CITY COUNCIL AGENDA REPORT
City of Anaheim
HOUSING AND COMMUNITY DEVELOPMENT
DEPARTMENT
DATE: FEBRUARY 13, 2024
FROM: HOUSING AND COMMUNITY DEVELOPMENT DEPARTMENT
SUBJECT: PROFESSIONAL SERVICES AGREEMENTS FOR ON-CALL
PROFESSIONAL LABOR COMPLIANCE SERVICES
ATTACHMENT (Y/N): YES ITEM # 13
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Motion, approve four separate Professional Services Agreements, substantially in the form attached, by and between the City of Anaheim (City) and the Anaheim Housing Authority (Authority) with Comprehensive Housing Services, Inc. (CHS); GCAP Services, Inc. (GCAP); Opportunity Marketing Group, Inc. (OMG); and Willdan Engineering (Willdan); in a not-to-exceed amount of $200,000 per Agreement; each for a two-year term, beginning February 13, 2024 with two, one-year renewal options; for on-call labor compliance services to support state and federally funded housing and capital improvement projects; authorize the Director of the Housing and Community Development Department, or her designee, to execute, implement, and administer the Agreements on behalf of the City and/or the Authority; and authorize de minimis changes that do not substantially change the terms and conditions of the agreements as determined by the Office of the City Attorney.
DISCUSSION:
The Housing and Community Development Department (Department) is the administrator of several federal programs on behalf of the City and is also tasked with overseeing the activities of the Anaheim Housing Authority (Authority), While each program has specific and distinct goals, objectives and program requirements, there are instances where the needs of both entities, the City and the Authority overlap. Labor compliance, which involves ensuring that construction work that is financed in whole or in part with federal funds adheres to certain Federal labor standards requirements is one such area. Therefore, for efficiency purposes, the City Attorney’s Office recommended the Department enter into contracts as both the City and the Authority thus eliminating the need to enter into two contracts with the same contractors, for the same type of work.
Labor compliance consultants conduct weekly on-site interviews, review the weekly certified payroll documents from each contractor, and ensure that every employee receives the state or federally mandated wages for the duration of each project. Current examples of projects requiring labor compliance oversight include several public facility improvement projects such as the Brookhurst Splash Pad, Rio Vista Park, the Brookhurst Professional Services Agreements for On-Call Professional Labor Compliance Services February 13, 2024
Teen Center, and other capital improvement projects funded by the Community Development Block Grant (CDBG) program.
To identify qualified contractors, the Department released a Request for Proposal (RFP) for labor compliance services in October 2023 and received proposals from six firms. In accordance with the qualifications-based selection procurement process outlined in City Council Policy No. 4.1, the Department established a review panel comprised of Department staff who have direct knowledge of federal labor compliance requirements.
The panel ranked the proposals utilizing the following set of criteria: understanding of the scope of work as identified in the RFP, qualifications of consultant staff, experience with federal and state regulations, and reasonableness of the consultant fee schedule. The panel identified four firms that met the qualifications as outlined in the RFP:
Comprehensive Housing Services, Inc. (CHS); GCAP Services, Inc. (GCAP); Opportunity Marketing Group, Inc. (OMG); and Willdan Engineering (Willdan). Staff recommends all four on-call consultant contracts to ensure there are sufficient resources and technical expertise to advance the volume and complexity of housing and capital improvement projects presently underway, and the number of projects anticipated in the next few years.
In compliance with City Council Policy No. 4.1 and under the Terms of the Agreements, the consultants will each submit project-specific proposals when services are requested, allowing staff to choose the lowest bid. The maximum not-to-exceed contract amount is $200,000 per consultant. This amount is based on cost of past projects, scope of upcoming projects, and the varying level of specialized service required for each project.
The term of each agreement is two years, beginning February 13, 2024 with two, one- year optional renewals, for a potential total of four years. After these contracts expire, the Department will issue a new RFP in order to ensure that costs remain competitive and to provide opportunities for other consultants to participate.
IMPACT ON BUDGET:
The funds for these agreements are available in the Housing and Community Development’s Fiscal Year 2023/24 budget.
Respectfully submitted,
Grace Ruiz-Stepter
Director of Housing & Community Development
