CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: FEBRUARY 13, 2024
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: THIRD AMENDMENT TO COOPERATIVE AGREEMENT NO.
C-4-1714 WITH ORANGE COUNTY TRANSPORTATION
AUTHORITY FOR THE ANAHEIM CANYON METROLINK
STATION IMPROVEMENT PROJECT
ATTACHMENT (Y/N): YES ITEM # 16
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Motion, approve Amendment No. 3 to Cooperative Agreement No. C-4-1714 (Amendment) with Orange County Transportation Authority (OCTA) for the Anaheim Canyon Metrolink Station Improvement Project (Project) increasing the reimbursable funds to the City by $40,000 for a total amount not to exceed $383,000, and extending the termination date to December 31, 2024; and increase the Department of Public Works revenue and expenditure budget for FY 2023/24 in the amount of $40,000.
DISCUSSION:
On January 9, 2015, City Council approved the Cooperative Agreement No C-4-1714 between the City and OCTA to define roles and responsibilities for the Project. Under the agreement, OCTA was the lead agency responsible for all phases of the Project including the administration of grant funding, design, environmental clearance, construction, and to reimburse the City for all cost in providing support during the design and construction of the Project up to $173,000.
On December 3, 2019, City Council approved the First Amendment to Cooperative Agreement No. C-4-1714 between the City and OCTA to increase the reimbursable funds to the City by $100,000 for a total of $273,000, to extend the termination date to December 31, 2022, and to compensate OCTA $40,840 for construction costs to extend a casing to protect an existing City owned sewer line.
On August 9, 2022, City Council approved the Second Amendment to Cooperative Agreement No. C-4-1714 between the City and OCTA to increase the reimbursable funds to the City by $70,000 for a total not to exceed amount of $343,000, to extend the termination date to December 31, 2023, and to compensate OCTA $39,800 for construction costs to build a protective slab over a City owned water line.
The Project is complete and consists of a second mainline track and platform, extending the existing platform, additional shade structures, benches, another ticket vending Third Amendment to Cooperative Agreement No. C-4-1714 with Orange County Transportation Authority for the Anaheim Canyon Metrolink Station Improvement Project

machine, landscaping and irrigation, water quality features, a traffic signal modification and other appurtenant work. This Project benefits residents, visitors, and businesses of Orange County by facilitating track improvements that will allow OCTA to create a more robust service for Metrolink at the Anaheim Canyon Metrolink Station and improve on- time service between the Inland Empire and Orange County.
Due to several changes during the construction phase of the Project that needed to be reviewed, approved, permitted, and inspected by the City, the City’s efforts increased after the Second Amendment to the original agreement. Some of these changes were caused by unforeseen field conditions and others were needed due to value engineering proposals by OCTA’s contractor. There were also additional City overtime inspections and police assistance required during additional weekend railroad crossing closures that were not originally anticipated. Therefore, this Amendment will provide for an increase in reimbursable funds to the City by $40,000 for a total of $383,000 to cover the additional City related engineering costs, administration costs, and inspection fees that the City incurred during construction. Furthermore, it is expected that an additional increase in reimbursable funds to the City up to $35,000 may be needed after the Record Drawing plans are received, reviewed, and approved. OCTA has agreed to the additional reimbursement requirement, however, they requested a separate amendment for that additional increase be made after this fiscal year.
The Amendment will also extend the termination date from December 31, 2023 to December 31, 2024 to allow for the closeout of permits, processing of final Record Drawing plans, and processing of the final invoice to OCTA. The platform extension and second platform have been in service since January 30, 2023. The City is currently awaiting the submittal of the Record Drawing plans to close out the City issued permits.
IMPACT ON BUDGET:
Approval of this Amendment would increase the Department of Public Works revenue and expenditure appropriations for FY 2023/24 by $40,000 in restricted transportation funds.
Respectfully submitted,
Rudy Emami
Director of Public Works
