City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: OCTOBER 8, 2024
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: AMENDMENT NO. 4 TO COOPERATIVE AGREEMENT NO. C- 4-1714 WITH ORANGE COUNTY TRANSPORTATION

AUTHORITY FOR THE ANAHEIM CANYON METROLINK

STATION IMPROVEMENT PROJECT
ATTACHMENT (Y/N): YES ITEM # 14
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion, approve Amendment No. 4 to Cooperative Agreement No. C-4-1714 (Amendment) with Orange County Transportation Authority (OCTA) for the Anaheim Canyon Metrolink Station Improvement Project (Project) increasing the reimbursable funds to the City of Anaheim (City) by $25,950 for a total amount not to exceed $408,950; and increase the Department of Public Works revenue and expenditure budget for FY 2024/25 in the amount of $25,950.

DISCUSSION:

On November 18, 2014, City Council approved Cooperative Agreement No C-4-1714 between the City and OCTA to define roles and responsibilities for the Project. Under the agreement, OCTA was the lead agency responsible for all phases of the Project including the administration of grant funding, design, environmental clearance, construction, and to reimburse the City for all cost in providing support during the design and construction of the Project up to $173,000.

On December 3, 2019, City Council approved the First Amendment to Cooperative Agreement No. C-4-1714 between the City and OCTA to increase the reimbursable funds to the City by $100,000 for a total of $273,000, to extend the termination date to December 31, 2022, and to compensate OCTA $40,840 for construction costs to extend a casing to protect an existing City owned sewer line.

On August 9, 2022, City Council approved the Second Amendment to Cooperative Agreement No. C-4-1714 between the City and OCTA to increase the reimbursable funds to the City by $70,000 for a total not to exceed amount of $343,000, to extend the termination date to December 31, 2023, and to compensate OCTA $39,800 for construction costs to build a protective slab over a City owned water line.

On February 13, 2024, City Council approved the Third Amendment to Cooperative Agreement No. C-4-1714 between the City and OCTA to increase the reimbursable funds to the City by $40,000 for a total not to exceed amount of $383,000 and to extend the termination date to December 31, 2024.

The Project is complete and consists of a second mainline track and platform, extending the existing platform, additional shade structures, benches, another ticket vending machine, landscaping and irrigation, water quality features, a traffic signal modification and other appurtenant work. This Project benefits residents, visitors, and businesses of Anaheim by facilitating track improvements that will allow OCTA to create a more robust service for Metrolink at the Anaheim Canyon Metrolink Station and improve on-time service between the Inland Empire and Orange County. The Project makes it easier to commute to and from the Anaheim Canyon.

Due to several changes during the construction phase of the Project that needed to be reviewed, approved, permitted, and inspected by the City, the City’s efforts increased after the original agreement. Some of these changes were caused by unforeseen field conditions and others were needed due to value engineering proposals by OCTA’s contractor. The City’s additional efforts included additional City overtime inspections, police assistance, engineering and staff costs, permit fees, station benches, and review and approval of as-builts and record drawings for the Project. Therefore, this Amendment will provide for an increase in reimbursable funds to the City by $25,950 for a total of $408,950 to cover the additional City efforts incurred during and after construction.

The platform extension and second platform have been in service since January 30, 2023. The City has reviewed the Project’s Record Drawing Plans and provided comments to OCTA’s design consultant. Once all comments have been addressed and the City approves the Record Drawing Plans, the City will finish closing out all the City issued permits.

This Project supports the City’s Strategic Plan Goal F Promote Economic Development and Tourism, Strategy 3 – Continue to expand Anaheim Canyon as an innovation district and economic engine.

IMPACT ON BUDGET:

Approval of this Amendment would increase the Department of Public Works revenue and expenditure appropriations for FY 2024/25 by $25,950 in restricted transportation funds.

Respectfully submitted,
Rudy Emami
Director of Public Works
