In accordance with your request, STC GardenWalk, LLC, as the successor-in-interest to Anaheim Capital Partners of the ownership of Anaheim GardenWalk, requests an annual review of Development Agreement No. 99-01. As you are aware, the Development Agreement, since its original approval, has been assigned to three separate parties, with STC GardenWalk LLC being responsible for obligations related to the retail and parking structure components. STC GardenWalk, is a Lifestyle Retail and Entertainment Complex initially approved by the Anaheim City Council in June 1999. The retail portion and associated parking structure completed construction in 2008, thus fulfilling the obligations under the Development Agreement, which strictly related to timing of project completion.
From the Annual Review on November 20, 2018, STC GardenWalk, LLC acquired interest and ownership of Anaheim GardenWalk from Anaheim Capital Partners on December 21, 2018. Since the last Annual Review in November 2023, and from the time of acquisition to the present, various retail, dining, and entertainment uses as previously approved by the Anaheim Planning and Building Department were established to proceed with tenancy at STC GardenWalk. Such tenancy continues to proceed in accordance with the appropriate permitting and construction approvals imposed by the City of Anaheim, most notably: construction completion of an additional public restroom on the 'Sky Level' (top floor), construction completion of the Artist Row food court section (an adjacent Beer Garden section currently on-going construction), grand re-opening of UFC Gym, construction commencement of Paris Baguette and OdysseyVR, and construction processes continuing for Boiling Point, Jin Tea, and Meet Fresh (Taiwanese Dessert). As described above and previously confirmed in the 2023 Annual Review, construction of the retail building portion has been completed and STC GardenWalk has further no obligations under the Development Agreement.
