CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: OCTOBER 29, 2024
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: JOINT PARTICIPATION AGREEMENT WITH THE CITY OF
FULLERTON FOR THE ORANGETHORPE AVENUE
REHABILITATION FROM STATE COLLEGE BOULEVARD TO
PLACENTIA AVENUE
ATTACHMENT (Y/N): YES ITEM # 14
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Motion, approve the Joint Participation Agreement (Agreement) between the City of Anaheim and City of Fullerton, in an amount not to exceed $534,624.65, for Anaheim’s pro-rata share for the design, construction, and administration of the Orangethorpe Avenue Rehabilitation from State College Boulevard to Placentia Avenue, and authorize and direct the Director of Public Works or designee, on behalf of the City of Anaheim, to execute the Agreement and any related documents, and to take any and all actions as are necessary to implement and administer the Agreement.
DISCUSSION:
The City of Fullerton (Fullerton) is constructing the Orangethorpe Avenue Rehabilitation from State College Boulevard to Placentia Avenue (Project). Since only a small portion of the Project on the southside is within the City of Anaheim (Anaheim), it will be more efficient and minimize the inconvenience to the traveling public if Fullerton rehabilitates the Anaheim portion of the roadway at the same time.
The work consists of reconstructing the asphalt concrete pavement and underlying base layer, ADA curb ramp and driveway reconstruction, signing, striping, and other miscellaneous items of work.
The entire Project cost is estimated at $4,111,124. Anaheim’s pro-rata share in the project is estimated at $534,625, or around 13% of the total cost, for the design, construction, and administration for the work within the Anaheim boundary. Anaheim will reimburse Fullerton its pro-rata share of the actual cost within 45 days of being invoiced.
This Agreement between Anaheim and Fullerton outlines the respective roles and responsibilities and stipulates that Fullerton will be the lead agency for the design, environmental, construction, and administration of the Project.
Joint Participation Agreement with the City of Fullerton for the Orangethorpe Avenue Rehabilitation from State College Boulevard to Placentia Avenue October 29, 2024
Construction is anticipated to start and be completed during the 4th Quarter of 2024.
This Project supports the City’s Strategic Plan Goal C - Invest in Infrastructure and Amenities, Strategy No. 4 – “Improve, enhance, beautify and maintain major street corridors” and Strategy No. 8 – “Invest in the expansion and maintenance of the paving program to achieve a Pavement Condition Index (PCI) of 75+/-.”
ENVIRONMENTAL DETERMINATION:
The Agreement establishes Fullerton as the Lead Agency. In accordance with the California Environmental Quality Act (CEQA) (Public Resources Code Sections 21000–21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), Fullerton, as Lead Agency is required to determine if the Project is exempt from CEQA.
Fullerton has made the determination that the Project is Categorically Exempt from CEQA pursuant to Class 1, Section 15301 (Existing Facilities) of Title 14 of the CCR, which allows for the repair, maintenance, or minor alteration of existing public or private structures, involving negligible or no expansion of use beyond that existing at the time of the Lead Agency’s determination.
IMPACT ON BUDGET:
Adequate funding is available in restricted transportation funds in the Department of Public Works’ FY 2024/25 budget.
Respectfully submitted,
Rudy Emami
Director of Public Works
