CITY COUNCIL AGENDA REPORT
City of Anaheim
HUMAN RESOURCES DEPARTMENT
DATE: JANUARY 23, 2024
FROM: HUMAN RESOURCES DEPARTMENT
SUBJECT: RESOLUTION APPROVING A LETTER OF UNDERSTANDING
BETWEEN THE CITY OF ANAHEIM AND THE ANAHEIM
POLICE ASSOCIATION
ATTACHMENT (Y/N): YES ITEM # 21
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Resolution, approve a Letter of Understanding between the City of Anaheim and the Anaheim Police Association (“APA”), changing classification titles and amending applicable articles and salary schedules of the June 28, 2019 through July 3, 2025 Memorandum of Understanding (“MOU”) between the City of Anaheim and the APA to reflect the new classification titles, effective the pay period beginning February 2, 2024.
DISCUSSION:
Chapter 1.05 of the Anaheim Municipal Code establishes the City’s Personnel System and vests the Human Resources Director with the responsibility for ensuring the appropriateness of classifications based upon the type and level of duties and responsibilities performed. This occasionally requires modifying classifications to meet operational needs.
In accordance with Section 1.05.020 of the Municipal Code, the Human Resources Director recommends changing the classification titles of the i) Bailiff, ii) Corrections Officer, and iii) Corrections Facility Supervisor classifications (hereinafter “Corrections Classifications”) by adding Police Reserve Level III to the title of each classification title.
The primary duties of employees serving in these classifications relate to enforcing policies and maintaining protocols at the City detention facility, specific to the custody, housing, and meal provisions for arrestees.
Since 2017, incumbents in the corrections classifications have been required to complete Level III Reserve Peace Officer training to provide a statutory basis under Penal Code §832.6, which allows incumbents in these classifications to provide armed transport of persons in custody without immediate supervision by sworn police officers.
Changing Classification Titles of Bailiff, Corrections Officer, and Corrections Facility Supervisor January 23, 2024
All incumbents Corrections Classifications have completed the required training and are sworn as Level III Reserve Peace Officers. In this status, incumbents have limited peace officer powers only while on duty and in the performance of responsibilities that do not require general law enforcement powers.
To appropriately reflect the nature of the duties and responsibilities related to the Level III Reserve Officer role, in addition to the non-peace officer assignments performed by incumbents in their respective classifications, staff recommends a title change to recognize the Police Reserve Level III status.
The classification of Bailiff is recommended to be renamed Bailiff / Police Reserve Level III. The Corrections Officer is recommended to be renamed Corrections Officer / Police Reserve Level III. The Corrections Facility Supervisor is recommended to be renamed Corrections Facility Supervisor / Police Reserve Level III. All incumbents shall assume the new classification title. This recommended action will not increase the Police Department’s position count.
As reflected in the attached Letter of Understanding between the City of Anaheim and the APA, the APA agrees with the recommendations related to changing classification titles and amending various articles of the MOU and Appendix “A-1” - Wages to reflect the new classification titles. Approval of this Letter of Understanding by the City Council is required for incorporation of the proposed classification changes into the City’s personnel system.
IMPACT ON BUDGET:
The recommended changes will not result in any budget impact.
Respectfully submitted,
Linda N. Andal
Human Resources Director
