A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM RATIFYING AND APPROVING THE ACTIONS OF
THE DIRECTOR OF COMMUNITY SERVICES, OR
DESIGNEE, IN SUBMITTING AN APPLICATION FOR GRANT
FUNDS TO THE CALIFORNIA DEPARTM ENT OF PARKS
AND RECREATION FOR THE OUTDOOR RECREATION
LEGACY PARTNERSHIP GRANT PROGRAM FOR LA
PALMA PARK AND, AUTHORIZING THE ACCEPTANCE OF
SUCH GRANT ON BEHALF OF THE CITY AND AMENDING
THE BUDGET ACCORDINGLY ; AND DETERMINING THAT
THESE ACTIONS ARE EXEMPT FROM THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO
SECTION 15306 OF TITLE 14 OF THE CALIFORNIA CODE OF
REGULATIONS.
WHEREAS, the Outdoor Recreation Legacy Partnership (ORLP) program was established in 2014 and is funded through the Land and Water Conservation Fund. ORLP is a nationally competitive program targeting grant assistance to help economically disadvantaged urban communities with no, or almost no, access to publicly available, close-by, outdoor recreation (the "Grant"); and
WHEREAS, the California Department of Parks and Recreation ("Grantor") is responsible for administration of the Grant p rogram in the State, setting up necessary rules and procedures governing applications by local agencies under the Grant program; and
WHEREAS, the City of Anaheim certifies by R esolution the approval of the application and the availability of eligible matching funds prior to submission of the application to the State; and
WHEREAS, in April 2024, a grant application was submitted to Gran tor in the amount of $6,000,000.00 for the proposed La Palma Park Project (the "Project"); and
WHEREAS, the City is familiar with the terms, conditions and limitations of any such Grant; and
WHEREAS, the City desires to accept such Grant awarded to the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows:
2 1. Approves and ratifies the actions of the Dire ctor of Community Services, or designee, in filing of an application to the California Department of Parks and Recreation for the Grant.
2. The City hereby ratifies actions taken by and approves actions to be taken on behalf of the City, by the Director of C ommunity Services (“Director”) or designee, and the Director is hereby authorized and directed to conduct all negotiations, and sign and submit all documents, including, but not limited to applications, agreements, amendments, and payment requests, which may be necessary in connection with the completion of the Project and of the said Grant.
3. Agrees to comply with all applicable federal, state and local laws, ordinances, rules, regulations and guidelines.
4. Agrees to, and by this R esolution, does accept any such Grant so awarded to the City of Anaheim without further action of the City Council being required.
5. The City of Anaheim hereby agrees to comply with each and all of the terms, conditions and limitations imposed by the Grantor upon said Grant.
6. The receipt of the Grant is exempt from CEQA under guideline section 15306, which pertains to information gathering purposes leading to an action that a public agency has not yet approved, adopted or funded.
7. Contingent upon the award of said Grant, the annual budget of the City of Anaheim is hereby amended by increasing revenue and expenditures in an amount equal to the amount of the Grant Funds awarded.
