The work on the Project consists of replacement of uneven and broken sidewalks, curb and gutter, drive approaches and all appurtenant work as shown on the plans and delineated in the specifications.
The Project is part of an annual arterial sidewalk concrete rehabilitation program started in 2016 to address replacement of damaged and displaced sidewalk panels, curb and gutter, and drive approaches on arterial streets throughout the city. The program is intended to restore sidewalks to City standards and improve pedestrian mobility. Under this program, the Public Works Department has completed nine projects from the west end of the City to the east end of the City over a period of seven years from 2016 to 2023. A summary of the locations, costs, and quantity of replacements is shown on Attachment 2. These projects are hereby referred to collectively as “Cycle 1”, marking the completion of projects on every major arterial street in the City with the exceptions of Beach Boulevard, the Resort Area, and the Platinum Triangle.
The subject Project will return to the western region of the City and will include localized arterial sidewalk repairs and replacements from the western city limits up to and including Brookhurst Street (Attachment 3). The subject Project is therefore denoted as the first project of “Cycle 2”. This project will address maintenance issues that have arisen on arterial sidewalks since the completion of the Cycle 1 projects in this area in 2016 and 2017. Staff has observed that the maintenance and repair issues to be addressed on Cycle 2 projects tend to be less severe than on Cycle 1. For this reason, the available funding enables staff to broaden the total area covered by the project as compared to Cycle
1. Proposed Cycle 2 projects are shown on Attachment 3, and are anticipated to be completed over the period commencing with this Project and completing in 2031, pending budget approval and adoption of future fiscal years. Proposed Cycle 2 projects also include the Resort Area and Platinum Triangle as distinct phases.
The bid from We R Builders, Inc. for this project is found to be responsive and favorable compared to the engineer’s estimate, appears to be reasonable, and is within available funding.
Construction is scheduled to begin this February and be completed in April 2024. Liquidated damages for this project shall be $2,000 per day.
Award of Contract for Arterial Sidewalks Removal and Replacement at Various Locations – Cycle 2 - Phase 1 January 23, 2024
COMMUNITY WORKFORCE AGREEMENT (CWA):
This project is not a covered “Project Work” as defined in the Amended and Restated Community Workforce Agreement dated October 5, 2021 with the Los Angeles / Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions. The size and scope of this project does not meet the definition of “Project Work” as defined in the CWA; therefore this project is exempt.
ENVIRONMENTAL DETERMINATION:
Upon review of the California Code of Regulations (CCR), staff recommends the City Council determine that the Project is Categorically Exempt from CEQA pursuant to Class 1, Section 15301 (Existing Facilities) and Class 2, Section 15302 (Replacement or Reconstruction) of Title 14 of the CCR. Section 15301 allows for the repair, maintenance, or minor alteration of existing public improvements and Section 15302 allows for the replacement or reconstruction of existing improvements that will be in the same site and will have substantially the same purpose and capacity. The proposed improvements will be restoring and repairing the existing concrete located within existing street right-of-way with no expansion of capacity. Staff will file a CEQA Notice of Exemption (NOE) with the County Clerk, which starts a 35-day statute of limitations for challenges of the decision, upon approval by the City Council.
IMPACT ON BUDGET:
Sufficient funding for this project is available in restricted transportation funds in the Public Works FY 2023/24 budget.
Respectfully submitted,
Rudy Emami
Director of Public Works
