CITY COUNCIL AGENDA REPORT
City of Anaheim

FINANCE DEPARTMENT
DATE: SEPTEMBER 24, 2024
FROM: FINANCE DEPARTMENT
SUBJECT: RESCIND ACCEPTANCE OF BID, AND ACCEPT THE

OVERALL LOWEST RESPONSIVE BID FOR NETWORK

EQUIPMENT AND MAINTENANCE
ATTACHMENT (Y/N): YES ITEM # 07
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion, rescind the acceptance of the bid made to Iron Bow Technologies, LLC (Iron Bow) at the City Council meeting of July 16, 2024 (Bid #9806); accept the bid from the overall lowest responsive bidder, ConvergeOne, Inc. (ConvergeOne); and authorize the Purchasing Agent to execute the purchase order for the purchase of Cisco network equipment and maintenance in the amount of $2,089,865.72, plus applicable tax, all in accordance with Bid #9806.

DISCUSSION:

Purchasing asked the City Council to accept the referenced bid from Iron Bow to purchase Cisco network equipment and maintenance. However, after the acceptance and award, it was discovered, and concurred by Iron Bow, that Iron Bow’s bid was non-responsive due to providing an insufficient number of years of maintenance and support as requested in the bid specifications. The next lowest bidder, ePlus Technology Inc., also concurred their bid was non-responsive due to providing an insufficient number of years of maintenance and support. Therefore, Council is requested to rescind the previous bid award by taking the requested action on this item and awarding the bid to ConvergeOne, the overall lowest responsive bidder (see Attachment 1). The net effect of the change will result in an increase of $264,961.13.

IMPACT ON BUDGET:

Sufficient funds are included in APU’s Fiscal Year 2024/25 restricted Electric Utility Fund budget, and future years will be subject to City Council approval of budget appropriations.

Respectfully submitted, Concurred by,
Kari Bouffard Dukku Lee
Purchasing Agent Public Utilities General Manger
