SUBJECT: AMENDMENT TO ORDINANCE NO. 6570, NUNC PRO TUNC,
TO CORRECT A CLERICAL DRAFTING ERROR
PERTAINING TO THE AMENDMENT OF CHAPTER 18.14
(PUBLIC AND SPECIAL-PURPOSE ZONES) OF TITLE 18
(ZONING) OF THE ANAHEIM MUNICIPAL CODE
ATTACHMENT (Y/N): YES ITEM # 27
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council introduce an ordinance of the City of Anaheim (City) amending Ordinance No. 6570, nunc pro tunc, to correct a clerical drafting error in Ordinance No. 6570, pertaining to the amendment of Chapter 18.14 (Public and Special-Purpose Zones) of Title 18 (Zoning) of the Anaheim Municipal Code.
DISCUSSION:
On March 19, 2024, the City Council adopted Ordinance No. 6570 which amended various chapters of Title 18 of the Anaheim Municipal Code (the “Code”) as part of the City’s annual code update program in furtherance of the City’s efforts to identify potential changes to increase efficiency, improve service delivery, and respond to changing regulatory and market demands.
Inadvertently, Ordinance No. 6570 when adding a new subjection to Section
18.14.030 (Uses) of Chapter 18.14 (Public and Special-Purpose Zones) of Title 18 (Zoning) of the Anaheim Municipal Code incorrectly utilized a number associated with an existing subsection having the effect of replacing an existing unrelated provision. This amendment can be found in Section 10 of Ordinance No. 6570.
Upon codification of Ordinance No. 6570, staff discovered the clerical error. If the City Council introduces and subsequently adopts the subject ordinance to correct this clerical error and add the new subsection as 18.14.030.140, it will have retroactive legal effect to the effective date of Ordinance No. 6570, which was April 18, 2024.
Amendment to Ordinance No. 6570, Nunc Pro Tunc
May 21, 2024
IMPACT ON BUDGET:
The costs to process and implement this Code amendment are included in the Planning and Building Department’s FY 2023/24 General Fund budget.
Respectfully submitted,
Ted White
Deputy City Manager/Director of Planning and Building
