The City received three bid protests from the second, third and fifth lowest bidders related to premium time labor due to certain work taking place during nighttime hours to reduce traffic impacts. Asplundh responded to each protest and no cause has been established to reject the current low bid.

The Project is for Anaheim Public Utilities (APU) to improve electrical reliability and provide operational flexibility within the Platinum Triangle as well as to provide electrical capacity for ocV!BE (Customer) for the electric service needs of its planned development. The work involves underground substructure and electrical installations along Gene Autry Way, State College Boulevard, and Katella Avenue. Street improvements for the ocV!BE development will be performed by the Customer, and the schedule is being coordinated with City departments.

Electric line extensions requested by large developments are provided in accordance with APU’s Electric Rates, Rules, and Regulations that requires the associated costs to be fully paid by the Customer. The Customer’s costs are based on their proportionate share of Project activities, including design, permits, construction, inspection, pavement restoration, and materials attributable to their electric service needs. The final Project costs shall be audited by the City’s Audit Division and any adjustments made thereafter to reflect actual Project expenditures to ensure that the Customer is paying its full cost responsibility.

The bid includes a provision of $6,000,000 for the contractor to procure electrical equipment such as transformers, cables, and switches required for the project. This is to address the high volume of equipment needed and industry material shortages resulting in long delivery times. This will align procurement activities with the construction schedule. Payments will only be made for equipment delivered for the Project.

The bid price reflects the current bidding environment, appears to be reasonable, and is within the available funding. Liquidated damages for this project shall be $1,000 per day. Construction is scheduled to be completed by the 4th quarter of 2025.

COMMUNITY WORKFORCE AGREEMENT (CWA):

This Project is not a covered “Project Work” as that term is defined in the Amended and Restated Community Workforce Agreement (CWA). Electric utility work on high voltage utility equipment and other special utility construction work are specifically exempt and excluded from the scope of the CWA.

ENVIRONMENTAL DETERMINATION:

Anaheim Public Utilities recommends that City Council determine that the Project is categorically exempt from CEQA pursuant to Sections 15301(b), 15303(d), and 15304 of Title 14 of the California Code of Regulations. The Project will consist of installing new underground electrical facilities and installing minor street apparatuses to improve existing system reliability. There is no potential for significant effect on the environment.
