CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: APRIL 2, 2024
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: AMENDMENT TO LEASE AGREEMENT WITH ORANGE COUNTY
WATER DISTRICT FOR THE INSTALLATION OF A CAMERA TO
OBSERVE THE WATER FLOW IN THE SANTA ANA RIVER
ATTACHMENT (Y/N): YES ITEM # 07
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Motion:
1) Approve Amendment One to Lease (Amendment) with the Orange County Water District (OCWD) to allow the installation of a camera on the leased premises for the purpose of observing the water flow in the Santa Ana River; and
2) Authorize the City Manager or designee, on behalf of the City, to execute any related documents and take any and all actions necessary to implement and administer the Amendment.
DISCUSSION:
The OCWD executed an agreement with the City of Anaheim (City) establishing the terms and conditions of selling Groundwater Replenishment System (GWRS) water for the City's Canyon Power Plant. The agreement was later expanded to provide GWRS to the City's Anaheim Regional Transportation Intermodal Center (ARTIC). As part of this expansion, the City agreed to lease a portion of City-owned property to OCWD to construct an injection well that would benefit the City and other cities in north Orange County by increasing the local groundwater supply. On October 18, 2013, City Council approved a Lease Agreement (AGR-7690), which granted OCWD the right to enter on specific City-owned property to install, construct, reconstruct, redevelop, inspect, operate, maintain, and improve said injection well. The City-owned property is an undeveloped land generally located at the south end of ARTIC parking lot B (i.e., the southernmost parking lot "Premises").
OCWD now wishes to use the most southerly portion of the premises to install cameras, poles, solar panels, and related equipment to observe water flow in the Santa Ana River.
OCWD has obtained authorization to enter into the Amendment with the City.
Except for including subsection 1.1.2.1, as detailed in the Amendment, all other terms, covenants, and conditions, including the $1.00 Rental Payment of the AGR-7690, shall remain in full force and effect.
Amendment to Lease Agreement with Orange County Water District for the installation of a camera to observe the water flow in the Santa Ana River
April 2, 2024
IMPACT ON BUDGET:
There is no budgetary impact. Design, construction, operations, and maintenance of the cameras and those appurtenant facilities will be fully funded by OCWD, similar to the existing injection well.
Respectfully submitted,
Rudy Emami
Director of Public Works
