CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: FEBRUARY 27, 2024
FROM: PUBLIC WORKS DEPARTMENT
SUBJECT: RESOLUTION UPDATING THE CITY OF ANAHEIM’S TITLE

VI PLAN
ATTACHMENT (Y/N): YES ITEM # 23
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Resolution, approve and adopt the updated City of Anaheim Title VI Plan and authorize its submittal to the California Department of Transportation (Caltrans) and Federal Transit Administration (FTA); and determine its action is exempt from the California Environmental Quality Act (CEQA) pursuant Section 15060(c)(3) ) of Title 14 of the California Code of Regulations because it is not a project as defined in Section 15378.

DISCUSSION:

The City of Anaheim (City), on behalf of the Anaheim Transportation Network (ATN), has submitted various FTA grant applications to support ATN’s efforts at transitioning to a zero-emission fleet.

During post-award discussions with FTA, the City and ATN were advised that various federal requirements would need to be satisfied in order for the city to receive (and ultimately passthrough) FTA grants to ATN. These requirements generally include executing a direct recipient agreement with FTA, executing a subrecipient agreement with ATN, adhering to various federal administrative, accounting, auditing, and compliance requirements, and complying with the FTA’s Civil Rights Act of 1964 (Title VI) requirements, which prohibit discrimination based on race, color, or national origin in federally funded programs, including public transportation.

As a first step, staff is proposing in the recommendation to update the City’s Title VI plan to ensure compliance with the FTA’s Title VI requirements. The City’s Title VI Plan, consistent with federal requirements, identifies the process by which the city complies with Title VI requirements (specified above), ensures public participation, and resolves grievances. The currently proposed changes to the City’s existing Title VI plan are relatively minor and are identified in track changes, in the third attachment to the Resolution Updating the City of Anaheim’s Title VI Plan February 27, 2024

staff report.

The proposed changes generally consist of noting that FTA funds can be sub awarded by way of a subrecipient agreement and establishing a subrecipient monitoring plan to manage and direct monitoring efforts of the City’s subrecipient(s).

Upon City Council approval of these proposed updates and the attached resolution, these documents will be submitted to both Caltrans and FTA. Once these agencies accept these documents, staff will begin working with FTA and ATN to address the other outstanding requirements, so that awarded FTA grant funds can be received by the City and passed through to ATN as expeditiously as possible.

IMPACT ON BUDGET:

This proposed Title VI Plan update does not have a budget impact. Once all FTA funding requirements have been satisfied, staff will return with appropriate agreements, if necessary, and propose any required budget adjustments at that time.

Respectfully submitted,
Rudy Emami
Director of Public Works
