RECOMMENDATION:
That the City Council, by Motion:
1) Waive the sealed bidding requirement of Council Policy 4.0 and ratify the three- month extension of a master agreement with Greentech Landscape, Inc., Whittier, CA, to provide landscape maintenance services for the East area of the City of Anaheim (City), in the amount of $93,496.96 and a 20% contingency for unforeseen service requirements for the extension period, term ending August 31, 2024.
2) Accept the bid from DMS Facility Services, in the amount of $329,760 plus a 20% contingency, to provide landscape maintenance services covering the East area of the City for a one-year period with up to four one-year optional renewals; and authorize the Purchasing Agent to exercise the renewal options, all in accordance with Bid #9790.
DISCUSSION:
Purchasing solicited bids from known contractors and posted the bid on the City’s procurement portal. Sealed bids were received by 2:00 p.m., July 9, 2024, from the following companies and were publicly opened immediately thereafter.

Greentech Landscape, Inc. provides landscape maintenance services for the East area of the City. The master agreement was in the final year of a five-year agreement. The three- month extension allows for the uninterrupted continuation of services while the City goes through the process of establishing a new agreement.
The bid was based on a fixed monthly cost for landscape services to maintain areas in the East portion of the City, covering a total of 30 different work sections. These services include, but are not limited to, the maintenance of plant materials, turf areas, irrigation systems, litter control, mowing, edging, pruning, watering, fertilizing, mulch replacement, weed and pest control, parkways, medians, berms, and tree wells.
The term of the agreement will be for a one-year period with up to four one-year optional renewals. Unit pricing is fixed for the initial one-year base period. The renewal periods shall be negotiated each year with any increases not-to-exceed the change in the Consumer Price Index (CPI) for the L.A.-Long Beach-Anaheim areas for the most recent available month period. Increases in direct labor shall also be negotiated limiting any change to the CPI and the actual amount of any increase in the prevailing wage. The 20% contingency is recommended to provide the ability to address any unforeseen service requirements that may arise during the term of the agreement.
IMPACT ON BUDGET:
Sufficient funds are available in the Public Works Department’s Fiscal Year 2024/2025 Right of Way general fund budget. Funding for subsequent years will be subject to Council’s approval of budget appropriations.
