HOUSING AUTHORITY AGENDA REPORT
City of Anaheim
HOUSING & COMMUNITY DEVELOPMENT
DEPARTMENT
DATE: DECEMBER 12, 2023
FROM: HOUSING & COMMUNITY DEVELOPMENT DEPARTMENT
SUBJECT: APPROVAL OF FIRST AMENDMENT TO PROFESSIONAL
SERVICES AGREEMENT WITH OVERLAND, PACIFIC &
CUTLER, LLC
ATTACHMENT (Y/N): YES ITEM # 02
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the Governing Board of the Anaheim Housing Authority, by Motion, approve a First Amendment to the Professional Services Agreement by and between the Anaheim Housing Authority and Overland, Pacific & Cutler, LLC, for on-call professional services to provide relocation guidance and assistance to eligible parties impacted by development activities, by extending the term for one-year, January 1, 2024 to December 31, 2024, and increasing the contract authority from $100,000 to $200,000; and authorize the Executive Director, or her designee, to execute and administer the Agreement on behalf of the Anaheim Housing Authority.
DISCUSSION:
The Anaheim Housing Authority’s (Authority) primary mission is to increase access to affordable housing opportunities for low-income households who live or work in Anaheim.
Key strategies employed by the Authority to advance the production of affordable units includes the acquisition of opportunity sites and as needed, assembling of sites to create a more viable development parcel. At times, acquisitions may require the relocation of persons residing in these properties. For example, the Authority recently acquired motels along Beach Boulevard in West Anaheim, that had long term occupants. Federal and State regulations stipulate that persons who are displaced from real property that has been acquired, rehabilitated, or demolished using Federal or State funds are eligible for relocation benefits. Displaced persons must participate in a thorough interview process to determine eligibility and relocation needs before filing a claim with the Authority for relocation benefits. The eligibility review process is conducted by on-call consultants specializing in relocation services.
In January 2018, the Authority solicited Statements of Qualifications (SOQs) for on-call relocation services. Two firms submitted SOQs which were evaluated based on overall experience, services, and knowledge of relocation regulations. Staff selected Overland, Pacific & Cutler (OPC) as the best qualified firm based on experience and familiarity with ongoing relocation projects. The Professional Services Agreement was approved for a two- First Amendment to Professional Services Agreement with Overland, Pacific & Cutler, LLC December 12, 2023
year term, from January 1, 2018, to December 31, 2020, with two (2) additional one-year terms, from January 1 to December 31, 2021, and January 1 to December 31, 2022.
At the end of the initial contract term, OPC was still engaged in ongoing relocation services resulting from the Avon Dakota Neighborhood Revitalization, Tampico Motel, and Anaheim Lodge acquisitions. On January 10, 2023, the Authority implemented a sole source Professional Services Agreement (Agreement) with OPC to ensure uninterrupted relocation services in support of the ongoing projects detailed above. The Agreement was for a one-year term, January 10, 2023, to December 31, 2023, for an amount not to exceed $100,000.
Due to the Authority’s continuing efforts in relocating persons from the recently acquired properties, staff is seeking to extend the Professional Services Agreement (First Amendment) for a one-year term extension ending December 31, 2024, and to increase the contract authority from $100,000 to an amount not to exceed $200,000. The First Amendment will ensure uninterrupted, on-going implementation of relocation services in support of the projects detailed above.
Staff anticipates completing the relocation services for the recently acquired projects to conclude during the one-year extension to the First Amendment with OPC. Consequently, staff intends to solicit Statements of Qualifications (SOQs) in 2024 to identify the best- qualified firm to provide the department with future relocation services.
IMPACT ON BUDGET:
There is sufficient budget authority in the Housing & Community Development’s Fiscal Year 2023/24 budget to cover these expenses.
Respectfully submitted,
Grace Ruiz-Stepter
Executive Director
