RECOMMENDATIONS:
That the City Council, by Motion:
1) Approve the Right-of-Way Contract with JJAC Enterprises LLC, for the purchase of real property at 1041 N. Acacia Street, in the amount of $39,368.33, for a Permanent Road Easement and a Temporary Construction Easement and authorize the acquisition payment of $39,368.33 to JJAC Enterprises LLC plus estimated escrow fees not-to-exceed $11,500, for the Citywide Safe Routes to School (SRTS) Sidewalk Gap Closure Project (Project); and
2) Approve the Right-of-Way Contract with Frontera LLC for the purchase of a Temporary Construction Easement at 2930 E. Frontera Street, in the amount of $71,559.90, and authorize the acquisition payment of $71,559.90 to Frontera LLC for the Project.
DISCUSSION:
The Department of Public Works is acquiring a right-of-way easement and a temporary construction easement within the property located at 1041 N. Acacia Street and a temporary construction easement within the property located at 2930 E. Frontera Street for the Citywide Safe Routes to School (SRTS) Sidewalk Gap Closure Project.
This Project is part of the Department of Public Works’ efforts to enhance safety around school areas. The Project will add new sidewalks around various parts of the City of Anaheim (City), on Acacia Street, La Palma Avenue, and Frontera Street,) and a new multi-use trail on the south side of Santa Ana Canyon Road between Fairmont Boulevard and Eucalyptus Drive. The new sidewalks and multi-use trails will close the sidewalk gaps located within one-half mile of school entrances on arterial streets and ensure pedestrians and students have a safe path of travel to their destinations. Currently, pedestrians walk on the street, across lawns, and on uneven segments of private property to reach their destinations.
Right-Of-Way Contracts for the Acquisition of Real Property located at 1041 N. Acacia Street and 2930 E. Frontera Street for the Citywide Safe Routes to School (SRTS) Sidewalk Gap Closure Project

JJAC Enterprises LLC has agreed to the purchase price of the easements at 1041 N. Acacia Street for $39,368 and Frontera LLC has agreed to the purchase price of the easement at 2930 E. Frontera Street for $71,559. The purchase prices are based on fair market value and negotiations with the property owners resulting in administrative settlements as being reasonable, prudent, and in the public interest. The City will also pay the estimated escrow fees not-to-exceed $11,500 for the property located at 1041 N. Acacia Street.
Upon approval of the Right-of-Way Contracts, the Director of Public Works will accept City Deeds No. 12778 and 12779 (APN 073-333-23, ACQ2024-01535) located at 1041 N. Acacia Street and City Deed No. 12784 (APN 268-331-02 and 268-331-06, ACQ2024-01537) located at 2930 E.
Frontera Street conveying to the City of Anaheim certain real property interests granted in conjunction with the Project pursuant to Resolution No. 2021-042, and authorize the City Clerk to attest and cause said Deeds to be recorded in the Office of the Orange County Recorder.
IMPACT ON BUDGET:
Adequate funds are available in Federal Grant and restricted Transportation Funds in the Public Works Department’s FY 2024/25 Budget.
