CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: DECEMBER 17, 2024
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: AWARD OF CONTRACT TO CROSSTOWN ELECTRICAL &
DATA, INC. FOR TRAFFIC SIGNAL MODIFICATION PROJECT

AT BALL ROAD AND DISNEYLAND DRIVE
ATTACHMENT (Y/N): YES ITEM # 17
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion, award the contract to the lowest responsible bidder, Crosstown Electrical & Data, Inc., of Irwindale, California, and Contractor’s License No. 756309, Classification C-10 and A, in the amount of $478,987 plus a 10% contingency for the traffic signal modifications at the Ball Road and Disneyland Drive intersection (Project); and authorize the Director of Public Works, on behalf of the City, to execute the Contract and any other related documents, and to take such actions as are necessary to implement and administer the contract; direct and authorize the Finance Director to execute the Escrow Agreement pertaining to contract retentions; and determine the Project is categorically exempt from the California Environmental Quality Act pursuant to Class 1, Section 15301(c) (Existing Facilities) and Class 2, Section 15302 (Replacement or Reconstruction) of Title 14 of the California Code of Regulations.

DISCUSSION:

The Anaheim Tourism Improvement District (ATID) Transportation Committee allocated funding for the City to implement traffic signal modifications at the intersection of Ball Rd. and Disneyland Dr. The intent of the project is to allow the City to modify the traffic signal operations to safely address traffic delays and vehicle queuing at the intersection during peak periods by installing changeable lane designation blank-out signs at the intersection and along the north and south approaches to the intersection.

The City of Anaheim advertised for bids to construct on August 8, 2024. The bid due date was September 5, 2024. Elecnor Belco Electric, Inc., subsequently withdrew their bid due to a calculating error in their estimating software that resulted in a lower than intended bid.

The City has already furnished long-lead items for the project. Cost for which total $341,229.67.

The City received 10 bids summarized as follows:

1. Elecnor Belco Electric, Inc., Chino, CA (WITHDREW BID) .......................$ 330,888.00

2. Crosstown Electrical & Data, Inc., Irwindale, CA ...........................................$ 478,987.00

3. Alfaro Communications Construction, Inc., Compton, CA..............................$ 483,113.47 Award of contract for traffic signal modification project at Ball Road and Disneyland Drive December 17, 2024

The bid price competitively falls above the engineer’s estimate of $705,650, which reflects the current bidding environment, appears to be reasonable, and is within the available funding. Liquidated damages for this project will be $1,650 per day. Construction is scheduled for the 1st Quarter of 2025. Construction is estimated to be completed within 30 working days.

ENVIRONMENTAL DETERMINATION:

Upon review of the California Code of Regulations (CCR), staff recommends the City Council determine that the Project is Categorically Exempt from CEQA pursuant to Class 1, Section 15301 (Existing Facilities) and Class 2, Section 15302 (Replacement or Reconstruction) and will not cause a significant effect on the environment. Section 15301(c) allows for the repair, maintenance, or minor alteration of existing public or private structures, involving negligible or no expansion of use beyond that existing at the time of the Lead Agency‘s determination. Section 15302 allows for the replacement or reconstruction of existing structures (traffic signal) and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.

Pursuant to 15301 and 15302 of Title 14 of the California Code of Regulations, there are no unusual circumstances in respect to the proposed project for which staff would anticipate a significant effect on the environment.

After determining that this Project is Categorically Exempt from CEQA, the City will file a Notice of Exemption with the County Clerk, which starts a 35-day statute of limitations for challenges of the decision.

COMMUNITY WORKFORCE AGREEMENT (CWA):

Bids closed for this project prior to City Council adopting the new Community Workforce Agreement. As such, it was bid based using the previous agreement requirements.

This project is not a covered “Project Work” as defined in the Community Workforce Agreement dated December 3, 2019 with the Los Angeles / Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions. The size and scope of this project does not meet the definition of “Project Work” as defined in the CWA; therefore this project is exempt.
