City of Anaheim
PUBLIC UTILITIES DEPARTMENT
DATE: NOVEMBER 19, 2024
FROM: PUBLIC UTILITIES DEPARTMENT
SUBJECT: AGREEMENT WITH WECK LABORATORIES, INC. FOR
WATER AND ENVIRONMENTAL LABORATORY TESTING,
ANALYSIS, AND REPORTING SERVICES
ATTACHMENT (Y/N): YES ITEM # 11
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Motion:
1. Approve an agreement with Weck Laboratories, Inc. (Weck) for water and environmental laboratory testing, analysis, and reporting services (Agreement), for an initial term of two years with up to four one-year optional renewals, at a not-to-exceed cost of $400,000 with a 15% contingency for as-needed extra services; and,
2. Authorize the Public Utilities General Manager, or designees, on behalf of the City of Anaheim (City), to execute the Agreement and any related documents, including any cost-neutral amendments of the Agreement and any documents contemplated by the Agreement, and to take such necessary or advisable actions to implement, fund, and administer the Agreement.
DISCUSSION:
At its meeting on October 23, 2024, the Public Utilities Board recommended that the City Council approve the Agreement with Weck Laboratories, Inc.
The City is responsible for water quality and environmental tests, analyses, and reports that are necessary to protect the public’s health and maintain state and federal regulatory compliance. Anaheim Public Utilities (APU) performs the majority of required water quality testing through its state-certified laboratory. However, since certain types of samples require specialized equipment that is costly to purchase and maintain, APU utilizes a qualified firm to perform approximately 2% of its water quality testing in a typical year.
Agreement with Weck Laboratories, Inc. for Water and Environmental Laboratory Testing, Analysis, and Reporting Services November 19, 2024
On July 2, 2024, APU issued a Request for Proposals (RFP) to provide water quality and environmental laboratory testing, analysis, and reporting services. Four respondents submitted proposals, and were ranked by staff as follows:
Respondent Rank
Weck Laboratories, Inc. 1
Eurofins Eaton Analytical, LLC 2
Enthalpy Analytical, LLC 3
BSK Associates, Inc. 4
The review process followed Council Policy 4.1 – Selection of Professional Consultants, and proposals were evaluated for the firms’ ability to perform the scope of work, qualifications that meet state certification requirements, record of success, methods employed, and reasonableness of costs for types of tests performed. Weck Laboratories, Inc. (Weck) is recommended as the highest rated respondent based on their qualifications and cost proposal. Weck is based in the City of Industry, California, and has over 60 years of experience providing similar services to other public agencies, including the Los Angeles Department of Water and Power, Metropolitan Water District of Southern California, Water Replenishment District, the West Basin Municipal Water District, and currently performs testing services for APU.
The Agreement is for a two-year initial term with the option of up to four one-year renewals. After the initial term, the provider has the option to request annual price adjustments based on changes in the Consumer Price Index (CPI); price increases cannot exceed 5% of the previous year's fee without written approval. The Agreement has a not- to-exceed cost of $400,000 for the initial term and extensions, plus a 15% contingency for as-needed extra services.
IMPACT ON BUDGET:
Sufficient funds are included in APU’s Fiscal Year 2024/25 restricted Water Utility Fund budget, and future years will be subject to City Council’s approval of budget appropriations.
Respectfully submitted,
Dukku Lee
Public Utilities General Manager
