CITY COUNCIL AGENDA REPORT
City of Anaheim

COMMUNITY SERVICES DEPARTMENT
DATE: SEPTEMBER 24, 2024
FROM: COMMUNITY SERVICES DEPARTMENT
SUBJECT: APPROVE AN AGREEMENT WITH MAGNOLIA SCHOOL

DISTRICT TO LEASE A PORTION OF DISTRICT PROPERTY AT

SCHWEITZER PARK FOR PARK PURPOSES
ATTACHMENT (Y/N): YES ITEM # 14
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion, approve an Agreement between the Magnolia School District and the City of Anaheim for lease of a portion of the School District’s Real Property at Schweitzer Park (Agreement) in exchange for maintenance and utilities services for an initial ten-year term with three additional five-year renewal options; and authorize the Director of Community Services or designee, on behalf of the City, to execute the Agreement and any related documents and to take such actions as are necessary to implement and administer the Agreement.

DISCUSSION:

The Original Lease between the City of Anaheim (City) and the Magnolia School District (School District) to lease a portion of Schweitzer Elementary’s property at Schweitzer Park is expiring on September 30, 2024.

The Initial Term of the Lease began in 1974, enabling the City to use a portion of Schweitzer School property for the development of Schweitzer Park as a 25-year lease with an option to renew for an additional 25 years. In 1996, City Council approved an Amendment to Lease Agreement to provide for the installation of a chain link fence and gates within the park lease area for improved school security, maintaining the lease term and option to extend the Agreement for an additional 25-year term as contained in the original Lease.

This Agreement will allow the City to continue to use 1.68 acres of the school property for park purposes for a term of ten years with three additional five-year terms. In exchange for continued use of the property for park purposes, the City will continue maintenance of the property and be responsible for associated utilities.

IMPACT ON BUDGET:

Sufficient funds for maintenance and utility expenses are available in the Community Services Department’s Fiscal Year 2024/25 General Fund budget.
