and July 1, 2019, respectively.
The bills, made applicable to every law enforcement agency in the state, require the release of specific investigative documents, as well as audio and video recordings related to critical incidents and certain personnel records related to misconduct. Under Senate Bill 1421, the requirements for release of information focus primarily on personnel investigations involving the discharge of a firearm, use of force by a peace officer, sustained violations of sexual misconduct, and sustained violations of truthfulness.
Additionally, the requirements for Assembly Bill 748 focus on the mandated release of audio and video recordings for any critical incident as defined by the bill.
The Anaheim Police Department (APD) is required to review administrative and criminal investigations, most of which contain both video and audio evidence. For each case requiring release, the process includes viewing body-worn camera (BWC) footage, listening to hours of audio recordings, and reviewing all related documents related to each individual investigation. The selected contractor, GNB Consulting, has been performing the work for the last five years, and possesses the requisite experience and specific knowledge of APD’s BWC and data storage platform, and has successfully produced the materials to be released.
Agreement with Garet Bonham, dba GNB Consulting, Inc. for Data Release November 28, 2023
IMPACT ON BUDGET:
Sufficient funds are available in the Police Department’s FY 2023/24 General Fund budget. Future years will be subject to Council approval of budget appropriations.
Respectfully submitted,
Rick P. Armendariz
Chief of Police
