HOUSING AUTHORITY AGENDA REPORT
City of Anaheim

HOUSING & COMMUNITY DEVELOPMENT

DEPARTMENT
DATE: DECEMBER 12, 2023
FROM: HOUSING & COMMUNITY DEVELOPMENT DEPARTMENT
SUBJECT: HOUSING SUCCESSOR ANNUAL REPORT
ATTACHMENT (Y/N): YES ITEM # 01
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the Governing Board of the Anaheim Housing Authority, by Motion, receive and file the Housing Successor Annual Report, and authorize the Executive Director, or her designee, to submit the Annual Report as a part of the City’s Annual Report on the City of Anaheim’s General Plan submitted to the State Department of Housing and Community Development pursuant to Government Code Section 65400.

DISCUSSION:

Parts 1.8 and 1.85 of the California Health and Safety Code, as modified by the Supreme Court's opinion in California Redevelopment Association, et al. v. Ana Matosantos, et al., Case No. S194861 and as amended by Assembly Bill 1484 and other subsequent legislation (together, the Dissolution Law) caused the dissolution of all California redevelopment agencies as of February 1, 2012 and established a process to select successor agencies to administer the winding down of the affairs of the former agencies.

Pursuant to the Dissolution Law, on January 24, 2012, the City Council elected to have the City of Anaheim serve as the Successor Agency to the Anaheim Redevelopment Agency (former Agency). In addition, the City Council elected not to assume the responsibility for performing housing functions of the former Agency, but instead selected the Anaheim Housing Authority (Housing Authority) to act as the housing successor (Housing Successor). Subsequently, the Housing Authority elected to act as the Housing Successor.

On October 13, 2013, the Governor signed into law Senate Bill 341 (SB 341), which amends provisions of the Dissolution Law, in particular relating to housing successors.

SB 341 amended the former housing annual report requirement due to both the State Controller and the Department of Housing and Community Development while Redevelopment Agencies were active and established affordable housing requirements to be performed by housing successors effective January 1, 2014. As of dissolution, housing successors now maintain and deposit funds into a Low and Moderate Income Housing Asset Fund (LMIHAF), which fund is subject to the requirements of the Dissolution Law, as amended by SB 341. Further, under SB 341, housing successors have an annual auditing and reporting obligations to be completed within six months after Housing Successor Annual Report

the end of the fiscal year starting with Fiscal Year 2013-2014. The Authority prepared an independent financial audit and the attached Housing Successor Annual Report (Annual Report) relating to the LMIHAF and the activities of the Housing Successor in the prior fiscal year. The Annual Report sets forth certain details of the Anaheim Housing Authority activities during Fiscal Year 2022-2023, as required by Section 34176.1(f) of the Dissolution Law such as available funds, affordable housing expenditures, and development status of affordable housing assets and is intended to provide the Housing Authority Governing Board, acting as the Housing Successor, an annual report on the housing assets and activities of the Housing Successor pursuant to the Dissolution Law.

In Fiscal Year 2022-2023 LMIHAF funds were expended to acquire properties on Beach Boulevard including the Covered Wagon, the Anaheim Lodge and to provide gap financing for projects such as the North Harbor Permanent Supportive Housing Project.

The LMIHAF fund balance for Fiscal Year 2022/23 is $18,112,239. Approximately $12,000,000 were expended during Fiscal Year 2022/23 for property acquisitions and relocations, gap loans, environmental assessments and clean-up, demolition of structures and asset management.

The Annual Report also requires that the former Agency’s pre-dissolution Implementation Plans be made available to the public on the City’s website. The Annual Report is based upon information prepared by Housing Successor staff and information contained within the independent financial audit of the LMIHAF included in the City of Anaheim Annual Comprehensive Financial Report for Fiscal Year 2022-2023 as prepared by KPMG, LLP. This Report conforms with and is organized into sections I through XI, inclusive, pursuant to Section 34176.1(f) of the Dissolution Law.
