Summary of Additions and Amendments to Planning Commission Materials
The following information that has been added or amended subsequent to the Planning Commission public hearing is included for City Council consideration as described below.
Chapter 18.114 (Disneyland Resort Specific Plan No. 92-1):
• Changed two references from “Mitigation Monitoring Plan No. 387” to “Mitigation Monitoring Program No. 387.”
Chapter 18.116 (Anaheim Resort Specific Plan No. 92-2):
• Changed one reference from “Mitigation Monitoring Plan No. 387” to “Mitigation Monitoring Program No. 387.”
• Table 116-E (Accessory Uses Incidental to and Integrated within a Hotel or Motel Including Suite-Type Hotels, and Otherwise Limited Herein: C-R District (Development Area 1)). Modified Special Provisions to clarify that Murals “shall be permitted by-right if not visible from public right-of-way; a minor conditional use permit is required if visible from the public right-of-way.”
• Table 116-G (Minimum Setbacks: C-R District). Clarified that the proposed setback along Disneyland Drive, between Katella Avenue and Ball Road is 11 feet. It was inadvertently shown in red/bold/strikethrough, when it should have been shown as red/bold.
• Table 116-Q Freestanding Monument Signs, Note (F). Clarified that the appropriate Exhibit number for the Central Core Plan is Exhibit 3.3-8, since both the prior number and the proposed number were in strikethrough.
Development Agreement:
• Moved the Table of Contents and the List of Exhibits to the beginning of the document following the agreement cover page.
• Updates were made to the numbering in the Definitions section. • Updates were made to the development agreement section cross-references in the document to reflect the updated numbers for the definitions and update cross-references to other sections of the development agreement.
• Planning Commission meeting date information was inserted into Sections 2.2.1. • City Council meeting notice dates were inserted into Section 2.2.2. • Section 3.1.9.2(B) was amended to include the dates of OCTA consideration of the amendment to Master Plan of Arterial Highways.
• Section 3.1.20 was amended to add a reference to the Traffic Management Center. • Section 3.2.1.5 was edited to add language describing the Municipal Code authority for the City Council approval and delegation of authority to the Public Works Director for approval of the final form of encroachment licenses for Disney’s proposed pedestrian bridges.
• Section 6.28 was added to confirm that the Finance Agreement associated with the 1996 Development Agreement remains enforced and that in the event, which is unlikely, of an inconsistency between the Finance Agreement and this Development Agreement, the Finance Agreement is the controlling document until the Finance Agreement expires. • The final form of Exhibits A, B, D, G, H, I, K, O are included in the Development Agreement.
• There were also minor non-substantive typo and numbering corrections made to the document.
Statement of Overriding Considerations:
• Added descriptions of Disney’s community benefit obligations related to the $30,000,000 Affordable Housing payment to the public trust for affordable housing residential units and housing affordability programs, the $8,000,000 payment obligation for park improvements outside of the Anaheim Resort and the $10,000,000 payment obligation for sewer system upgrades to the Katella Avenue sewer infrastructure.
