DATE: MAY 7, 2024
FROM: PLANNING AND BUILDING DEPARTMENT
SUBJECT: APPEAL OF THE PLANNING COMMISSION DECISION
APPROVING DEVELOPMENT APPLICATION NO. 2023-
00011 FOR A DETERMINATION OF PUBLIC

CONVENIENCE OR NECESSITY TO PERMIT OFF-SITE
SALES OF ALCOHOLIC BEVERAGES; MODIFICATION TO
CONDITIONAL USE PERMIT NO. 2725; AND

ADMINISTRATIVE ADJUSTMENT FOR A REDUCTION IN
REQUIRED PARKING FOR ADVENTURE LAND AT 2125-
2129 SOUTH HARBOR BOULEVARD
ATTACHMENT (Y/N): YES ITEM # 23
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Resolution, deny the appeal and uphold the Planning Commission’s decision to approve a determination of Public Convenience or Necessity to permit off-site sales of alcoholic beverages; modification to Conditional Use Permit No. 2725; administrative adjustment for a reduction in required parking for Adventure Land, a retail sales-general use located at 2125-2129 South Harbor Boulevard; finding that the project is Categorically Exempt from the requirements to prepare additional environmental documentation per CEQA Guidelines Section 15301 and 15302.2 (c); and approve Development Application No. 2023-00011, thereby approving the project.

DISCUSSION:

This item was originally brought to the City Council on appeal from the January 17, 2024 decision of the Planning Commission. At the February 27, 2024 City Council meeting, the appellant, Talab Ibrahim, stated that the information presented with respect to the number of rooms at the Carriage Inn motel was incorrect. Because this information is integral to the application, the City Council continued consideration of the appeal to Development Application No. 2023-00011 until March 26, 2024 after closing the public hearing. On March 26, 2024, staff requested that the City Council continue the item to May 7, 2024 to allow for additional research and site investigations to inform staff’s recommendation to City Council.

Appeal of Development Application No. 2023-00011
May 7, 2024

Page 2 of 2 ends

City staff verified that the number of existing motel rooms at the Carriage Inn exceeds, and is in conflict with, the original entitlement of 51 rooms approved for the property. At some point, likely beginning in the 1990s, exterior doors were added to the two-room suites (11 additional rooms) and portions of the manager and owner’s units as well as storage areas were converted to separately rented rooms (five total). Additionally, parking spaces were added to the parking lot which do not meet size and circulation requirements.

The property owner, who is also the owner of the Carriage Inn motel, agrees to reduce the number of motel rooms to 51 rooms, consistent with the originally permitted number of rooms under Conditional Use Permit No. 2725 and remedy work completed without the benefit of permits (Attachment No. 2).

Staff recommends that Condition Nos. 30 and 31 be added as reflected in the revised resolution follows:

Condition No. 30: The property owner shall, obtain permits from the Building Division to, (i) remove modifications to the property which render it inconsistent with the original number of motel rooms and related conditions pursuant to Conditional Use Permit No. 2725 and (ii) restore the property to a Building Code-compliant condition including restriping the parking lot pursuant to BLD2015-06006 (41 stalls), all within 180 days of approval of DEV2023-00011.

Condition No. 31: The sale of alcohol on the property pursuant to the Public Convenience or Necessity approved by DEV No. 2023-00011 shall not commence until Condition No. 30 is deemed satisfied by the Planning and Building Department Director.

IMPACT ON BUDGET:

There is no budgetary impact. The Appellant paid the fee necessary to schedule this appeal request, and the costs associated with this hearing will be incurred by the project applicant.

Respectfully submitted,
Ted White
