ATTACHMENT (Y/N): YES ITEM # 05
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Motion:
1. Approve the professional services agreement, in an amount not to exceed $1,560,808 plus a 10% contingency for as-needed extra services, with Kittelson & Associates, Inc., for consultant services for the Evaluation of Pedestrian Circulation Improvement Options in the Anaheim Resort and authorize and direct the Public Works Director, or designee to execute the Agreement, and take any and all actions as are necessary, required or advisable to implement and administer the Agreement; and
2. Authorize the Finance Director to increase the Public Works FY 2023/2024 budget by $1,900,000 to provide Anaheim Tourism Improvement District (ATID) transportation funding for the Evaluation of Pedestrian Circulation Improvement Options in the Anaheim Resort.
BACKGROUND:
In 2010, the City of Anaheim in collaboration with the Anaheim/Orange County Visitor and Convention Bureau (now known as Visit Anaheim) and a consortium of hoteliers formed the Anaheim Tourism Improvement District (ATID) for the promotion of local tourism and convention-related programs as well as transportation improvements within The Anaheim Resort and the Platinum Triangle. The ATID places a 2% assessment upon all the hoteliers within the ATID boundaries. Of the revenues collected from the ATID assessment, 25% of the funds are placed in a separate transportation fund that is intended to be dedicated to transit or transportation improvements within the ATID boundaries.

A three-member ATID Transportation Committee (ATID Committee) identifies funding priorities and approves expenditures. The Committee is made up of representatives from the following entities: 1) Representative of the City of Anaheim appointed by the Anaheim City Manager; 2) Representative from the largest single contributor in the aggregate by brand to the ATID; and, 3) Representative of the hoteliers as recommended by the Visit Anaheim Board of Directors, who shall also be an owner or operator of an Assessed Facility and a member of the board of directors of the Anaheim Transportation Network (ATN) and approved by the other two representatives on the Committee.
DISCUSSION:
At the May 22, 2023, ATID Committee meeting, staff was directed to develop and initiate a request for proposals (RFP) to evaluate potential pedestrian circulation improvement concepts in the Anaheim Resort (Resort), in light of emerging and planned development in the Resort.
Consistent with this direction, staff posted an RFP on Planetbids on October 20, 2023, with a scope of work specifying the following desired objective (see Attachment 1). To develop, review, screen, and assess the feasibility of pedestrian circulation concepts in the Resort.
To achieve this objective, the selected consultant will need to develop comprehensive pedestrian circulation improvement options for consideration; achieve consensus on preferred proposed circulation improvement options; and initiate feasibility assessments to develop, scope, schedule, and cost estimates for preferred improvement options.
At the conclusion of this effort, these findings will be used to inform future policy decisions and also potentially support environmental scoping.
Consultant proposals were due on December 7, 2023, and as of that date, three proposals were received. In accordance with the qualification-based selection process, pursuant to City Council Policy No. 4.1, Public Works established a review board, reviewed proposals, conducted interviews, and rated the proposals. The rated proposals are listed below in rank order.
Firm Ranking:
1. Kittelson & Associates, Inc.
2. Buro Happold
3. Fehr & Peers
The evaluation criteria included the ability of the consultants to perform the specific tasks outlined in the RFP, qualifications of the specific individuals who will work on the project, amount of time and involvement of key personnel who will be involved in respective portions of the project, reasonableness of the fee requested to do the work, demonstrated record of success by the consultant on work previously performed, and the specific method and techniques to be Amend the Public Works FY 2023/2024 Budget and Enter into a Professional Services Agreement with Kittelson & Associates, Inc. for Consultant Services for the Evaluation of Pedestrian Circulation Improvement Options in the Anaheim Resort March 19, 2024
employed by the consultant on the project. A presentation and an interview evaluation were also conducted for the two highest ranking firms.
The review board concluded that Kittelson & Associates was the most qualified firm based on the evaluation criteria and is therefore recommended to provide professional services for the Evaluation of Pedestrian Circulation Improvement Options in the Anaheim Resort.
This recommendation was presented to the ATID Committee on February 20, 2024, and the Committee concurred, agreeing to fund the project with ATID funds. The ATID funding allocation was for $1,900,000, which includes funds for Kittelson & Associates’ base fee of $1,560,808, contingencies, as well as staff administration time.
Therefore, staff recommends that City Council authorize the Finance Director to increase the Public Works FY 2023/2024 budget by $1,900,000 in order to accept the ATID allocation, approve the attached professional service agreement with Kittelson & Associates in the amount of $1,560,808, and authorize the Public Works Director to execute the agreement and take any and all actions that are necessary, required or advisable to implement and administer the Agreement.
Upon City Council approval of these recommendations, Public Works staff will work to immediately initiate this study effort. Kittelson & Associates’ proposed schedule calls for a twenty-two-month project duration, with regular updates and final reports being provided to the City Council, Planning Commission, and the ATID Committee.
IMPACT ON BUDGET:
This action will increase the Department of Public Works expenditure budget in restricted transportation funds by $1,900,000 for FY 2023/24.
Respectfully submitted,
Rudy Emami
Director of Public Works
