SUBJECT: APPEAL OF THE PLANNING COMMISSION DECISION
APPROVING DEVELOPMENT APPLICATION NO. 2023-
00011 FOR A DETERMINATION OF PUBLIC
CONVENIENCE OR NECESSITY TO PERMIT OFF-SITE
SALES OF ALCOHOLIC BEVERAGES; MODIFICATION TO
CONDITIONAL USE PERMIT NO. 2725; AND
ADMINISTRATIVE ADJUSTMENT FOR A 5% REDUCTION
IN REQUIRED PARKING FOR ADVENTURE LAND AT 2125-
2129 SOUTH HARBOR BOULEVARD
ATTACHMENT (Y/N): YES ITEM # 32
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Resolution, deny the appeal and uphold the Planning Commission’s decision to approve a determination of Public Convenience or Necessity to permit off-site sales of alcoholic beverages; modification to Conditional Use Permit No. 2725; and administrative adjustment for a 5% reduction in required parking for Adventure Land, a retail sales-general use located at 2125-2129 South Harbor Boulevard and approve Development Application No. 2023-00011, thereby approving the project.
DISCUSSION:
On January 17, 2024, following a public hearing, the Planning Commission voted 7- 0 to approve Development Application No. 2023-00011 for a Determination of Public Convenience or Necessity to permit the off-site sales of alcoholic beverages in an existing retail sales-general use that is incidental to and integrated with The Carriage Inn motel; a modification to Conditional Use Permit No. 2725 to remove a condition of approval requiring a restrictive covenant on the property; and an administrative adjustment to permit fewer parking spaces than required by the Zoning Code. A copy of the January 17, 2024 Planning Commission resolution, staff report, draft meeting minutes, and written public comments received by the Planning Commission are included as Attachment 2, 3, 4, and 5 to this report.
Within the time prescribed by law, the Planning Commission’s decision was Development Application No. 2023-00011
February 27, 2024
appealed to the City Council by Talab Ibrahim (the “Appellant”). The appeal request is included as Attachment 6 to this report.
Project Description: The applicant requests a Determination of Public Convenience or Necessity for the sale of alcoholic beverages (beer, wine, and distilled spirits) for off-premises (off-sale) consumption in conjunction with the existing retail sales-general establishment, Adventure Land.
As shown on the Project Plans (Attachment 7), the total alcohol display areas will not exceed 10% of the floor area of the existing retail establishment.
The State of California Department of Alcoholic Beverage Control (ABC) requires a Type 21 Off-Sale General license for this request. State law limits the issuance of a new alcohol sales license when a license is requested in a police reporting district with a crime rate above the City average, or when there is an overconcentration in the number of ABC licenses within a census tract. A Determination of Public Convenience or Necessity is required for this application because there is an overconcentration in the number of ABC licenses within the census tract (2 off-sale licenses permitted, 3 off-sale licenses exist within the census tract). A copy of the ABC License Map is included as Attachment 9. As stated in the Anaheim Police Department Memorandum (Attachment 10), the property is within Police Reporting District 2224, which is below the City average in crime.
In addition to the Determination of Public Convenience or Necessity, the applicant requests a modification to Conditional Use Permit No. 2725 to remove a condition of approval requiring a restrictive covenant on the property indicating that the parking variance for the property shall terminate and become null and void upon any change of use from the original approved use as a retail wig shop unless additional required parking is provided. Attachment 12 includes a Draft Memorandum of Termination of Restrictive Covenant drafted by the City Attorney’s Office, which will be recorded if the Planning Commission’s approval is upheld by the City Council.
Lastly, the applicant is requesting an administrative adjustment for a 5% reduction in parking for the project site. The motel and freestanding commercial building are on the same parcel and share a total of 44 parking spaces. The Zoning Code requires 46 parking spaces for the two uses on the site. The applicant submitted a Parking Justification Letter with a parking demand analysis, which surveyed the parking on several days between the hours of 8:00 a.m. and 10:00 p.m. and indicated that the maximum number of spaces used at any one time was 38 spaces. The Applicant Parking Justification Letter is included as Attachment 11 to this report.
A full detailed analysis of the project is included in the January 17, 2024 Planning Commission report (Attachment 3).
Basis of Appeal: The Appellant’s basis for appeal (Attachment 6) is that the applicant provided misleading and inaccurate information to the Planning Commission regarding the proposed business. The Appellant also stated doubt that the Planning Commission had sufficient time to thoroughly read all the submitted letters. Through Attorney Joshua Kaplan and by way of letter dated February 8, 2024, the appellant provided supplemental documentation with respect to the appellant’s identity and character, the applicant’s identity and character, and the factual and legal context of the appeal (Attachment 6A). An attachment to the supplemental documentation Development Application No. 2023-00011
February 27, 2024
provided by Attorney Joshua Kaplan includes a duplicate of the comments provided by his client to the Planning Commission prior to the January 17, 2024 meeting.
The information below summarizes the appellant’s stated reasons for appealing the project and staff’s analysis of each point.
Reason #1: The applicant provided misleading and inaccurate information to the Planning Commission, including in response to questions from the Commission.
Details explaining the specific misleading and inaccurate information provided to the Planning Commission were not provided by the appellant. However, Condition of approval No. 1 requires that the business be operated in accordance with the Letter of Justification, which was reviewed by the Planning Department and the Anaheim Police Department staff and is included as Attachment 8.
Reason #2: The Commissioners did not have time to thoroughly read all the submitted letters.
The Planning Commission staff report, distributed to the Commissioners on January 12, 2024, included five letters in opposition to the project received prior to the publication of the staff report. An additional eight letters, most with common themes, were provided to the Commissioners in two batches as received, the latest of which was distributed before 2:00 pm on the day of the public hearing. Printed copies were also provided on the dais for reference which staff acknowledged in the presentation.
Reason #3: The granting of an alcohol sale license to applicant would violate State law because of the proximity of the Project to schools and public playgrounds or non-profit youth facilities.
The State of California Department of Alcoholic Beverage Control (ABC) is authorized, but not required, to deny alcohol sale licenses that are within 600 feet of schools, public playgrounds, or non-profit youth facilities. Parkview Elementary School, located at 12272 Wilken Way in the City of Garden Grove, is approximately 0.7 miles away from the subject building via local public streets. While there is no direct access between the sites without traveling along Harbor Boulevard and Orangewood Avenue, the furthest edge of the Adventure Land building to the nearest property line of Parkview Elementary School is approximately 550 feet.
Reason #4: The applicant has not met its burden of establishing public convenience or necessity.
A determination of public convenience or necessity is required when a license is requested in a police reporting district with a crime rate above the City average, or when there is an overconcentration in the number of ABC licenses within a census tract. The subject building is located within Census Tract 884.02, which allows for 2 off-sale licenses based on the population within the tract, and there are currently 3 off-sale licenses (2 in the City of Garden Grove). The property is located within Police Reporting District 2224, which is below the City average in crime.
Development Application No. 2023-00011
February 27, 2024
The existing retail use is incidental to and integrated with the Carriage Inn motel. The operational characteristics of the proposed business are consistent with similar businesses in the surrounding vicinity and would provide an additional convenience to patrons of the Carriage Inn motel and surrounding Anaheim Resort area by providing a variety of goods geared towards hotel patrons and tourists visiting the Resort. Conditions of approval from the Police Department have been included in the resolution that require the installation of CCTV, proper lighting, restricting the hours of operation to the hours presented in the Letter of Justification, and policing of loitering around the retail store by the business operator to ensure that the business would not negatively affect the neighborhood.
Environmental Impact Analysis: The Planning Commission found that the proposed Project is Categorically Exempt from the requirements to prepare additional environmental documentation per CEQA Guidelines, Section 15301, Class 1 (Existing Facilities). The Class 1 exemption consists of the repair, maintenance, and/or minor alteration of existing public or private structures or facilities, involving negligible or no expansion of the use beyond that existing at the time of this determination. The proposed project does not include the expansion of the existing freestanding commercial building or the motel use, and all business activities would occur within the existing structure. Pursuant to Section 15300.2 (c) and 15301 of Title 14 of the California Code of Regulations, there are no unusual circumstances in respect to the proposed project for which staff would anticipate a significant effect on the environment and, therefore, the proposed project would be categorically exempt from the provisions of CEQA.
Staff recommends that the City Council determine that the project will not cause a significant effect on the environment and is, therefore, categorically exempt as outlined herein from the requirement for the preparation of environmental documents under the California Environmental Quality Act and no further environmental review is required.
CONCLUSION: The Planning Commission carefully considered the Project, considered the staff report, and public comments received, and determined that the Project, as conditioned, would: serve as an additional public convenience or necessity; would not adversely affect the adjoining land uses or the growth and development of the surrounding area; would not be detrimental to the overall public health and safety of the community; would not impose an undue burden upon the streets and highways; would be consistent with the purposes and intent of the Zoning Code and could not be achieved by using provisions in the Zoning Code that do not require an adjustment; and would not produce a result that is out of character or detrimental to the neighborhood. Adequate parking will be provided on-site for both the motel and retail salesgeneral use, and all business activities would occur within the existing building. Therefore, staff recommends that the City Council uphold the decision of the Planning Commission approving the project.
IMPACT ON BUDGET:
There is no budgetary impact. The Appellant paid the fee necessary to schedule this appeal request, and the costs associated with this hearing will be incurred by the project applicant.

- 2 -
WHEREAS, the effects of the Proposed Project are Categorically Exempt from the requirements to prepare additional environmental documentation per CEQA Guidelines, Section 15301, Class 1 (Existing Facilities). Pursuant to Section 15300.2 (c) and 15301 of Title 14 of the California Code of Regulation, there are no unusual circumstances in respect to the Proposed Project for which staff would anticipate a significant effect on the environment and, therefore, the Proposed Project is categorically exempt from the provisions of CEQA; and
WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on January 17, 2024, at 5:00 p.m., with notice of said public hearing having been duly given as required by law and in accordance with the provisions of Chapter 18.60 (Procedures) of the Code, to hear and consider evidence for and against the Proposed Project and to investigate and make findings and recommendation in connection therewith; and WHEREAS, the Planning Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing with respect to the request to permit the Proposed Project on the Property, the Planning Commission adopted Resolution No. PC2024-002 approving Development Application No. 2023- 00011; and
WHEREAS, on January 25, 2024, and within the time prescribed by law, an appeal of the Planning Commission’s action was filed by Talab Ibrahim (the “Appellant”); and WHEREAS, upon receipt of Planning Commission Resolution No. PC2024-002 approving Development Permit No. 2023-00011, a summary of evidence and a report of the findings and recommendations of the Planning Commission, and the appeal, the City Council did set the matter for a de novo hearing, which public hearing was noticed in the matter provided by law; and WHEREAS, on February 27, 2024, at the time and place fixed for said public hearing, the City Council did hold and conduct a public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did consider the recommendations and action of the Planning Commission pursuant to the appeal provisions set forth in Chapter 18.60 of the Code; and
WHEREAS, the City Council, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing with respect to the request for a Determination of Public Convenience or Necessity for Development Application No. 2023-00011, does find and determine the following facts:
1. On July 11, 1995, the City Council adopted Resolution No. 95R-134 establishing procedures and delegating certain responsibilities to the Planning Commission relating - 3 -
to the determination of "Public Convenience or Necessity" on those certain applications requiring that such determination be made by the local governing body pursuant to applicable provisions of the Business and Professions Code, and prior to the issuance of a license by the Department of Alcoholic Beverage Control ("ABC").
2. Section 23958 of the Business and Professions Code provides that the ABC shall deny an application for a license if issuance of that license would tend to create a law enforcement problem, or if issuance would result in or add to an "undue concentration" of licenses, except when an applicant has demonstrated that "public convenience or necessity" would be served by the issuance of a license. For purposes of Section 23958.4, "undue concentration" means the case in which the Property is located in an area where any of the following conditions exist:
(a) The Property is located in a crime reporting district that has a 20 percent greater number of reported crimes than the average number of “reported crimes” (as defined in Section 23958.4), as determined from all crime reporting districts within the City of Anaheim. (b) As to on-sale retail license applications, the ratio of on-sale retail licenses to population in the census tract or census division in which the Property is located exceeds the ratio of on-sale retail licenses to population in the county in which the applicant premises are located. (c) As to off-sale retail license applications, the ratio of off-sale retail licenses to population in the census tract or census division in which the Property is located exceeds the ratio of off-sale retail licenses to population in the county.
3. Notwithstanding the existence of the above-referenced conditions, ABC may issue a license if the Planning Commission determines that the "public convenience or necessity" would be served by the issuance.
4. Resolution No. 95R-134 authorizes the City of Anaheim Police Department to make recommendations related to "public convenience or necessity" determinations; and, when the sale of alcoholic beverages for off-premises consumption is permitted by the Code, said recommendations shall take the form of conditions of approval to be imposed on the determination in order to ensure that the sale and consumption of alcoholic beverages does not adversely affect any adjoining land use or the growth and development of the surrounding area.
5. The Property is in Census Tract Number 884.02, which incorporates the City of Anaheim and the City of Garden Grove with a population of 4,679 persons. This population allows for two off-sale Alcoholic Beverage Control licenses, and there are presently three licenses in the tract. The property is within Police Reporting District 2224, which is below the City average crime.
In 2023, there were 59 crimes with the top crimes being larceny, vehicle theft, and robbery. Because there is an overconcentration in the number of off-sale ABC licenses within the census tract, a determination of "public convenience or necessity" is required.
6. The request to permit alcoholic beverage sales for off-premises consumption in conjunction with the retail sales-general use subject to the conditions of approval imposed will not be detrimental to the health and safety of the citizens of Anaheim, would not adversely affect the - 4 -
surrounding land uses and the growth and development of the area in which it is proposed and will provide an added convenience to the patrons of the surrounding Anaheim Resort area because the operational characteristics are consistent with similar businesses in the surrounding vicinity; a condition of approval has been included in the resolution which requires that the applicant operate in accordance to the Letter of Justification submitted as part of the application; conditions of approval are also included from the Police Department that require the installation of CCTV, proper lighting, restricting the hours of operation to the hours presented in the Letter of Justification, and policing of loitering around the retail store by the business operator to ensure that the business would not negatively affect the neighborhood. At the January 17, 2024 Planning Commission meeting, the business owner stated that he agreed with all of the conditions in the draft resolution and did not state any objections. Therefore, the conditions imposed on the Proposed Project will ensure that potential nuisances associated with the proposed use will be minimized, and compatible to surrounding land uses.
7. The determination of "Public Convenience or Necessity" can be made based on the finding that the license requested is consistent with the Planning Commission guidelines for such determinations and further that the granting of the determination of Public Convenience or Necessity, under the conditions imposed, will not be detrimental to the health and safety of the citizens of the City of Anaheim; and
WHEREAS, the City Council, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing with respect to the request for a conditional use permit amendment, does find and determine the following facts:
1. The proposed use of the property is one for which a conditional use permit is authorized by the Code. The Code permits hotels and motels south of Orangewood Avenue with approval of a conditional use permit. Retail sales-general uses with sales of alcohol for offpremises consumption are permitted by right in the C-R District of SP 92-2, provided that the use is incidental to and integrated with a hotel or motel. The existing motel was approved by the Planning Commission under Conditional Use Permit No. 2725, and the existing retail sales-general use is permitted by right when incidental to and integrated with a motel.
2. The proposed use will not adversely affect the adjoining land uses, or the growth and development of the area in which it is located. The motel and various commercial uses have operated on the subject site since the conditional use permit approval in 1985. The surrounding properties include other commercial uses along Harbor Boulevard and multiple-family residential to the east. The motel and retail sales-general uses are compatible with the surrounding land uses and all business activities will occur within the existing buildings.
3. The size and shape of the Property are adequate to allow the full operation of the Proposed Project in a manner not detrimental to either the particular area or to the health and safety of the public. The motel and commercial building were originally approved in 1985. There are no proposed exterior modifications to the site or expansions of the building footprints under this application. Based on the applicant’s parking justification letter, there is adequate parking - 5 -
available on-site for both the motel and retail sales-general use at the observed peak hours of operation.
4. The traffic generated by the Proposed Project would not impose an undue burden upon the streets and highways, as they are designed and improved to carry the anticipated traffic generated by the Proposed Project. The applicant submitted a parking justification letter providing parking counts for the subject property during business hours for a weekday and weekend. Based on the counts provided, the peak time for the motel and retail sales-general use was between the hours of 8:00 a.m. and 9:00 a.m. on a Saturday when a total of 38 parking spaces were occupied.
There is a total of 44 parking spaces available on-site. The existing businesses are currently operating with no observed burden upon the nearby streets and highways from these uses.
5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the health and safety of the citizens of the City of Anaheim. The applicant is requesting the removal of a condition of approval requiring a restrictive covenant on the property which restricted the use of the commercial building as a means, in conjunction with a variance, to address a deficiency in Code required parking for the motel and commercial building. In conjunction with the request to remove the condition, the applicant is requesting an Administrative Adjustment, discussed below, to reduce the Code required parking. All business activities will occur within the existing buildings and are consistent with the other commercial uses in the vicinity.
WHEREAS, the City Council, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing with respect to the request for an administrative adjustment, does find and determine the following facts:
1. The adjustment is consistent with the purposes and intent of the Zoning Code. The applicant requests an administrative adjustment to allow for fewer parking spaces than required by the Code. The Code permits a deviation of up to 20% from the parking requirements through an administrative adjustment. The retail sales-general use and motel would require 46 parking spaces, and 44 parking spaces are provided on-site, representing a 5% reduction in Code-required spaces.
Therefore, the request for the administrative adjustment of 5% is consistent with the purpose and intent of the Zoning Code.
2. The same or similar result cannot be achieved by using provisions in the Zoning Code that do not require adjustment. Due to existing improvements on the property, additional parking cannot be achieved on-site. The motel and freestanding commercial retail building are existing and permitted uses, and the subject application does not propose any changes to the building footprints or general use classifications for the motel and commercial retail use.
3. The proposed administrative adjustment will not produce a result that is out of character or detrimental to the neighborhood. The applicant conducted a parking demand analysis at the project site on November 21, 2023, November 24, 2023, and November 25, 2023, between the hours of 8:00 a.m. and 10:00 p.m. The maximum number of spaces used at any one time was 38 spaces, which occurred between 8:00 a.m. and 9:00 a.m. on Saturday, November 25, 2023, and - 6 -
is less than the 44 spaces provided. The parking demand analysis was conducted when both the motel and retail sales-general use were operating under normal conditions. Therefore, it can be assumed that adequate parking is provided on-site and would not be detrimental to the neighborhood.
WHEREAS, this City Council determines that the evidence in the record constitutes substantial evidence to support the actions taken and the findings made in this Resolution, that the facts stated in this Resolution are supported by substantial evidence in the record, including testimony received at the public hearing, the staff presentations, the staff report, and all materials in the project files. There is no substantial evidence, nor are there other facts, that negate the findings made in this Resolution. This City Council expressly declares that it considered all evidence presented and reached these findings after due consideration of all evidence presented to it.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to the above findings, this City Council does hereby approve the determination of public convenience or necessity, conditional use permit amendment, and administrative adjustment for Development Application No. 2023-00011 at the Property, contingent upon and subject to the conditions of approval set forth in Exhibit B attached hereto and incorporated herein by this reference, which are hereby found to be a necessary prerequisite to the proposed use of the Property in order to preserve the health, safety and general welfare of the citizens of the City of Anaheim. Extensions for further time to complete conditions of approval may be granted in accordance with Section 18.60.170 of the Code.
Timing for compliance with conditions of approval may be amended by the Planning Director upon a showing of good cause provided (i) equivalent timing is established that satisfies the original intent and purpose of the condition(s), (ii) the modification complies with the Code, and (iii) the applicant has demonstrated significant progress toward establishment of the use or approved development.
BE IT FURTHER RESOLVED, that the conditions of approval attached to this Resolution as Exhibit B amend and hereby replace in their entirety the Previous Conditions of Approval adopted by Resolution No. PC85-231 for Conditional Use Permit No. 2725 for a 51-unit motel and existing commercial building, and therefore shall control and govern the Property.
BE IT FURTHER RESOLVED that any amendment, modification, or revocation of this permit may be processed in accordance with Chapters 18.60.190 (Amendment of Permit Approval) and 18.60.200 (Revocation or Modifications of Permits) of the Code.
BE IT FURTHER RESOLVED that the City Council does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void.
BE IT FURTHER RESOLVED that approval of this application constitutes approval of the proposed request only to the extent that it complies with the Code and any other applicable City, - 7 -
State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation, or requirement.
BE IT FURTHER RESOLVED that the time within which a rehearing must be sought is governed by the provisions of Section 1.12.100 of the Anaheim Municipal Code and the time within which judicial review of final decisions must be sought is governed by Section 1094.6 of the Code of Civil Procedure and Anaheim City Council Resolution No. 79R-524.

ITEM NO. 1
PLANNING COMMISSION REPORT
City of Anaheim
PLANNING & BUILDING DEPARTMENT
DATE: JANUARY 17, 2024
SUBJECT: DEVELOPMENT APPLICATION NO. 2023-00011
LOCATION: 2125-2129 South Harbor Boulevard (Adventure Land) APPLICANT/PROPERTY OWNER: The applicant is Invest CA, LLC, represented by F. Michael Ayaz, Esp. of Blake and Ayaz, ALC, and the property owner is Tammy Ngo of Rainbow International Restaurant Hotel.
REQUEST: The applicant requests a determination of Public Convenience or Necessity to permit the off-site sales of alcoholic beverages in an existing retail salesgeneral use that is incidental to and integrated with The Carriage Inn motel; a modification to Conditional Use Permit No. 2725 to remove a condition of approval requiring a restrictive covenant on the property; and approval of a an administrative adjustment to permit fewer parking spaces than required by the Anaheim Municipal Code (the “Code”) (5% reduction proposed).
AUTHORITY: Section 18.60.190 (Amendment of Permit Approval) of Chapter 18.60 (Procedures), Section 18.60.220 (Determination of Public Convenience or Necessity) of Chapter 18.60 (Procedures), and Section 18.62.040 (Administrative Adjustments) of Chapter 18.62 (Administrative Reviews).
RECOMMENDATION: Staff recommends that the Planning Commission find and determine that a Class 1 – Existing Facilities Categorical Exemption under the California Environmental Quality Act (CEQA) (Public Resources Code, Sections 21000-21189.57) as set forth in Sections 15301 and 15300.2 of the State CEQA Guidelines (California Code of Regulations, Title 14, Chapter 3, Sections 15000-15387) is the appropriate environmental documentation for this request; and adopt the attached resolution approving Development Application No. 2023-00011.
BACKGROUND: Adventure Land is an existing small retail sales-general use that occupies a 2,667 square foot freestanding building within the parking lot of The Carriage Inn motel at 2125-2129 South Harbor Boulevard. Adventure Land, which is incidental to and part of the surrounding motel, primarily serves motel patrons and nonmotel patrons in The Anaheim Resort area. The establishment currently sells souvenirs, clothing, convenience food items, travel size toiletries, and other travel size convenience items.
Development Application No. 2023-00011
January 17, 2024
The property is in the Commercial Recreation (C-R) District of the Anaheim Resort Specific Plan (SP 92-2) and is designated for Commercial Recreation land uses in the General Plan. The property is surrounded by commercial uses to the north, south, and to the east across Harbor Boulevard, with multiple-family residential uses to the west.
Conditional Use Permit No. 2725 was approved by the Planning Commission in October 1985 and allowed for the construction of a 51-room motel on the subject parcel where an existing commercial building (current Adventure Land location) was located, along with a variance from parking requirements for the site. The conditional use permit included a condition of approval requiring a restrictive covenant on the property to note that the parking variance shall terminate upon a change of use from the existing commercial use at the time, a retail wig shop.
A retail sales-general use, and the sales of alcoholic beverages for off-premises consumption, that is incidental to and integrated within a hotel or motel is permitted by right as an accessory use in the C-R District of SP 92-2. Therefore, a conditional use permit is not required for the sale of alcoholic beverages in conjunction with this application. However, the Planning and Building Director has referred the decision on the Determination of Public Convenience or Necessity to the Planning Commission pursuant to Section 18.60.080 to serve the general public interest and in conjunction with the request to amend the Conditional Use Permit.
SITE LOCATION
Development Application No. 2023-00011
January 17, 2024
PROPOSAL: The applicant requests a Determination of Public Convenience or Necessity for the sale of alcoholic beverages (beer, wine, and distilled spirits) for off-premises (off-sale) consumption in conjunction with the existing retail sales-general establishment. The State of California Department of Alcohol Beverage Control (ABC) requires a Type 21 Off-Sale General license for this request. The retail sales-general establishment would operate Monday to Thursday from 7:00 a.m. to 11:00 p.m. and Friday to Sunday from 7:00 a.m. to 12:00 a.m. As indicated on the floor plan below, alcohol display would occur in a section of refrigerated coolers along the north side wall (beer and wine) and behind the cashier (distilled spirits). According to the square footage calculations on the Project Plans (Attachment No. 2), the alcohol display areas will not exceed 10% of the market floor area (258 square feet total).
FLOOR PLAN
In addition to the Determination of a Public Convenience or Necessity, the applicant requests a modification to Conditional Use Permit No. 2725 to remove the condition of approval requiring a restrictive covenant on the property indicating that the parking variance shall terminate and become null and void upon any change of use in the existing retail wig shop unless additional Code required parking is provided. Attachment No. 7 includes a Draft Memorandum of Termination of Restrictive Covenant drafted by the City Attorney’s Office, which would be recorded if the application is approved by the Planning Commission.
Development Application No. 2023-00011
January 17, 2024
Lastly, the applicant is requesting an administrative adjustment for a 5% reduction in parking for the project site. The motel and freestanding commercial building are on the same parcel and share a total of 44 parking spaces. The Code requires 46 parking spaces for the two uses on the site.
FINDINGS AND ANALYSIS:
Public Convenience or Necessity (PCN): State law limits the issuance of new alcohol sales licenses when a license is requested in a police-reporting district with a crime rate above the City average or when there is an overconcentration in the number of ABC licenses within a census tract.
A determination of public convenience or necessity is required for this application because there is an overconcentration in the number of ABC licenses within the census tract. State law also states that such restrictions can be waived if the local jurisdiction makes a determination that the proposed business would serve "public convenience or necessity." The subject location is in Census Tract Number 884.02, which incorporates the City of Anaheim and City of Garden Grove with a population of 4,679 persons. This population allows for two offsale Alcoholic Beverage Control licenses, and there are presently three licenses (one in the City of Anaheim and two in the City of Garden Grove) in the tract (Attachment No. 4). As stated in Attachment No. 5, the property is within Police Reporting District 2224, which is below the City average in crime. In 2023, there were 59 crimes with the top crimes being larceny, vehicle theft, and robbery. The Police Department does not believe the sale of alcoholic beverages in conjunction with the subject supermarket would negatively influence the type of crime occurring in this area, subject to their recommended conditions of approval. The draft resolution includes conditions from the Police Department, including installation of CCTV, proper lighting, and policing of loitering around the retail store by the business operator to ensure that the business would not negatively affect the neighborhood.
The applicant’s PCN Justification (Attachment No. 3) states that sale of alcohol is a convenience for patrons as the surrounding locations do not offer the same type of travel goods geared towards motel patrons, as well as the same types of alcohol. Based on staff’s review of the application, including the applicant’s justification statement and statement of operations, staff supports the request for Determination of Public Convenience or Necessity with the recommended conditions of approval.
Modification to Conditional Use Permit No. 2725: The Code states that major amendments to an approved permit are processed in the same manner as a new permit and subject to a new public hearing. The applicant is proposing to remove a condition of approval from Conditional Use Permit No. 2725, which is considered a major amendment. Therefore, before the Planning Commission may approve an amendment to the conditional use permit, it must make specific findings of fact. Each required finding for a conditional use permit and corresponding analysis is presented below:
Development Application No. 2023-00011
January 17, 2024
1) That the proposed use is properly one for which a conditional use permit is authorized by this code;
The Code permits hotels and motels south of Orangewood Avenue with approval of a conditional use permit. Retail sales-general uses with off-site sale of alcohol are permitted by right in the C-R District of SP 92-2, provided that the use is incidental to and integrated with a hotel or motel. The existing motel was approved by the Planning Commission under Conditional Use Permit No. 2725, and the existing retail salesgeneral use is permitted by right when incidental to and integrated with a motel. 2) That the proposed use will not adversely affect the adjoining land uses, or the growth and development of the area in which it is proposed to be located; The motel and various commercial uses have operated on the subject site since the conditional use permit approval in 1985. The surrounding properties include other commercial uses along Harbor Boulevard and multiple-family residential to the east.
The motel and retail sales-general uses are compatible with the surrounding land uses and all business activities will occur within the existing buildings. 3) That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use, in a manner not detrimental to either the particular area or health and safety;
The motel and commercial building were originally approved in 1985. There are no proposed exterior modifications to the site or expansions of the building footprints under this application. Based on the applicant’s parking justification letter, there is adequate parking available on-site for both the motel and retail sales-general use at the observed peak hours of operation.
4) That the traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area; and The applicant submitted a parking justification letter providing parking counts for the subject property during business hours for a weekday and weekend.
5) That the granting of the conditional use permit under the conditions imposed, if any, will not be detrimental to the health and safety of the citizens of the City of Anaheim.
The applicant is requesting the removal of a condition of approval requiring a restrictive covenant on the property which restricted the use of the commercial building Development Application No. 2023-00011
January 17, 2024
as a means, in conjunction with a variance, to address a deficiency in Code required parking for the motel and commercial building. In conjunction with the request to remove the condition, the applicant is requesting an Administrative Adjustment, discussed below, to reduce the Code required parking. All business activities will occur within the existing buildings and are consistent with the other commercial uses in the vicinity.
Administrative Adjustment: Administrative adjustments are waivers of certain development standards, including parking requirements, and can be approved by the Planning and Building Director. When an administrative adjustment application is made in conjunction with a project that requires Planning Commission action, all requests are subject to review and approval by the Planning Commission. Before the Planning Commission may approve an administrative adjustment, it must make specific findings of fact. Each required findings and corresponding analysis is presented below:
1) The adjustment is consistent with the purposes and intent of the Zoning Code; The Code permits a deviation of up to 20% from the Code-required parking through an administrative adjustment. The retail sales-general use and motel would require 46 parking spaces and 44 parking spaces are provided on-site, representing a 5% reduction in Code-required spaces. Therefore, the request for the administrative adjustment for a 5% reduction is consistent with the purpose and intent of the Zoning Code. 2) The same or similar result cannot be achieved by using provisions in the Zoning Code that do not require the adjustment; and
Due to the existing improvements on the property, additional parking cannot be achieved on-site. The motel and freestanding commercial retail building are existing and permitted uses, and the subject application does not propose any changes to the building footprints or general use classifications for the motel and commercial retail use.
3) The adjustment will not produce a result that is out of character or detrimental to the neighborhood.
The applicant conducted a parking demand analysis at the project site on November 21, 2023, November 24, 2023, and November 25, 2023, between the hours of 8:00 a.m. and 10:00 p.m. The maximum number of spaces used at any one time was 38 spaces, which occurred between 8:00 a.m. and 9:00 a.m. on Saturday, November 25, 2023, which is less than the 44 spaces provided. The parking demand analysis was conducted when both the motel and retail sales-general use were operating under normal conditions. Therefore, it can be assumed that adequate parking is provided on-site for the existing uses. Staff does not believe that the reduction of two parking spaces would be out of character or detrimental to the neighborhood, as the parking demand analysis identified that at the peak usage, only 38 spaces were occupied.
Development Application No. 2023-00011
January 17, 2024
Environmental Impact Analysis: Staff recommends that the Planning Commission find that the effects of the proposed project are Categorically Exempt from the requirements to prepare additional environmental documentation per California Environmental Quality Act (CEQA) Guidelines, Section 15301, Class 1 (Existing Facilities). The Class 1 exemption consists of the repair, maintenance, and/or minor alteration of existing public or private structures or facilities, involving negligible or no expansion of the use beyond that existing at the time of this determination. The proposed project does not include the expansion of the existing freestanding building or motel use, and all business activities would occur within the existing structure.
Public Correspondence: Before an application was formally submitted to the City for this request, staff received four letters in opposition to the determination of Public Convenience or Necessity at this location. After the public notices were mailed out for the public hearing, staff received one letter in opposition to the project. All public correspondence documents are included as Attachment No. 9.
CONCLUSION: Subject to the recommended conditions of approval, staff believes that the proposed sale of alcoholic beverages for off-premises consumption in conjunction with the retail sales-general use would be compatible with surrounding uses and the general vicinity and would provide a public convenience or necessity. Adequate parking will be provided on-site for both the motel and retail sales-general use, and the existing uses would not be detrimental to either the particular area or health and safety of the community. Therefore, staff recommends that the Planning Commission approve the determination of Public Convenience or Necessity for Adventure Land, approve the amendment to Conditional Use Permit No. 2725 to remove the condition of approval requiring the restrictive covenant on the property, and approve the administrative adjustment for 5% reduction in the number of required parking spaces.

Amanda Lauffer, Associate Planner, provided a summary of the staff report dated January 17, 2024. This item is a request to make a determination of Public Convenience or Necessity to permit the off-site sales of alcoholic beverages in an existing retail sales-general use that is incidental to and integrated with The Carriage Inn motel. The applicant also requests to modify a conditional use permit to remove a condition of approval requiring a restrictive covenant on the property, as well as approval of an administrative adjustment to permit a 5% reduction in the number of Coderequired parking stalls.
The project site is located at 2129 South Harbor Boulevard, about 300 feet south of the intersection of Harbor Boulevard and Orangewood Avenue. The project site is in the Commercial Recreation District of the Anaheim Resort Specific Plan and is designated for Commercial Recreation land uses in the General Plan. The property is surrounded by commercial uses to the north, south, and to the east across Harbor Boulevard, with multiple-family residential uses to the west.
Adventure Land is an existing small retail sales-general use that occupies a 2,667 square foot freestanding building within the parking lot of the Carriage Inn motel. This use is incidental to and part of the surrounding motel, and primarily serves motel patrons and non-motel patrons in The Anaheim Resort area. Adventure Land currently sells souvenirs, clothing, convenience food items, travel size toiletries, and other travel size convenience items.
The applicant requests a Determination of Public Convenience or Necessity for the sale of alcoholic beverages, including beer, wine, and distilled spirits, for off-premises consumption in

PLANNING COMMISSION [DRAFT] MINUTES
conjunction with the existing retail sales-general establishment. As shown in the floor plan, the applicant proposes to display beer and wine in the refrigerated section along the north side wall and the distilled spirit display will be located behind the cashier. Both display areas would occupy less than 10% of the total floor area. The hours of operation are 7am to 11pm Monday to Thursday and 7am to midnight Friday through Sunday.
The State of California Department of Alcohol Beverage Control requires a Type 21 Off-Sale General license for this type of sale. A finding of Public Convenience or Necessity is required because the establishment is located within a census tract that allows 2 off-sale licenses based on population size, and there are currently 3 off-sale licenses in the tract. It should be noted that this census tract includes both the City of Anaheim and the City of Garden Grove; 2 of the existing licenses are within the city limits of Garden Grove and are not included on this map.
Staff reviewed this application with the Anaheim Police Department. The draft resolution includes conditions of approval from the Police Department, including the installation of CCTV, proper lighting, and policing of loitering around the retail store by the business operator, to ensure that the business would not negatively affect the neighborhood and would operate in a responsible manner.
In 1985, Conditional Use Permit No. 2725 was approved by the Planning Commission and allowed for the construction of a 51-room motel on the subject parcel where an existing commercial building was located, along with a variance from parking requirements for site. The CUP included a condition of approval requiring a restrictive covenant on the property to note that the parking variance shall terminate upon a change of use from the existing commercial use at the time, which was a retail wig shop.
As part of this application, the applicant is requesting to remove the condition of approval requiring the restrictive covenant. Attachment No. 7 of this item includes a Draft Memorandum of Termination of Restrictive Covenant drafted by the City Attorney’s Office, which would be recorded if the application is approved. The draft resolution for this item would amend, and hereby replace in their entirety, the previous conditions of approval that were adopted for CUP No. 2725.
Lastly, the Code requires 46 parking spaces for the motel and retail sales- general uses, and 44 spaces are provided on site. The applicant is requesting an administrative adjustment for a 5% reduction in the Code required parking spaces, or a total of 2 spaces. A parking demand analysis was conducted on the project site which observed parking on several days between the hours of 8am and 10pm. The parking demand analysis was conducted when both the motel and retail sales-general use were operating under normal conditions. The maximum number of spaces used at any one time was 38 spaces, which occurred between 8am and 9am on a Saturday, and is less than the 44 parking spaces provided.
Subject to the recommended conditions of approval, staff believes that the proposed sale of alcoholic beverages for off-premises consumption in conjunction with the retail sales-general use would be compatible with the surrounding uses and would provide a general public convenience or necessity. Adequate parking will be provided for both uses and all business activities would continue to occur within the existing buildings.
Based on the analysis included in the staff report and the findings contained in the draft resolution, staff supports the request and recommends approval of the application.

PLANNING COMMISSION [DRAFT] MINUTES
Attached to your staff report are 5 letters of opposition to the project. Before an application was formally submitted to the City for this request, Staff received 4 letters in opposition to the determination of public convenience or necessity at this location. An additional letter in opposition was received after the public notices were mailed out. Staff received a total of 8 letters in opposition after the staff report was published, which were provided to you before the meeting and are also printed out for you on the dais.
Vice Chair Henninger asked if the conditions of approval would replace the previous conditions of approval; Associate Planner Lauffer provided clarification that some conditions would carry over with the new CUP and others were obsolete and no longer applicable. Vice Chair Henninger requested in the future that previous conditions of approval were included in a redline version to see what changes are being proposed.
Commissioner Perez asked questions about the police-reporting district and census tract that were answered by Veronica Emami, Civilian Investigator.
Chairperson Kring asked questions regarding the sale of individual beers and wine coolers that were answered by Veronica Emami Civilian Investigator.
Michael Ayaz, Applicant, spoke about the proposed project. Applicant Ayaz spoke about the perceived issues with the project including homelessness. He explained that the majority of the customers are hotel/motel and resort guests. He also stated all conditions of approval have been reviewed and agreed to follow.
Commissioner Perez asked if Adventure Land had the same owners as the Carriage Inn; Applicant Ayaz stated that the Adventure Land business is owned by another party.
Veronica Emami, Civilian Investigator, clarified there is not a homeless problem specific to the Arco Gas Station located at 2101 South Harbor Boulevard. The homeless situation surrounds the area.
Jaime Arcadia, owner of The Cave Sports Bar, provided public comment including a concern for open containers, and opposed the project.
Michael Ayaz, Applicant, responded to public comment and explained that the conditions of approval which include a camera system and signage about loitering address the concerns expressed by Mr. Arcadia, owner of the Cave Sports Bar.
Dr. Bassam Slibi, Business Owner, spoke about the business operations, connection to the hotel and overall Resort area, and products sold at the store.
Michael Ayaz, Applicant, spoke about the floorplan and space must match what is being presented at Planning Commission.
Chairperson Kring suggested signage for visitors stating drinking and opened containers are not allowed on the premises.
Principal Planner Scott Koehm stated that an additional condition of approval could be added regarding signage about opened containers and loitering.
01.17.2024
PLANNING COMMISSION [DRAFT] MINUTES
Chairperson Kring asked Dr. Slibi, Business Owner, if the additional condition of approval was acceptable and he stated yes. Chairperson Kring stated that would be added to the motion.
Commissioner Lieberman stated she took into consideration the public comments received and stated she did not think it would have the same issues as a 7-Eleven because it is set back and inside the property. She did not believe it would become a community stopping spot and the customer base would not change and supported the project.
Commissioner Lieberman moved to approve the project.
Commissioner Walker seconded Commissioner Lieberman’s comments. Commissioner Walker stated he forgot to disclose that his daughter and son-in-law own property within the buffer zone of the project.
Assistant City Attorney Leoni Mulvihill asked to clarify Commissioner Lieberman’s motion if it included the additional condition of approval regarding signage. Commissioner Lieberman stated it did not include the additional condition of approval. Her motion was as staff recommended.
Commissioner Walker clarified he did not second Commissioner Lieberman’s motion; he seconded her comments only.
Commissioner Castro seconded the motion.
Commissioner Perez asked if there were any additional lodging establishments that had additional uses of the buildings such as stores, restaurants, or bars. Principal Planner Koehm stated that there are additional properties located in the Anaheim Resort Area that have sundries and convenience items inside the hotels. The newer hotels also have a liquor license as well.
Commissioner Perez commented that he did not think that adding alcohol would change the demographical data that was presented.
Commissioner Lieberman, seconded by Commissioner Castro, made a motion to approve; the motion carried by a vote of 7-0.

Greetings,
My name is Talab Ibrahim, serving as a board member at Anaheim Public Utilities, representing District 4. As both a resident and a property manager within our splendid city, I wish to express my strong opposition to the approval of an alcohol license for any establishment situated in the resort district, near a densely populated residential neighborhood, or near any educational institute. Before delving into the reasons for my objections, allow me to provide some insights about this location and the applicant.
The current application is not for a hotel seeking a license to serve alcohol to its guests; instead, it pertains to a standalone market situated in the parking lot of a two-star motel that previously operated as a massage parlor before the pandemic.
The market' s applicant sought an off-premises license from the state' s ABC ( Alcohol Beverage Control) in June 2022. However, the community members protested, prompting the ABC to request a hearing if the applicant wished to proceed. Despite this, the applicant chose not to face the protesters and still decided to open and operate the market without obtaining a beer/ liquor license. Subsequently, the operator circumvented the state' s system and applied for a permit through Anaheim' s planning department, categorizing the business as " existing."
It's important to note that this property is situated within the Anaheim Resort District. To the best of my knowledge, the Anaheim Business License Department typically does not grant licenses for businesses of this nature, including liquor stores, beer/wine stores, bars, hookah lounges, and similar establishments.
Homelessness and Safety:
The entire city of Anaheim, and specifically the Anaheim Resort District, has experienced an unprecedented surge in the homeless population like never before. While we appreciate the city's commendable efforts to house and assist homeless individuals, our concern lies with those who, unfortunately, opt out of participating in the available programs, particularly individuals struggling with alcohol and drug addiction.
Harbor Blvd serves as a thoroughfare for various pedestrians, including families heading to Disneyland, locals commuting to work, and convention attendees. The presence of alcoholics in close proximity to families, especially with children, is not only immoral but also poses significant safety risks. This could lead parents to opt for alternative family vacation destinations, causing detrimental effects on local businesses. The Resort district businesses are still in the process of recovering from the pandemic' s impact, and they require our support and the city's consideration to flourish.
As proud Anaheim residents, we aspire for our city to offer an unforgettable experience to both visitors and locals.
Personally, biking on Harbor Blvd since 2010, I've witnessed the changes Harbor Blvd has undergone with homelessness and crime. I know of a Disneyland cast member who no longer feels safe walking to and from work at night. If adult residents are hesitant to walk in Anaheim' s prime street, it raises concerns for families with children and convention attendees carrying valuable belongings. Attached is a screenshot ( Attachment A) of a Yelp review detailing a car break- in at the Carriage Inn, prior to the addition of a liquor store in the parking lot, illustrating potential consequences if a liquor store is granted at the location.
Alcohol addicts seem drawn to liquor and convenience stores, transforming these locations into popular " hang- out" spots; an example of that is the intersection of Harbor and Katella where there are FIVE alcohol stores. Alcohol and drug addiction are the source of homelessness and criminal activities. Granting alcohol licenses fails to address or curb this problem; instead, it inadvertently fuels its growth. While we often discuss solutions for homelessness and crime at city hall, approving licenses for alcohol supply indirectly contributes to the escalation of these issues.
Crimemapping. com indicates a higher incidence of reported crimes near alcohol stores and their surroundings compared to other retailers. Introducing one more store not only jeopardizes the safety of the community but also poses risks to nearby businesses and residential neighborhoods. The Anaheim Police Department' s Call for Service logs reveal a significant number of avoidable incidents necessitating police response, which could be prevented if a beer store did not exist. This misuse of public resources diverts attention from addressing more pressing law enforcement needs within the community. Attachment B is a copy of police calls for the adjacent AMPM from January 2021 to June 2022, and I have requested additional logs from June 2022 to December 2023, though they have not yet been received from the Anaheim Police Department. Also attached, is a Yelp review of a guest at the Carriage Inn who most likely witnessed a prostitution activity in an adjacent room and presence of police officers on the property ATTACHMENT C-1 and C-2
Schools:
The Carriage Inn and the proposed market on its property are very close to educational establishments. It is only about 425 feet from Parkview Elementary School, about 500 feet from Happy Hearts Preschool and within a half mile from Pondarosa Elementary. Local high school and junior high students commute to schools with the OCTA bus, whose bus stop is Infront of the Carriage Inn and the proposed alcohol store.
Parking:
I noticed in the mailed notice that, in addition to seeking approval for an alcohol license, the applicant is also requesting a reduction in parking space requirements. I'll keep this brief and defer to those who have experienced challenges at the Carriage Inn parking lot. Attached are a few Yelp reviews highlighting difficulties with parking and incidents in the parking lot.

Top of Form
As a property manager, I diligently exceed my responsibilities to ensure our neighborhood attracts a deserving new business. I have intentionally kept multiple vacant spaces available for extended periods to secure a positive addition to the community. While considering prospective tenants, three expressed interests in operating tattoo shops, two proposed meat markets with alcohol, and four intended to establish massage parlors. I declined these applications due to the potential negative impact on both children and adults in our neighborhood.
Again, as a concerned city official and resident of District 4, I urge careful consideration and vigilance before approving the alcohol license for the mentioned establishment located in our Anaheim Resort District. Such a decision could have adverse effects on the community' s well-being, and it is crucial to uphold the standards and regulations that ensure the harmony and integrity of our city.
Sincerely,
Talab Ibrahim
Board Member, Anaheim Public Utilities

To Whom It May Concern,
I live in the area of Harbor Blvd. and Orangewood Ave. It is my understanding that a local market located in front of the Carriage Inn on Harbor Blvd is requesting a liquor license. I am opposed to this as I feel there are already too many locations selling alcohol. We have an existing issue with the homeless population and I believe that alcohol selling establishments contribute to this issue. I am not opposed to alcohol, I drink socially myself. My issue is with the number of establishments already in existence and the increase in homeless people loitering at these establishments. I have a 13 year- old daughter who commutes to school via the city bus system, she leaves and arrives home in the dark. I am greatly concerned about her safety as the homeless population often uses the bus stops as an encampment. Existing alcohol selling establishments near Harbor Blvd currently include:
A Market on Katella
Orange Liquor on Chapman
Magic Land Market on Katella
Hi Crest on Chapman
Jigger on Haster and Chapman
Stadium Liquor on Haster
Kings Liquor on Orangewood
Highland on Chapman
P & J Liquor on Katella
US Liquor on Harbor
This is to name a few. I am requesting that Adventure Land Market on Harbor not be granted the requested liquor license. I believe that this establishment owner has at least two other locations in the Disney area. Enough is enough, we also have schools and parts in this area. There is no need to increase this particular type of business.
Thank you for your time.

Re: INVEST CA, LLC dba ADVENTURE LAND
CUP Modification, request for PCN and removal of restrictive covenant for 2129 S. Harbor Blvd., Anaheim, CA 92802
LETTER OF JUSTIFICATION
Dear Ms. Lauffer,
We write on behalf of Invest CA, LLC doing business as Adventure Land (“Applicant”), in response to the City of Anaheim Planning & Building Department’s comments dated November 16, 2023, regarding Applicant’s request for a finding from the City of Anaheim for:
1) Public Convenience and Necessity for a Type 21 (Off Sale General) Alcoholic Beverage Control ((“ABC”) license;
2) CUP Modification to remove the condition of approval requiring additional parking in order to operate another retail use besides a wig shop at the premise; 3) Remove the covenant restricting the retail use of the premise from running with the real property;
4) Administrative Adjustment to permit fewer parking spaces than required by Code (5% reduction).
for the premise located at 2129 S. Harbor Boulevard, Anaheim, CA 92802.

Request for Public Convenience and Necessity for a Type 21 (Off Sale General) ABC License The primary purpose of the business is a small retail sales establishment that is incidental to and part of the surrounding motel which primarily serves motel patrons and non-motel patrons. The premise allows the purchase of souvenirs, clothing, convenience food items, over the counter medicine and first aid items, travel size toiletries and electronics, as well as other travel and convenience necessities. The sale of alcohol shall be an ancillary use that Applicant believes would provide a necessary service and convenience to patrons, as the only retail location options to purchase similar types of merchandise and alcohol products in one location are over a half mile away from the premises’ current location. Approximately 36-40% of business will be from alcohol sales.
This type of Retail Sales – General use is permitted under as set forth in Table 11-E of Anaheim Municipal Code Section 18.116.070. A Type 21 Off Sale General was purchased from Thrifty Payless, Inc., where it was previously operated at Rite Aid Store #5750, located at premises 31890 Plaza Drive, San Juan Capistrano, CA 92675.
There are only three (3) other locations with an Off-Sale ABC license within census tract 0884.02 as follows:

AM PM Mini Market only sells wine and beer for off sale consumption and therefore does not provide comparable services or products to patrons. Both Hi Crest Liquor and Highland Liquor 2 are typical liquor stores with other grocery and household items. Neither sell souvenirs or travel items and both are over a mile away from Applicant’s premise which specifically serves visitors and tourists staying at local motels and hotels along Harbor Boulevard as well as the general neighborhood near the California Disney Resort area. of selling alcohol, none of the above businesses are oriented to tourist retail sales, providing convenience for motel patrons and visitors to the various attractions and entertainment nearby.
Kings Liquor, which is also in close proximity but in a different census tract, sells wine, beer, and distilled spirits as well as grocery items, but does not sell souvenirs or items for travel.
Parkview Elementary School is a half mile away from the premise, and the premise is adjacent to a residential neighborhood. However, the type of license being requested should not impact a residential area or school as the license is for off sale, where patrons will consume products off site from the premises, thus no increase in noise or potential nuisance will be at issue any more than what currently exists under the store’s present operations.
The business provides motel patrons and non-motel patrons with convenient necessities such as travel items, snacks and beverages, souvenirs, clothing, sundry goods, limited hygiene products, and over the counter medications. Tourists and travelers of the area, including guests of the numerous surrounding adjacent motels, hotels, and theme parks in the immediate area, are served by the store’s convenience as other similar locations within a one-mile radius do not provide the same retail items.
No loitering signs will be posted, and surveillance camera systems will ensure that both the premises location and adjacent motel prevent security and safety hazards to patrons and nearby residents. The site, to include the premises establishment and the motel in general, is equipped with security cameras as depicted on the plans.
The plans submitted with the application provide square footage calculations for each storage and/or display area proposed for the beer, wine, and distilled spirits, and clearly label each of these storage and display areas on the floor plan. The distilled spirits will be displayed behind the cash register and only accessible by the on-duty employees. No distilled spirits will be located on the sales floor for direct access to patrons. Beer and wine will be located in coolers and directly accessible to patrons for purchase. There will be no barrels or temporary locations. For the location of the products see plans submitted concurrently herewith. The hours of operation for the business will be Monday through Thursday from 7 a.m. to 11 p.m. and Friday to Sunday from 7 a.m. to 12 a.m.
The business will be offering for sale and selling the types of alcoholic beverages permitted under a Type 21 License, i.e., beer, wine, and distilled spirits. Distilled spirits of a normal array and variety will be offered, which will be located behind the register, non-refrigerated, and only accessible by the on-duty employees. Beer will be displayed for sale within coolers on the sales floor. There may be unrefrigerated beer on the premises but such unrefrigerated beer will not be available for sale, rather, they will be stored on the premises for future placement in coolers for sale.
Applicant has reviewed the comments from the Anaheim Police Department dated March 14, 2023, and agrees and will comply with the Police Department’s instructions to implement crime prevention precautions and adhere to the recommended conditions that are to be placed on the CUP.
The Proposed use will support the existence of Public Convenience and Necessity for this location. As required by California Business and Professions Code §23958 and 23958.4 Applicant requests

that the local governing body find that public convenience and necessity will be served as Applicant’s primary use as a retailer will offer customary grocery, travel, and souvenir products needed by patrons in the community in addition to the ancillary sales of alcoholic beverages.
Request for CUP Modification to remove the condition of approval requiring the covenant restricting the use of the building and removal of the covenant restricting the use of the building from the property.
In 1986 former owners recorded a restrictive covenant on the property for the sole purpose of obtaining a conditional use permit to construct and operate their proposed motel. The parking requirements for the existing retailer (a wholesale wig shop) were in excess of what the retailer’s needs were, thus the parking variance was requested for the requisite needs of the proposed motel.
The restrictive covenant was recorded to ensure that the existing retailer had enough parking to serve the business needs and would not be impacted by the addition of a 51 unit, 3 story motel.
The wig shop would not require any additional parking stalls outside those needed for employees and wholesale buyers of the wig shop. The covenant was written to support commercial use and ensure that traffic and parking would not interfere with other businesses and to serve the benefit of the public.
However, although this restricted use was well intentioned, a perpetual restriction of the premise was short sighted. This was evident in the application where the lease for the wig shop retailer was only for a term of 10 years. The parking variance was stated to become null and void upon any change of use from the existing retail use as a wholesale wig shop. The existing retail use has varied over the last 37 years from that of a wig shop, and the restrictive covenant was not enforced despite changes in ownership for the retail and motel businesses. The Applicant believes that the course of business over the last almost 4 decades establishes that additional parking is not needed.
The premise primarily serves the local motel patrons who have parking per the motel requirements for parking, and parking stalls used by non-motel patrons is on average for no longer than a course of 15 minutes. Parking and traffic have not been greatly impacted by the continued variance in retail use (from that of a wig shop), and if it had, Applicant believes the City would have sought to enforce restricted use within the last 30 or so years, which to the Applicant’s knowledge they have not. The restrictive covenant is an impotent device that no longer serves the benefit of the businesses, their patrons, nor the City of Anaheim.

Parking Justification1
Counts of occupied parking stalls at the site were taken on Tuesday, November 21, 2023, between 8 a.m. and 10 p.m. and Friday, November 24, 2023, between 8 a.m. and 10 p.m. and Saturday, November 25, 2023, to between 8 a.m. and 10 p.m. to determine the number of parking stalls actually being utilized at the project site during anticipated peak hours of operation. The existing parking lot for this building contains a total of 44 spaces. Based upon the counts taken on the above-referenced days, the maximum number of occupied parking spaces for:
• Tuesday, November 21, 2023, with 21 stalls used on the hotel side between 9 a.m. and 10 a.m., and 3 stalls in front of Adventure Land between 11 a.m. and 12 p.m.; • Friday, November 24, 2023, with 30 stalls used on the hotel side at 10 p.m. and 4 stalls used in front of Adventure Land between 8 a.m. and 9 a.m.; • Saturday, November 25, 2023, with 34 stalls used on the hotel side between 8 a.m. and 9 a.m. and 4 stalls being used in front of Adventure Land between 8 a.m. and 10 a.m.
The maximum number of stalls used at any one time was 38 stalls, which falls below the total number of 44 stalls allocated to the project site.
In conclusion, the Applicant respectfully requests that the City finds Public Convenience and Necessity for a Type 21 (Off Sale General) Alcoholic Beverage Control (“ABC”) license; modifies the CUP to remove the condition of approval requiring additional parking in order to operate another retail use besides a wig shop at the premise; removes the covenant restricting the retail use of the premise from running with the real property; and allows a reduction of 5% in the required parking. The Applicant looks forward to a great working relationship with the City of Anaheim, the surrounding businesses, and the community at large.

RE: PARKING STUDY LETTER FOR ADVENTURE LAND LOCATED AT 2129 SOUTH HARBOR BOULEVARD, ANAHEIM, CALIFORNIA.
Introduction
The purpose of this parking justification letter is to determine the parking demand for Adventure Land, a 2,667 square foot general retail sales establishment that is incidental to and part of the surrounding hotel, The Carriage Inn, which includes 51 guest rooms, a manager’s office, and no banquet or meeting room areas. The City of Anaheim Municipal Code’s parking requirement for hotels is 0.8 spaces per guest room, plus 1 space per 1,000 square feet of retail space, plus 0.25 spaces for each employee working in the guest room areas. Therefore, based on the Code requirement for hotels with incidental retail square footage, a total of 46 stalls are required, while the project site has 44 stalls available. There is a total of 6 stalls available directly in front of the Adventure Land retail building, while the adjacent hotel parking area includes an additional 38 stalls. Both the retail and hotel buildings are located on the same parcel with a shared parking lot area.
Operational Characteristics
The project consists of a small retail sales establishment that is incidental to and part of the surrounding motel which primarily serves motel patrons and non-motel patrons. The premise allows the purchase of souvenirs, clothing, convenience food items, over the counter medicine and first aid items, travel size toiletries and electronics, as well as other travel and convenience necessities. The sale of alcohol shall be an ancillary use that Applicant believes would provide a necessary service and convenience to patrons. Adventure Land has been open for approximately 18 months and now requests that the City of Anaheim approve the following:
1) Public Convenience and Necessity for a Type 21 (Off Sale General) Alcoholic Beverage Control ((“ABC”) license;
2) CUP Modification to remove the condition of approval requiring additional parking in order to operate another retail use besides a wig shop at the premise; 3) Remove the covenant restricting the retail use of the premise from running with the real property.
Other characteristics of the project include:

Observed Parking Demand at Project Site
Counts of occupied parking stalls at the site were taken on Tuesday, November 21, 2023, between 8 a.m. and 10 p.m. and Friday, November 24, 2023, between 8 a.m. and 10 p.m. and Saturday, November 25, 2023 to between 8 a.m. and 10 p.m. to determine the number of parking stalls actually being utilized at the project site during anticipated peak hours of operation. The existing parking lot for this building contains a total of 44 spaces. Based upon the counts taken on the above-referenced days, the maximum number of occupied parking spaces for:
• Tuesday, November 21, 2023, with 21 stalls used on the hotel side between 9 a.m. and 10 a.m., and 3 stalls in front of Adventure Land between 11 a.m. and 12 p.m.;
• Friday, November 24, 2023, with 30 stalls used on the hotel side at 10 p.m. and 4 stalls used in front of Adventure Land between 8 a.m. and 9 a.m.; • Saturday, November 25, 2023, with 34 stalls used on the hotel side between 8 a.m. and 9 a.m. and 4 stalls being used in front of Adventure Land between 8 a.m. and 10 a.m.
The maximum number of stalls used at any one time was 38 stalls, which falls below the total number of 44 stalls allocated to the project site.
Other Circumstances
Other circumstances exist at the project site and/or the proposed use that further reduces the parking demand and includes:

Analysis
The observed parking demand at the existing project site is 38 stalls, which is less than the 44 stalls available on the property. Because Adventure Land was already operating during the time of the parking study counts, it can be assumed that the counts represent an average parking demand for the project site, and that adequate parking is available for both the hotel and general retail sales establishment.
