CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: SEPTEMBER 24, 2024
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: AWARD OF CONTRACT FOR ANAHEIM CONVENTION

CENTER NORTH LIGHTING CONTROL MODIFICATIONS

AND RELATED WORK (RE-BID)
ATTACHMENT (Y/N): YES ITEM # 10
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion, award the contract to the lowest responsible bidder, Optima Energy, Inc. of Artesia, California, Contractor’s License No. 907155, Classification C-10, in the amount of approximately $1,023,076, for the Anaheim Convention Center (ACC) North Lighting Control Modifications and Related Work Project (Re-Bid) (Project); waive minor irregularities, variances and discrepancies associated with the bid documents as well as the number of bids received; authorize and direct the Director of Public Works, on behalf of the City of Anaheim (City), to execute the Contract and any other related documents and to take such actions as are necessary to implement and administer the Contract; and authorize and direct the Finance Director to execute the Escrow Agreement pertaining to contract retentions.

DISCUSSION:

The bid is summarized as follows:

1. Optima Energy, Inc., Artesia, CA.................................................... $1,023,075.94 The Lighting Control system in ACC North will be adjusted to incorporate the original contract functionality and flexibility requirements necessary to accommodate major clients with a variety of shows, meetings and exhibits that have a multitude of lighting control preferences and sequences. In collaboration with the maintenance and operations staff at the Convention Center, a supplemental needs assessment and corresponding engineering design, which includes a stand-alone Wi-Fi network, has been performed and completed by licensed engineers.

The project scope consists of
 Repurposing existing and installing new control system components, cabling, switches, conduits, etc. to the maximum extent practical; Award of Contract for the Anaheim Convention Center North Lighting Control Modifications and Related Work September 24, 2024

Page 2 of 2 ends

 Constructing an independent and stand-alone Wi-Fi network, for the sole purpose of supporting the operation of the lighting control system, without impacting the commercial Wi-Fi network reserved for add-on purchase by the clients;  Installing new power cables, conduit, breakers, etc. along with other miscellaneous items of work; and
 Programming, integrating and commissioning the various new and repurposed components, as well as the overall lighting control and Wi-Fi systems, as necessary.

The end user will be able to enjoy operational control of the entire lighting system as well as its functionalities from one centralized platform, greatly enhancing the conventioneers’ experience.

The project was advertised twice since the first advertising effort did not receive any contractor bids. The re-bid price is approximately 20% higher than the engineer’s estimate. Staff acknowledges that the higher bid price reflects the specialty nature of the work, the current financial bidding environment and vendor availability in the marketplace. Therefore, staff recommends that the re-bid price be accepted as reasonable and that the recommendation to award the contract be approved. This re-bid price is within the allocated funding. Liquidated damages are set for $750 per day.

Construction is scheduled to begin in the 4th Quarter of 2024 and be completed in the 1st Quarter of 2025. The CEQA determination on file for the original Betterment VII project for ACC North will cover these minor infrastructure corrections, as well as the necessary programming omitted in the original project scope. Since this project primarily serves to improve the efficiency, functionality and operational control of the existing lighting system, it offers no potential detrimental impact to the environment.

COMMUNITY WORKFORCE AGREEMENT (CWA):

Staff has determined that the work of this project is covered “Project Work”, as defined in the Community Workforce Agreement “CWA”, between the City and the Los Angeles / Orange Counties Building and Construction Trades Council, the Signatory Craft Councils and Local Unions. Therefore, all contractors are required to adhere to all applicable provisions of the CWA during the implementation and administration of this Project.

IMPACT ON BUDGET:

Sufficient funds are available in the Public Works Department’s FY 2024/25 Budget.

Respectfully submitted,
Rudy Emami
Director of Public Works
