The work to be performed for this project generally consists of rehabilitating the roadway by removing and reconstructing asphalt concrete, sidewalks, ADA access ramps, driveway approaches, curbs & gutters, pavement markings, repainting curbs and all appurtenant work as shown on the plans and specifications. The bid price of $9,163,000 reflects the current bidding environment, appears to be reasonable, and is within the available funding.

Liquidated damages for this Project shall be $4,000 per calendar day.

Construction is scheduled to begin in the spring of 2024 and should be completed by the spring of 2025.

ENVIRONMENTAL DETERMINATION:

In accordance with CEQA (Public Resources Code Sections 21000–21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), the City of Anaheim, as Lead Agency, is required to determine if the Project is exempt from CEQA.

Upon review of the CCR, staff recommends that the City Council determine the Project is Categorically Exempt from CEQA pursuant to Class 1, Section 15301 (Existing Facilities) of Title 14 of the CCR, which allows for the repair, maintenance, or minor alteration of existing public or private structures, involving negligible or no expansion of use beyond that existing at the time of the Lead Agency’s determination.

After determining that this Project is Categorically Exempt from CEQA, the City will file a Notice of Exemption with the County Clerk, which starts a 35-day statute of limitations for challenges of the decision.

COMMUNITY WORKFORCE AGREEMENT (CWA):

This Project is covered “Project Work” as defined in the CWA the City entered into with the Los Angeles/Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions.

IMPACT ON BUDGET:

Adequate funding is available from restricted Transportation Funds, Wastewater Funds, and Public Utilities’ Water Utility and Electrical Utility capital funds in the Public Works and Public Utilities Department’s FY 2023/24 budgets.

Respectfully submitted,
Rudy Emami
Director of Public Works
