CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: FEBRUARY 27, 2024
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: FINAL MAP AND SUBDIVISION AGREEMENT OF TRACT NO. 19192
ATTACHMENT (Y/N): YES ITEM # 16
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Motion, approve the Final Map and Subdivision Agreement of Tract No. 19192 with OrangeAve 2024, LLC for a proposed residential condominium project comprised of 24 attached single-family townhomes with open space, private drives, and landscaped areas, located at 2219 W. Orange Avenue, and direct and authorize the Mayor and City Clerk to execute same.
DISCUSSION:
OrangeAve 2024, LLC, is the developer of the proposed residential subdivision located at 2219 W. Orange Avenue and Faith Lutheran Church of Anaheim is the owner/subdivider of the property.
The property is being subdivided into two lots. Faith Lutheran Church of Anaheim will remain on Lot 1. The developer desires to purchase Lot 2 and establish a subdivision for condominium purposes comprised of 24 attached single-family townhomes with open space, private drives, and landscaped areas via a final map, as required by the Subdivision Map Act. The Final Map number is 19192. It contains a gross area of 2.788 acres and a net area of 2.365 acres. The engineering for the development project is being provided by C&V Consulting Inc. of Irvine, California.
The Tentative Map No. 19192 was approved by the City Council on February 28, 2023, in conjunction with General Plan Amendment No. 2023-012; and Conditional Use Permit No. 2023-013 to allow for the construction of a residential development consisting of 24 residential townhomes. The Final Map has been checked and found to be technically correct and substantially the same as it appeared on the Tentative Map as approved by the City Council.
There is a portion of right-of-way along the frontage of Tract 19192 that is not needed as per the City’s Planned Roadway Network. The developer has initiated an abandonment process for that portion along the frontage of Lot 2, for which staff is preparing an item to be presented to City Council at a later date for approval.
Final Map and Subdivision Agreement of Tract No. 19192
February 27, 2024
The proposed tract development is intended to provide quality single-family housing with private drives, common space areas, and other amenities including public improvements. The required public improvements include curb widening, sidewalk relocation, parkway construction and landscaping improvements along the frontage of Orange Avenue. These improvements are consistent with the city of Anaheim General Plan and the conditions of approval for the Tentative Map and will continue to enhance the city's infrastructure and circulation in the project area.
As part of the map approval, the developer is required to enter into a Subdivision Agreement with the city. Approval of the agreement is necessary to ensure that the developer completes all off-site public improvements to the property and that the work is performed by the developer at his sole cost. The agreement requires that the developer provide security for the cost of the improvements to ensure the new homes will have the required infrastructure to service the development, and the developer has posted these bonds. In the event that the developer is not able to complete the work due to unforeseen circumstances, the city may utilize the security bond through the bonding entity to complete the improvements as directed by the City Engineer.
