CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: DECEMBER 17, 2024
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: AGREEMENT WITH PARKVIEW HEALTHCARE CENTER
OPERATING REAL ESTATE COMPANY, LLC FOR A GRANT OF
EASEMENT AT 1514 EAST LINCOLN AVENUE FOR THE
LINCOLN AVENUE WIDENING PROJECT FROM EAST STREET
TO EVERGREEN STREET (R/W ACQ 2016-00785)
ATTACHMENT (Y/N): YES ITEM # 20
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Motion, approve the Agreement for Grant of Easement with Parkview Healthcare Center Real Estate Operating Company, LLC, for a Street and Public Utility Easement and Right of Entry, in exchange for additional on-site work to rehabilitate the front parking lot, parking stalls, and relocate an existing fire line backflow assembly device, for the property located at 1514 East Lincoln Avenue for the Lincoln Avenue Widening Project from East Street to Evergreen Street (Project).
DISCUSSION:
The Department of Public Works is acquiring right-of-way along Lincoln Avenue for the Project, specifically a Street and Public Utility Easement at 1514 East Lincoln Avenue (Property).
Lincoln Avenue is designated as a major arterial on the City’s Planned Roadway Network and the County’s Master Plan of Arterial Highways (MPAH). This Project will widen Lincoln Avenue from an existing four lanes to a six-lane divided facility within the Project limits, as designated by both planning documents. The widening of Lincoln Avenue will increase the safety for pedestrians and motorists by minimizing conflicting left-turn movements from existing driveways and side streets, reduce traffic congestion, and provide an enhanced landscaped parkway for the community. New street enhancements will include the installation of curb and gutter, driveways, sidewalk, curb ramps, bus pads, pavement, streetlights, traffic signal modifications, signing, striping, the relocation of existing facilities, raised landscaped median islands and parkway trees, and drainage system improvements.
Parkview Healthcare Center Real Estate Operating Company, LLC, has agreed to grant the Street and Public Utility Easement at 1514 East Lincoln Avenue at no cost in exchange for additional on-site work at the 1514 East Lincoln Avenue property. The City has agreed to rehabilitate the front parking lot and restripe the parking stalls. Additionally, as part of the acquisition agreement, the Project will relocate an existing fire line backflow Agreement for Grant of Easement at 1514 East Lincoln Avenue for the Lincoln Avenue Widening Project from East Street to Evergreen Street (R/W ACQ 2016-00785)

assembly device from an underground vault located in the public right of way that services the property to a location next to the existing building.
The estimated value of the on-site work to be done as part of the project is $54,600. The value of the Street and Public Utility Easement is estimated at $46,000 based on the property appraisal from 2020. The property owner has agreed to not update the appraisal value of the Street and Public Utility Easement to higher current market prices. Additionally, the property owner did not request up to $5,000 in reimbursement for an independent appraisal as allowed for in SB 1210, which therefore could be included in the consideration for the easement. The Street and Public Utility Easement at 1514 East Lincoln Avenue will allow the City to build the standard street sidewalk width of 10-ft along the property and place the required fire line backflow assembly device above ground on their property, outside the public right of way. The agreed upon exchange of the value of the easement and on-site work at no cost is based on negotiations with the property owner resulting in an administrative settlement as being reasonable, prudent, and in the public interest.
The Project started construction in the 3rd Quarter of 2024 and is estimated to be completed in the 3rd Quarter of 2025.
This Project supports Anaheim’s Strategic Plan Goal C - Invest in Infrastructure and Amenities, Strategy No. 4 – “Improve, enhance, beautify and maintain major street corridors” and Strategy No. 8 – “Invest in the expansion and maintenance of the paving program to achieve a Pavement Condition Index (PCI) of 75+/-.”
IMPACT ON BUDGET:
Adequate funding for this Agreement is available in restricted transportation funds as part of the Department of Public Works Department’s FY 2024/25 budget.
Respectfully submitted,
Rudy Emami
Director of Public Works
