I. GENERAL
The following changes, additions, or deletions shall be made as indicated, and all other conditions shall remain the same.

II. DESIGN-BUILDER QUESTIONS AND ANSWERS
Q1 Items 1 and 2 under the Minimum Requirements of the subject RFP generally states that responsible charge for the Geotechnical Services will be managed/supervised by a registered professional (i.e. Certified Engineering Geologist (CEG) or Geotechnical Engineer (GE). However, in accordance with the State Board of Registered Professional Engineers and Geologists, there is a clear separation between the two registrations. For example, The State defines a Certified Engineering Geologist as specialty certification in the discipline of geology but does not allow a CEG the authority to certify engineering work related to soil engineering and vise versa. In addition, a GE is a practicing registration (specialty) for Registered Professional Engineers (PE) that affords the PE the authority to use the practicing title of Geotechnical Engineer. In that regard, a PE practicing in the field of soil engineering as a specialty engineering practice may still certify soil engineering work but cannot use the practicing title of Geotechnical Engineer. Is the City of Anaheim implying in the minimum requirements that it accepts the certification of soil engineering testing and practices as a replacement or substitute for the GE oversight and responsible charge? I’ve attached a FAQ document provided by the California Board of Professional Engineers Land Surveyors and Geologists should additional information be required.

A1 The City of Anaheim’s intent is to have a Registered Professional manage/supervise the geotechnical services project in accordance with California Board for Professionals Engineers, Land Surveyors and Geologist and practice with limitations allowed by the board.

Q2 Can you confirm can we submit on each individual category or must we be able to complete all three?
A2 Yes, you can submit on each category or all that are applicable to the consultant firm or team. Please submit only one proposal that outlines each category that your firm will complete.

Page 2 of 2 ends

Q3 Will the city accept submittal from firms willing to do portions of the work that are not subject to the CWA?
A3 Yes, if a consultant is unable to comply with the Community Workforce Agreement (CWA) their agreement will have the section referencing CWA redacted from their agreement. The consultant(s) can still perform non-CWA work.

Q4 We would like the following changes considered to the sample contract.

Please advise if these are acceptable:

1. Addition of limit of liability based on contract size.

2. Add a waiver of consequential damages.

3. Removal of language that implies a duty to defend.

4.Removal of required warranties, which implies indemnification – our insurance prohibits us from offering warranties or guarantees.

5. We cannot have the city listed as primary on our Worker’s Compensation or Professional Liability insurance, although this contract requires it.

A4 After consulting with the City’s legal team, the City cannot consider the above-mentioned changes.

Q5 Should rates sheets for drilling and/or traffic control subcontractors be included as part of our fee schedule submittal?
A5 The rate sheets for subcontractors if necessary can be included in the Appendix.

Q6 For references, are we to provide a total of 3 (past and present) working references? Or, are we to provide a total of 6 references which includes 3 past working references and 3 present working references? A6 A total of three (3) working references which should include at least one (1) past and one (1) present working, the third can be either a past or present working reference.

3. PROJECT UNDERSTANDING AND APPROACH
GAI understands that the City of Anaheim is seeking to retain services from qualified consulting engineering firms on an “on-call as-required on a short notice” basis to provide soils testing and inspection, geotechnical engineering, certified deputy building inspection, materials testing, and environmental engineering & science services for future City capital construction contracts. The City will award agreements to provide the above services for a period of two (2) years . The agreements may be renewed for a maximum of two (2) additional terms of two (2) years each , subject to satisfactory performance and at the sole discretion of the City. The initial term of services is anticipated between April 2024 and April 2026, with the City’s option to extend through April 2026 and April 2028.

The comprehensive services to be provided under the agreements by the consultant firm or team will be in three major categories:
1) Soil engineering, testing and inspection.
2) Deputy building inspection and materials testing.
3) Environmental engineering & science services.

GAI is submitting our proposal for Category 1: Soil engineering, testing and inspection. Soil engineering, testing and inspection shall cover preliminary site investigations for roadway and building construction including analysis of site soils, foundation design, excavation and backfill, pavement thickness design and related information required for the design or construction of City facilities. GAI’s testing laboratory is a participant in the Caltrans Independent Assurance Program approved to perform testing on State Federal and Highway construction projects and possesses certifications in AASHTO, ASTM, DSA, etc.

GAI’s project manager and founding principals have more than 39 years of experience, and have worked on locally, state and federally funded projects. They are well familiar with the Greenbook Standard Plans and Specifications, Caltrans Test Methods (CTM), Caltrans Highway Design standards and geotechnical report preparation protocols, and ASTM testing procedures. Our team has recently completed and is currently working on several federally funded Capital Improvement Projects. We are thoroughly familiar with the requirements of Caltrans’ Local Assistance Program and Local Assistance Procedures Manual (LAPM) for federally funded projects; as well Standard Specifications for Public Works Construction (Greenbook), BNi; and Standard Plans for Public Works Construction.

GAI’s general approach for geotechnical engineering/investigation and geotechnical construction observation and testing is described below.

3.1. Methodology and Work Plan

3.1.1. Approach to Geotechnical Engineering/Investigation and Pavement Engineering and Engineering Geology (Design Phase)
The City may require us to perform geotechnical investigations, geological study, and geohazard evaluation, geotechnical reports and plan reviews, field and laboratory testing, field compaction testing, and pavement engineering and analysis for different projects. Project Manager Dr. Shawn Ariannia, Ph.D., PE, GE, is the Project Manager for all of the geotechnical investigative scope of work. For geotechnical and pavement engineering investigative projects, we will apply the following approach, broken down into several phases:

A. Pre-Drilling Phase; Literature/Records Review and Site Reconnaissance The following tasks will be performed before the commencement of field exploration work:

1. Schedule and conduct a kick-off meeting with the City’s project manager.

2. Collect all the existing records/as -builts for the said project site in collaboration with the City staff.

3. Prepare a work plan and submit for City’s review and approval.

Proposal No. 24-1003 Geo-Advantec, Inc. Page 16 of 20
January 30, 2024

4. Prepare traffic control plans and submit for the City’s review and approval.

5. Obtain a no-fee permit from the City.

6. Perform site reconnaissance, mark the proposed coring/boring locations for the planned number of exploratory dig-outs.

7. Clarification of underground utilities by contacting Dig-Alert.

B. Field Exploratory Works; Borings, Corings, and Sampling The tasks to be performed for this phase of the project consist of the following:

1. Perform a second site visit prior to drilling/coring and review the marked utility lines by Dig-Alert.

2. Finalize work schedule for field operations and coordinate the drilling days/times with the City.

3. Provide traffic control as required by the City.

4. Perform planned field exploratory borings/corings, extract samples.

5. Perform coring/boring, as required.

6. Backfill the cored holes using approved materials.

7. Collect representative bulk and relatively undisturbed samples of subgrade soils and soils underlying the project site from selected boring/coring location and transfer to the laboratory.

C. Laboratory Testing
The extent of required laboratory tests for geotechnical and pavement engineering projects depends on the intended future work, project type, location, and specifications. For pavement projects, the laboratory testing program will depend on the type of treatment and work to be performed, such as preservation, rehabilitation, and removal and replacement of the existing pavement. The tests typically may include Gradation, Moisture & Density, Atterberg Limits, Expansivity, and R-Value. Tests. R-value test will be performed on selected samples and number of tests will depend on the different type of subgrade materials encountered and the size of the project.

D. Engineering Analysis and Final Report Preparation
At this stage, a thorough engineering analysis will be conducted. For pavement projects, the collected information from field investigation including thicknesses of asphalt and base layers, classifications of subgrade soils, R- value and Expansivity test results, will be utilized into the design process. GAI will coordinate with the City to obtain traffic data and design life information, which will be used in the design. Different rehabilitation alternatives will be studied and prior to finalizing the repor t, GAI will arrange a meeting with the City officials to discuss different alternatives from value engineering standpoint and select the more practical and economical options. Then, the final report will be prepared, which as minimum, will include:

1. Scope of Service.

2. Introduction of coring locations and a site plan showing the location of corings.

3. A discussion about conclusions of our site reconnaissance and summary table(s) providing information about pavement condition including type, severity, and extent of distress at different areas along with the project length.

4. A discussion of the subgrade materials encountered in the corings/borings and their engineering properties, including geotechnical engineering characteristics of the subgrade soils underlying the project limits.

5. Results of pavement sections thickness measurements.

6. Introducing identified locations for full-depth repair, if needed.

7. Results of laboratory tests.

8. Pavement design and construction recommendations including different appropriate alternatives of preservation, and rehabilitation such as mill & Overlay and FDR, etc.

9. Discussion on the design life of each recommended alternative.

10. Pavement design and Construction recommendations for new construction, i.e. removal & replacement and local repairs.

E. Quality Assurance/Quality Control (QA/QC) Procedures for Geotechnical Engineering Tasks/Projects
Our Quality Control (QC) procedure for the geotechnical engineering investigation projects includes:
• Clarifying and entering QC issues into our customized project management programs/logs prior to beginning the project.
• Preparation of coring/boring layout and drilling/sampling schedule for the field engineer and drilling crew. This task will be done by the project manager who is the geotechnical engineer in charge of the project.
• Logging all laboratory samples into our QC system when they are brought in. The responsible geotechnical engineer is consulted for priority or questions on specific test methods to ensure tests are performed per the correct standards. • Performing calculations and analysis, and preparing draft reports • Reviewing all the engineering calculations, analyses and reports by our principal/senior engineers
• Reviewing all the engineering recommendations and designed alternatives/solutions considering their practicality, compatibility with applicable codes, and time and cost impact on the project.
• Overseeing the project schedule in a timely manner, to assure the satisfactory progress of the tasks and coordinating necessary progress meetings with the City’s representative, to meet the project’s schedule.

F. Schedule (Time Control)
For investigation projects, we furnish a specific schedule for each project. The schedule will be managed in-house by using project management tools such as Excel logs and spreadsheets and different project management software such as Microsoft Project. The schedule will also be discussed with the City representative on a regular basis, so that all parties remain informed of the project progress. The specific dates of on -site activities will be addressed on the schedule and will be reviewed with the City before the commencement of the work. The schedule will include phasing milestones which enables the City to monitor and measure the progress of the project, as well as the logical sequence of tasks and durations.

3.1.2. Approach to Geotechnical Construction Observation and Materials Testing (Construction Phase)
The key elements to our success in performing and delivering during construction services are:
• Assigning a full-time project manager, who will be the only point-of-contact. • Effective communication between the PM and the City assigned representative for this project.
• Our project management skills.
• Technical Approach for monitoring, testing, and inspection services. • Scheduling and time control.

C. Quality Assurance/Quality Control (QA/QC) Procedures for Materials Testing Our laboratory is certified by AASHTO (AMRL), CCRL, and Caltrans and as a part of our ongoing Quality Assurance program, we are participating in annual testing programs for these three (3) certifying agencies. GAI conducts in-house semi-annual training courses for the field technicians and inspectors. Our soils technicians carry ICC and Caltrans certifications, and are certified deputy grading inspectors of the City of Los Angeles.

Budget Controlling and Resource Management: Our services are based on the requests/calls we receive from the project/City inspector. The need for our inspectors’ presence at the site is generally affected/controlled by the following factors:
• Quantity of the construction item, e.g. total volume of concrete, volume of welding, etc. • Requirements outlined in the Testing & and Inspection program and the project documents, e.g. periodic, continuous, etc.
• Contractor and subcontractor’s efficiency and sequencing of events. • Unexpected subsurface conditions for grading works.
• Weather conditions and other unforeseen delays.

To better manage the resources and control the budget, we will take the following steps:
• We record all the inspection times and testing fees that are because of re -tests, non- compliances, and contractor’s deficient works. These recorded times and costs will be reported to the client on a monthly basis.
• On all possible occasions, we will use/assign multi -certified inspectors to the jobs. This may help to save money for the client.
• A budget review sheet will be submitted to the client on a monthly basis. The sheet will depict the amount/percentage of the consumed budget versus the progress made per the schedule.
• When about 75% of the budget is consumed, we will request to have a meeting with the client/client’s representative, to evaluate the budget consumption vs. the time schedule and progress made to date by the contractor, and plan for future works or to come up with a realistic supplementary budget for the remaining part of the work, if needed.

No travel time or mileage will be charged for the field inspection services.
