CITY COUNCIL AGENDA REPORT
City of Anaheim
CITY MANAGER’S OFFICE
DATE: MAY 21, 2024
FROM: CITY MANAGER’S OFFICE
SUBJECT: RESOLUTION AUTHORIZING THE CITY MANAGER TO

EXECUTE AND ADMINISTER LICENSES AND RIGHT-OF-

ENTRY AGREEMENTS
ATTACHMENT (Y/N): YES ITEM # 24
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Resolution, authorize the City Manager to execute and administer Licenses and Right of Entry agreements on behalf of the City of Anaheim, each with a term not to exceed one year, allowing for temporary beneficial use of real property assets until such time as these properties are ready for disposition or development.

DISCUSSION:

The City of Anaheim (City) is actively pursuing opportunities to utilize vacant land under the jurisdiction of various departments such as the former Redevelopment Agency, Community Services, Economic Development, Anaheim Public Utilities, and Public Works Department. As the City has undergone significant development in recent years such as the five-freeway widening, multiple street widening projects, and new regulations, multiple remnant properties have been identified for potential repurposing. In the past, these properties have previously served as storage for construction materials or equipment for public works projects and have also accommodated temporary storage needs for large conventions hosted by the City. Requests for temporary use may also come from private parties. These vacant properties present opportunities for beneficial uses such as renewable energy installations, stormwater management systems, community gardens, and greenways.

Timing is crucial for the temporary use of these vacant properties as they are often related to priority projects underway and each department’s need for temporary usage arises unexpectedly and often urgently. Having the ability for temporary use of these vacant properties at the right time is of high importance as delayed access can lead to project bottlenecks, increase costs due to off-site storage, or missed opportunities. The ability to swiftly secure temporary use for these vacant properties ensures each department can capitalize on time-sensitive opportunities for priority projects.

For transparency and accountability purposes, staff plans to report each license and right- of-entry agreement to City Council once fully executed. This is to ensure City Council Resolution Authorizing the City Manager to Execute and Administer Licenses and Right-of-Entry Agreements May 21, 2024

remains informed of the temporary use of each vacant property and can provide oversight to further ensure the licenses and right-of-entry agreements align with the City’s goals and priorities.

Recognizing the temporary nature of these requests and their potential to contribute positively to the City, staff seeks authorization allowing the City Manager to execute and administer the Licenses and Right-of-Entry Agreements, each with a term not to exceed one year, allowing for the temporary use of such real property assets.

The attached Resolution provides for the requested authorization and includes provisions ensuring that the license can be reasonably terminated without cause, indemnity and insurance provided as determined by the City’s Risk Manager, reasonable license fees as determined by the City Manager, and approval of the form of the license agreement by the City Attorney’s Office. Should the proposed use of the real property directly benefit the City, department, project or program, the City Manager may waive the license fee.

IMPACT ON BUDGET:

There is no budgetary impact.

Respectfully submitted,
Greg Garcia
Assistant City Manager
