RECOMMENDATIONS:
That the City Council, by Motion:
1) Approve the Right-of-Way Contract with Edgar Montanez and Gema Alicia Montanez for the purchase of real property at 2230 E. La Palma Avenue, in the amount of $98,900, for a Permanent Road Easement and a Temporary Construction Easement and authorize the acquisition payment of $98,900 to Edgar Montanez and Gema Alicia Montanez plus escrow fees not-to-exceed $1,500 for the Citywide Safe Routes to School (SRTS) Sidewalk Gap Closure Project (Project); and 2) Approve the Right-of-Way Contract with Lawrence Molesky for the purchase of real property at 2238 E. La Palma Avenue, in the amount of $99,400, for a Permanent Road Easement and a Temporary Construction Easement and authorize the acquisition payment of $99,400 to Lawrence Molesky plus escrow fees not-to- exceed $1,500 for the Project.
DISCUSSION:
The Department of Public Works is acquiring right-of-way easements and temporary construction easements within the properties at 2230 E. La Palma Avenue and 2238 E. La Palma Avenue for the Citywide Safe Routes to School (SRTS) Sidewalk Gap Closure Project.
This Project is part of the Department of Public Works’ efforts to enhance safety around school areas. The Project will add new sidewalks around various parts of the City (on Acacia Street, La Palma Avenue, and Frontera Street) and a new multi-use trail on the south side of Santa Ana Canyon Road between Fairmont Boulevard and Eucalyptus Drive.
The new sidewalks and multi-use trails will close the sidewalk gaps located within one- half mile of school entrances on arterial streets and ensure pedestrians and students have a safe path of travel to their destinations. Currently, pedestrians walk on the street, across lawns, and on uneven segments of private property to reach their destinations.
Right-Of-Way Contracts for the Acquisition of Real Property located at 2230 E. La Palma Avenue and 2238 E. La Palma Avenue for the Citywide Safe Routes to School Sidewalk Gap Closure Project

Edgar Montanez and Gema Alicia Montanez have agreed to the purchase price of the easements at 2230 E. La Palma Avenue for $98,900 and Lawrence Molesky has agreed to the purchase price of the easements at 2238 E. La Palma Avenue for $99,400. The purchase prices are based on the appraised fair market value. The City will also pay the escrow fees for each transaction not-to- exceed $1,500 for the property located 2230 E. La Palma Avenue and not-to-exceed $1,500 for the property located at 2238 E. La Palma Avenue pursuant to the Right-of-Way Contracts.
Upon approval of the Right-of-Way Contracts, the Director of Public Works will accept City Deeds No. 12780 and 12781 (APN 083-013-13, ACQ2024-01534) located at 2230 E. La Palma Avenue and City Deeds No. 12782 and 12783 (APN 083-013-14, ACQ2024-01536) located at 2238 E. La Palma Avenue conveying to the City of Anaheim certain real property interests granted in conjunction with the Project pursuant to Resolution No. 2021-042, and authorize the City Clerk to attest and cause said Deeds to be recorded in the Office of the Orange County Recorder.
IMPACT ON BUDGET:
Adequate funds are available in Federal Grant and restricted Transportation Funds in the Public Works Department’s FY 2024/25 Budget.
