CITY COUNCIL AGENDA REPORT
City of Anaheim
CITY MANAGER’S OFFICE
DATE: AUGUST 20, 2024
FROM: CITY MANAGER’S OFFICE
SUBJECT: AGREEMENT WITH FANSLAU GOVERNMENT AFFAIRS

FOR STATE LEGISLATIVE ADVOCACY AND CONSULTING

SERVICES
ATTACHMENT (Y/N): YES ITEM # 09
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Motion, approve an Agreement with Fanslau Government Affairs for state legislative advocacy and consulting services for a term of one-year with two (2) optional one-year renewals, at a rate of $17,000 per month with a not-to-exceed amount of $625,000; and authorize the City Manager, or designee, to administer the agreement under the terms and conditions of the Agreement.

DISCUSSION:

In December 2023, city staff issued a Request for Proposals (RFP) for state legislative advocacy and consulting services and distributed the RFP for consideration by numerous Sacramento firms. As outlined in the RFP, the city is seeking to enter into an agreement with a well-managed, highly qualified consultant to provide professional services that support the administration of the city’s legislative program. The scope of work required generally includes providing analysis and advice on legislative issues, developing strategies, monitoring legislation, advocating for Anaheim’s priorities and interests, and identifying funding opportunities.

The city received a total of four (4) proposals from Sacramento firms. In accordance with Council Policy 4.1, a review panel was created and comprised of city staff from the City Manager’s Office, Housing and Community Development, and Public Utilities.

The panel conducted interviews with all firms and completed an evaluation of those firms based upon their written submissions and responses provided during the interview portion of the process. Upon completion of that process and a full vetting of the firms and all potential conflicts, city staff has selected Fanslau Government Affairs (FGA) as its preferred candidate.

FGA provided the city with a comprehensive proposal demonstrating their qualifications in legislative advocacy. Due to their relatively small client base with municipalities, FGA offers the city dedicated representation without any direct conflicts and fewer potential conflicts in representing Anaheim objectives. As part of FGA’s proposal, the firm will subcontract with Carter, Wetch, and Associates, another well-known Sacramento advocacy firm, on certain Anaheim issues that may require a more robust legislative strategy.

The initial term of the proposed Agreement is from September 1, 2024 to August 31, 2025 with a rate of $17,000 per month. Upon completion of the initial term, the agreement would allow for two (2) optional one-year renewals. The total compensation includes an additional $13,000 to cover any travel-related costs and services beyond the agreed monthly amount. The Agreement allows for either the city or Fanslau Government Affairs to terminate without cause with ten (10) days written notice.

IMPACT ON BUDGET:

Sufficient funds are available in the City Administration’s FY 2024/25 General Fund.

Respectfully submitted,
Greg Garcia
Assistant City Manager
