CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: NOVEMBER 19, 2024
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: ACCEPTANCE OF A DONATION OF REAL PROPERTY UNTO
THE CITY OF ANAHEIM
ATTACHMENT (Y/N): YES ITEM # 15
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Resolution, accept a donation of real property consisting of approximately 890 square feet of vacant land unto the City of Anaheim and authorize the City Clerk to cause City Deed No. 12837 to be recorded in the Office of the County Recorders of Orange County.
That the City Council, by Motion, approve a Donation Agreement with Pamela Bobit, as Trustee of the Pamela A. Bobit Living Trust under Trust Instrument dated 01/01/1994, for the donation of real property, free of restrictions or conditions, to incorporate to adjacent City-owned land and authorize the Director of Public Works, or designee, to execute the Donation Agreement on behalf of the City and to take the necessary actions to implement and administer the Donation Agreement.
DISCUSSION:
The property owner (Mrs. Pamela Bobit) desires to donate their real property (Property) to the City of Anaheim (City) free of restrictions or conditions. The Property comprises approximately 890 square feet of vacant land and is identified as Lot A of Tract 8873, APN: 356-192-01. It borders City-owned land that is currently used as a riding and hiking trail. The acceptance of the donated Property will enable the City to own and maintain a wider trail access point from Rio Grande Drive. Upon being contacted by the land-owner, staff conducted a survey to confirm the Property's boundary, obtained a preliminary title report to identify any encumbrance, and determined that it would be in the City's best interest to accept the generous donation and own the Property in fee. The donation and acceptance of the Property will allow the City to pursue a use compatible with the abutting City-owned property and will ultimately benefit Anaheim's residents.
The recommendation is in accordance with Administrative Regulation No. 330, which requires formal City Council acceptance for donations of property.
IMPACT ON BUDGET:
There is no budgetary impact.
