CITY COUNCIL AGENDA REPORT
City of Anaheim
ECONOMIC DEVELOPMENT DEPARTMENT
DATE: DECEMBER 17, 2024
FROM: ECONOMIC DEVELOPMENT DEPARTMENT
SUBJECT: DECLARING CERTAIN PROPERTIES LOCATED ALONG THE
EAST SIDE OF MANCHESTER AVENUE BETWEEN LINCOLN
AVENUE AND WEST BROADWAY AS SURPLUS LAND IN
ACCORDANCE WITH THE SURPLUS LAND ACT
ATTACHMENT (Y/N): YES ITEM # 23
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council:
1. By Resolution, declare the real property located along the east side of Manchester Avenue, between West Lincoln Avenue and West Broadway (APN 250-131-07 and APNs 250-132-07, -09, -10, -15) as surplus land pursuant to the Surplus Land Act, Government Code Section 54220, et seq, as amended by Assembly Bill 1486 (SLA);
2. By Motion, authorize the Director of Economic Development, or his designee, to issue a Notice of Availability (NOA) in accordance with the SLA; and
3. By Motion, authorize the Director of Economic Development to review each Notice of Interest (NOI) received, if any, during the 60-day NOA period and enter into negotiations with responsive bidder(s) for a period of 90 days, all in accordance with the SLA.
DISCUSSION:
Effective January 1, 2020, Assembly Bill 1486 amended the State Surplus Land Act (SLA) to require local agencies to formally declare publicly-owned property no longer used for the agency’s expressed purpose as “surplus land” or “exempt surplus land” as part of the property disposition process.
Attachment No. 2 identifies real properties located along North Manchester Avenue that the Economic Development Department recommends to be declared as surplus under the SLA. The properties are considered “surplus land” because they do not fall under any of the following exempt categories:
Declaring Certain Properties Located along the East Side of Manchester Avenue between Lincoln Avenue and West Broadway as Surplus Land in Accordance with the Surplus Land Act
December 17, 2024
A. Land that is less than one-half acre in area and is not contiguous to land owned by a state or local agency that is used for open-space or low- and moderate- income housing purposes;
B. Land that a local agency is exchanging for another property, or easements, necessary for the agency’s use;
C. Land that a local agency is transferring to another local, state, or federal agency, or to a third-party intermediary for future dedication for the receiving agency’s use; or
D. Land that is a former street, right of way, or easement, and is conveyed to an owner of an adjacent property.
Following the City Council’s declaration of the subject “surplus” property, the City of Anaheim (City) must issue a 60-day NOA to solicit the interest of various public and private entities, including housing sponsors, for the development of affordable housing (and parks and open space, as applicable). The NOA is sent to housing sponsors that have notified the Housing and Community Development Department of their interest in development of low and moderate-income housing on surplus land. The housing sponsors must submit a complete and responsive NOI in writing within the 60 day NOA period. The City will evaluate the NOIs and may negotiate with the entity(ies) that submit proper NOIs, including negotiation about the price and terms for the disposition and scope of development for the respective properties. In the event no agreement is reached between the City and the public or private entity(ies) after a good faith negotiation period of 90 days, the land may be disposed of without further regard to the SLA, subject to an affordability covenant recorded against the property mandating that if 10 or more residential units are developed on the property, not less than 15 percent of the total number of residential units shall be sold or rented as affordable housing.
ENVIRONMENTAL DETERMINATION:
The City Council finds and determines that this action results in no binding commitment by the City to authorize or advance the disposition of any of the Surplus Properties; will not result in a direct or indirect physical change in the environment; and does not constitute an “approval” of a “project” pursuant to CEQA Guidelines Sections 15004 and 15352.
IMPACT ON BUDGET:
Sufficient funds for compliance with the Surplus Land Act are available in the Economic Development Department’s Fiscal Year 2024/25 budget.
Respectfully Submitted,
Sergio M. Ramirez
Director of Economic Development
