CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: MARCH 19, 2024
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: FINAL MAP AND SUBDIVISION AGREEMENT OF TRACT NO. 19153
ATTACHMENT (Y/N): YES ITEM # 10
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Motion, approve the Final Map and Subdivision Agreement of Tract No. 19153 with Anaheim Real Estate Partners, LLC for a proposed mixed-use development (ocV!BE), subdivision boundary is located by State Route 57 (SR-57) to the west, Santa Ana River and the City of Orange to the east, Union Pacific Railroad to the north, and Katella Avenue to the south, and direct and authorize the Mayor and City Clerk to execute same.
DISCUSSION:
Anaheim Real Estate Partners, LLC, a California Limited Liability Company is the owner and subdivider of the proposed mixed-use development (ocV!BE). The subdivision boundary is located by State Route 57 (SR-57) to the west, Santa Ana River and the city of Orange to the east, Union Pacific Railroad (UPRR) to the north, and Katella Avenue to the south. The project site consists of the Arena Corporate Center (ACC), various commercial and office buildings, surface parking lots, and the Honda Center (which is not a part of the subdivision boundary of the Final Map Tract No. 19153).
The developer proposes to establish 16 numbered-lot and 6 lettered-lot subdivision to construct a mixed-use development project with various development phases within the Final Map Tract No. 19153 boundary. The project is currently undergoing Phase 1 development which consists of street infrastructures, bike paths, parking structures, entertainment areas, dining, office, and retail with open space and private drives.
Future phases of the project within the Final Map Tract No. 19153 boundary will include residential uses, hotels, urban parks, and additional entertainment and retail spaces.
The Tentative Map No. 19153 was recommended for approval by the Planning Commission on August 29, 2022 and approved by the City Council on September 27, 2022, per Resolution No. 2022-108 in conjunction with the General Plan Amendment (GPA2020-00532), Development Agreement (DAG2020-00004), Final Site Plans (FSP2020-00004, 2020-00005, 2020-00006, 2020-00007 and 2020-00008), and Final Map and Subdivision Agreement of Tract No. 19153
March 19, 2024
Amendment to the Conditional Use Permit No. 2010-05492 to allow for the construction of ocV!BE Development Project. The Final Map has been checked and found to be technically correct and substantially the same as it appeared on the Tentative Map as approved by the City Council.
The developer is required to construct public improvements including a new arterial roadway, River Road, between Katella Avenue and Ball Road, widening and median improvements along Katella Avenue, intersection and traffic signal improvements, and public utilities (i.e. sewer, water, and storm drain systems).
Additionally, the Traffic Study has determined the improvements at the Northbound SR- 57/Katella Avenue off-ramp and Southbound SR-57/Ball Road off-ramp are required as part of the Phase 1 development.
The project will also construct new private streets including Stanley Cup Way and the extension of Cerritos Avenue between Douglass Road and River Road with public access easements as dedicated on the Final Map.
The project will require an abandonment of Douglass Road between Katella Avenue and Cerritos Avenue prior to the construction of the proposed private improvements, pursuant to Resolution No. 2022-150 and in conformance with the Development Agreement No. 2020-00004.
As part of the map approval, the developer is required to enter into a Subdivision Agreement (Agreement) with the City. Approval of the Agreement is necessary to ensure that the developer completes all public improvements to the property and that the work is performed by the developer at his sole cost. The Agreement requires that the developer provides security for the cost of the improvements to ensure that the proposed subdivision will construct all public improvements to support the development in its entirety, and the developer has posted these bonds. In the event that the developer is not able to complete the work due to unforeseen circumstances, the City may utilize the security bond through the bonding entity to complete the improvements as directed by the City Engineer.
