HOUSING AUTHORITY AGENDA REPORT
City of Anaheim
HOUSING & COMMUNITY DEVELOPMENT
DEPARTMENT
DATE: DECEMBER 17, 2024
FROM: HOUSING & COMMUNITY DEVELOPMENT DEPARTMENT
SUBJECT: APPROVAL OF SECOND AMENDMENT TO PROFESSIONAL
SERVICES AGREEMENT WITH OVERLAND, PACIFIC &
CUTLER, LLC
ATTACHMENT (Y/N): YES ITEM # 03
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the Governing Board of the Anaheim Housing Authority, by Motion, approve a Second Amendment to the Professional Services Agreement by and between the Anaheim Housing Authority and Overland, Pacific & Cutler, LLC, for on-call professional services to provide relocation guidance and assistance to eligible parties impacted by development activities, by extending the term for one-year, January 1, 2025 to December 31, 2025, and increasing the contract authority from $200,000 to $350,000; and authorize the Executive Director, or her designee, to execute and administer the Agreement on behalf of the Anaheim Housing Authority.
DISCUSSION:
The Anaheim Housing Authority’s (Authority) primary mission is to increase access to affordable housing for low-income households in Anaheim. To achieve this, the Authority employs strategies such as acquiring opportunity sites and, when necessary, assembling parcels to create viable development opportunities. In some cases, acquisitions may require the relocation of persons residing at these properties. The Authority recently acquired motels in West Anaheim that have long-term occupants.
Under Federal and State regulations, individuals displaced by properties acquired, rehabilitated, or demolished with Federal or State funds are eligible for relocation benefits. Displaced persons must undergo a thorough interview process to determine eligibility and relocation needs before filing a claim with the Authority. This eligibility review is conducted by on-call relocation services consultants.
In January 2023, the Authority requested approval for a new Professional Services Agreement (Original Agreement) for one year, from January 10, 2023, to December 31, 2023, with a not-to-exceed amount of $100,000, to ensure the uninterrupted implementation of relocation services in support of the ongoing projects and potential new acquisitions.
Second Amendment to PSA with Overland, Pacific & Cutler, LLC December 17, 2024
On January 10, 2023, the Authority implemented the Original Agreement. However, at the end of the Original Agreement term on December 31, 2023, OPC remained engaged in providing ongoing relocation services at properties. Consequently, staff sought approval for a First Amendment to the Professional Services Agreement (First Amendment), which proposed a one-year extension, from January 1, 2024, to December 31, 2024, and an increase in contract authority from $100,000 to a maximum of $200,000, ensuring continuous relocation services for the listed projects.
Although the First Amendment term concludes on December 31, 2024, OPC is actively providing relocation services for the recently acquired Rainbow Inn, Kettle Motor Motel, and the upcoming Crown Motel acquisitions. Given the ongoing relocation efforts for these projects, the Authority is requesting a Second Amendment to extend the Original Agreement. This second one-year extension would run from January 1, 2025, to December 31, 2025, ensuring the continuation of relocation services at these properties.
The Authority is also requesting an increase in contract authority of $150,000, raising the total from $200,000 to a not-to-exceed amount of $350,000 to support ongoing relocation needs.
Staff anticipates completing the relocation services for the recently acquired projects to conclude during the one-year extension to the Second Amendment with OPC.
Consequently, staff intends to solicit Statements of Qualifications (SOQs) in 2025 to identify the best-qualified firm to provide the department with future relocation services.
IMPACT ON BUDGET:
There is sufficient budget available in the Housing & Community Development Department’s Fiscal Year 2024/25 budget to cover these expenses.
Respectfully submitted,
Grace Ruiz-Stepter
Executive Director of
Anaheim Housing Authority
