CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: APRIL 16, 2024
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: SUBDIVISION AGREEMENT OF PARCEL MAP NO. 2020-100 ATTACHMENT (Y/N): YES ITEM # 11
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Motion, approve the Subdivision Agreement of Parcel Map No. 2020-100, with 5G, LLC for improvements related to a development located at 2501 E. Ball Road.

DISCUSSION:
5G, LLC, the owner and developer of the proposed commercial subdivision located at 2501 E. Ball Road on the northeast corner of Ball Road and Sunkist Street, desires to subdivide the property into two parcels and construct a 7-Eleven store with a service station on Parcel 1, and a Rapid Express carwash on Parcel 2, via a parcel map in accordance with the Subdivision Map Act.

The City Council approved the Tentative Parcel Map No. 2020-100 on June 8, 2021, in conjunction with Conditional Use Permit No. 2019-06035, Public Convenience or Necessity No. 2019-00148; and Administrative Adjustment No. 2020-00449, for a commercial development consisting of a convenience store with service station and a carwash.

The Conditions of Approval of the tentative parcel map require the developer to construct public street improvements. Consequently, the developer is required to enter into a Subdivision Agreement with the City to ensure that the developer completes the public improvements at the developer’s sole cost. The agreement requires that the developer posts security for the cost of the improvements to ensure that the new commercial development will have the required infrastructure to service the development. In the event the developer is unable to complete the work due to unforeseen circumstances, the City may utilize the security bonds through the bonding entity to complete the improvements as directed by the City Engineer.

The improvement bonds have been posted and all tentative map conditions required prior to parcel map approval have been met. The parcel map has been checked and found to be technically correct and in conformance with the tentative parcel map as Subdivision Agreement of Parcel Map No. 2020-100

approved by the City Council. The Engineering for the development project is being provided by ATC Design Group of Escondido, California.

The required public improvements include the relocation/reconstruction of the sidewalk, construction of parkway landscaping and new commercial driveway approaches along the frontage of Ball Road and Sunkist Street. These improvements are consistent with the City of Anaheim General Plan and the conditions of approval of the tentative parcel map and will continue to enhance the City's infrastructure and circulation in the project area.

IMPACT ON BUDGET:

There is no budgetary impact.
