CITY COUNCIL AGENDA REPORT
City of Anaheim
HUMAN RESOURCES DEPARTMENT
DATE: JANUARY 23, 2024
FROM: HUMAN RESOURCES DEPARTMENT
SUBJECT: RESOLUTION APPROVING A LETTER OF UNDERSTANDING
CREATING A CLASSIFICATION ASSIGNED TO THE
ANAHEIM POLICE ASSOCIATION, RATE OF
COMPENSATION AND MODIFYING THE JUNE 28, 2019
THROUGH JULY 3, 2025 MEMORANDUM OF
UNDERSTANDING EFFECTIVE FEBRUARY 2, 2024
ATTACHMENT (Y/N): YES ITEM # 20
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Resolution, approve a Letter of Understanding between the City of Anaheim and the Anaheim Police Association (“APA”) creating a classification (Police Officer-Digital Forensics Investigator), approving the rate of compensation and amending the appropriate provision of the June 28, 2019 through July 3, 2025 Memorandum of Understanding (“MOU”), effective the pay period beginning February 2, 2024.
DISCUSSION:
Chapter 1.05 of the Anaheim Municipal Code establishes the City’s Personnel System and vests the Human Resources Director with the responsibility for ensuring the appropriateness of classifications based upon the type and level of duties and responsibilities performed. This occasionally requires adding classifications to meet operational needs.
In accordance with Section 1.05.020 of the Municipal Code, the Human Resources Director supports the Police Department’s request and recommends creation of a new classification of Police Officer–Digital Forensics Investigator and assignment of compensation for the classification based on the following:
Digital forensics investigation serves a vital role within the operations of the Police Department with mission critical involvement in major criminal cases including homicides, sexual assaults, high tech and cyber-crimes, internet child exploitation cases, and property and larceny cases. The key duties and responsibilities of the proposed classification include conducting forensic data extractions of various digital media devices, such as computers and cellular devices, preparation of search warrants for Creation of Police Officer – Digital Forensics Investigator Classification January 23, 2024
search of cloud based platforms and telecommunication companies, preparation of forensic police reports on data examinations, and provide expert testimony in legal proceedings. This position requires the incumbent to maintain ongoing specialized training as well as meet rigorous certification requirements. Currently, responsibilities related to digital forensics investigation are being performed under a Police Officer classification.
The Police Department has a specialized classification, Police Officer – Polygraph Examiner, that is assigned a salary relationship equivalent to 120% the Police Officer classification pay range in recognition of the classification’s unique, high-level responsibilities and extensive training and certification requirements. The specialized nature of this existing classification is comparable to the proposed classification.
In order to maintain internal alignment with city classifications with similar levels of duties, responsibilities, and qualifications, the Human Resources Director concurs with the Police Department's request to recommend the creation of the classification Police Officer – Digital Forensics Investigator and set the compensation for the classification on a six-step (i.e., Steps 5-10) pay range subject to a salary relationship equivalent to 120% the Police Officer classification. This will place the Police Officer – Digital Forensics Investigator at a minimum base hourly rate of $54.91 and maximum base hourly rate of $70.09, equivalent to the Polygraph Examiner classification. The proposed classification will not add to the department’s full-time equivalents (FTE) count.
As reflected in the attached Letter of Understanding between the City of Anaheim and the APA, the APA agrees with the recommendations related to the addition of the classification, assigned pay range and salary relationship pay policy. Approval of this Letter of Understanding by the City Council is required for implementation of the proposed addition of the classification to the City’s personnel system.
IMPACT ON BUDGET:
The cost to implement the recommendation is approximately $8,350 for the remainder of FY 2023/24 and estimated to be $27,000 over the remainder of the MOU. The Police Department has sufficient appropriation to support the recommendation.
Respectfully submitted,
Linda N. Andal
Human Resources Director
