CITY COUNCIL AGENDA REPORT
City of Anaheim
PLANNING AND BUILDING DEPARTMENT
DATE: JULY 16, 2024
FROM: PLANNING AND BUILDING DEPARTMENT
SUBJECT: AMENDMENT TO ANAHEIM MUNICIPAL CODE SECTION
18.54.035.070 TO REQUIRE ANNUAL RENEWAL OF SEX-
ORIENTED BUSINESS EMPLOYEE IDENTIFICATION CARDS
(DEVELOPMENT APPLICATION NO. 2024-00026)
ATTACHMENT (Y/N): YES ITEM # 27
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Ordinance, amend Section 18.54.035.070 of the Anaheim Municipal Code to require annual renewal of Sex-Oriented Business Employee Identification Cards, and determine that the proposed amendment is not subject to the California Environmental Quality Act (CEQA) Guidelines under Section 15061(b)(3) of Title 14 of the California Code of Regulations (Introduction).
DISCUSSION:
The Zoning Code requires Sex Oriented Business Entertainers, Managers, and Acting Managers to have a sex-oriented business employee identification card. The Police Department processes and investigates the sex-oriented business employee identification card applications. Currently, issued identification cards are valid for a period of three years, at which time an identification card must be renewed and reviewed by the Police Department.
High employee turnover rates in these businesses render impractical the current three-year validity. Therefore, the Police Department proposes a reduction in the duration of the identification card to one year to ensure more accurate and up-to-date records. Annual renewals will promote regular interactions between employees and the Police Department, enhancing law enforcement's ability to monitor and prevent illegal activities in sex-oriented businesses.
Planning Commission: On June 17, 2024, the Planning Commission recommended City Council approval of the Zoning Code amendment, 6-0; Commissioner Walker was absent. There were no public comments.
Amendment to Anaheim Municipal Code to Require Annual Review of Sex-Oriented Business Employee Identification Cards July 16, 2024
Environmental Impact Analysis: Staff recommends that the City Council find that the proposed ordinance is not subject to the California Environmental Quality Act (CEQA). This determination is pursuant to Section 15061(b)(3) of the State CEQA Guidelines. Pursuant to this section, the proposed amendment fits within the general rule that CEQA only applies to projects that have the potential for causing a significant effect on the environment. The proposed amendment is limited to a change in the duration of the identification card. Thus, the proposed amendment will not have a significant effect on the environment; therefore, the activity is not subject to CEQA.
IMPACT ON BUDGET:
The costs to process and implement this Code amendment are included in the Planning and Building and Police Departments’ FY 2024/25 budgets, respectively.
Respectfully submitted, Concurred by,
Ted White Rick P. Armendariz
Deputy City Manager / Chief of Police
Director of Planning and Building
