FOR VALUABLE CONSIDERATION, receipt of which is hereby acknowledged Frontera LLC, a California limited liability, (Grantor) hereby grants to City of Anaheim, a charter city, (Grantee), its agents, representatives, successors and assigns, a temporary construction easement over, on, under, in, across, along and through that portion of Grantor’s Property more particularly described in Exhibit “A1” and depicted in Exhibit “B1” attached hereto and made a part hereof (“Easement Area”), for the purpose of all reasonably necessary activities associated with construction of the Citywide SRTS Sidewalk Gap Closure Project ( “Project”). The Temporary Construction Easement is located wi thin a portion of Assessor Parcel Numbers 268- 331-02 and 268-331-06 (the “Property”).
The term of the Temporary Construction Ea sement described herein will commence on the date of the deposit of funds into escrow and expire thirty-six (36) months thereafter. The actual/physical construction activities within th e temporary construction easement area will be limited to a period of six (6) consecutive months within the thirty-six (36) month period (The “Construction Period”). During the Construction Period, the temporary construction easement shall be exclusive and during the remaining th irty (30) months, the temporary construction easement shall be non-exclusive.
