RE: Crescent, Broadview, & Victor ia Sanitary Sewer Improvement Project
RCP#2024-22274

Account No. 592-412-I805-7809, 211-412-I805-7809

ADDENDUM NO. 1

The following are changes to the contract documents and special provisions for the above referenced project:

THE PROPOSAL DUE DATE IS THURSDAY, October 24
th, 2024 AT
2:00 P.M.

1. RFP: Proposal due date on RFP page 2

 Proposal due date on RFP page 2 has been modified to reflect the accurate due date of October 24th, 2024, at 2:00pm.

2. RFP: Language modified

 Page 17 of the RFP clarifies which forms should be included and excluded from the 20-page limit of the proposal.

3. Q&A:
 Received 09/26/2024: Will the City or th e GC be awarding the geotechnical engineering, testin g and inspections potion of this project?

 RESPONSE: The City will not be awarding a portion of this project. The City’s inte nt is to contract the entire project to a single firm as st ated in the RFP language for this project under PROPOSAL TERMS AND
CONDITIONS Section II.D. “The City intends to contract

Page 2 of 5 ends

with a single firm PER EACH PROJECT and not with
multiple firms doing business as a joint venture."

 Received 09/28/2024: Can we submit a proposal for ONLY the geotechnical engineering portion of the scope of work? (Our firm is pre-qualified with the City of Anaheim to provide these services).

 RESPONSE: No. Per language in this RFP under PROPOSAL TERMS AND CONDITIONS Section II.D. “The City intends to contract with a single firm PER EACH PROJECT an d not with multiple firms doing business as a joint venture.”, theref ore a bid of only a portion of this project does not fit the City’s intent.

 Received 10/04/2024: Could you please confirm the due date for the fee proposal? The RFP shows a due date of 10/31, but PlanetBids shows a due date of 10/24. Thank you.

 RESPONSE: The proposal due date is October 24, 2024 @ 2:00pm as stated on Page 1 of this RFP. A forthcoming addendum will address the discrepancy noted on page 2 of this RFP.

 Received 10/08/2024:  We are requesting the As-Builts for the project area. Can those be made available?

 RESPONSE: Submit and Official Reco rds Request with Anaheim Public Works and Anaheim Public Utilities.

 Received 10/09/2024: Will Anaheim utilize any state or federal funds for the project?

 RESPONSE: No state or federal funds will be utilized by the City for this project.

 Received 10/10/2024: There is a discrepancy between the RFP and the contract regarding liquidated damages provisions for the Consultant . Can you provide clarification on the discrepancy?

 RESPONSE: The liquidated damages ($150/day) in the RFP applies to the Design Consultant to ensure that the schedules are met. The

Page 3 of 5 ends

liquidated damages in the Exhibits st ates "Contractor shall pay to the City, or have withheld from monies due it, the sum of $1,000." is for the Contractor (construction) and so th is does not apply to the Design Consultant. The Exhibit aims to guide the Design Consultant on the necessary level of effort during the project's design phase, hence the title "Instructions for Spec Preparer." The guidelines in this exhibit will assist the Design Consultant in accurately recalculating the liquidated damages to be included in the contract documents.

 Received 10/10/2024: Does the City anticipate the project would require NEPA or Mitigated Negative Declaration (MND) per Section V, Item 16, or would it likely be sufficiently covered by a Ca tegorical Exemption (Cat Ex) with supporting technical analyses?

 RESPONSE: The City is funding this project with city funds, so CEQA, not NEPA applies. Additionally, the City believes it will be considered a categorical exemption, therefore eliminating the need for any technical analysis.

 Received 10/10/2024: How recent are the City CCTV videos indicated in Section V, Item 8,? Do the CCTV videos also include Broadway Street and Brookhurst Street sewers?

 RESPONSE: The CCTV is from May 2020. The CCTV does include Brookhurst street sewers, but not Broadway Street.

 Received 10/11/2024:

1. Can you please confirm the following dates and information related to this pursuit:
•Deadline for Requests for Information: Thursday , October 17th, 2024 @ 2:00 PM.
•Proposal Due Date: Thursday, Oc tober 24, 2024 @ 2:00 PM via PlanetBids.
•Fee Proposal: No later than 2:00 PM (PST) October 31st, 2024 via mail, hand delivery, or sent by courier.

2. Is CCTV available for the segments shown in exhibit A?

3. Page 18 of the RFP mentions that th e cover letter must be wet signed.

Can you confirm that the cover letter needs to be wet signed even with the format of submittal being electronic?

Page 4 of 5 ends

4. The RFP mentions that the “Designa tion of Sub-Contractors Form” is excluded from the max 20 page count. Are all forms excluded from the page count requirements (e.g., Exhibits E, F and I)?

 RESPONSE: The proposal due date is October 24, 2024 @ 2:00pm as stated on Page 1 of this RFP.

1. Deadline for Requests for Info rmation: Thursday, October 17th, 2024 @ 2:00 PM.

2. Fee proposal shall ONLY be sent via mail, hand delivered, or sent by courier no later than 2:00 PM (PST) October 24th, 2024

3. CCTV is not available for all se gments, only portions of the segments shown Exhibit A.

4. All other exhibits (if not listed as included) are excluded from the 20 pages maximum.

 Received 10/15/2024: Is construction part of the 18-month schedule for this project? Or does the 18-month schedule end at completion of the bid documents?

 RESPONSE: The 18-month schedule is solely for completing the design phase and does not include the bid period. All submittal reviews at various milestones, as well as all design-related tasks, must be allocated within this 18-month schedule. Given the urgency, a shorter schedule would be beneficial, provided that quality and safety are not compromised. This addendum has addressed the discrepancies noted in the RFP.

THE PROPOSAL DUE DATE IS THURSDAY, October 24
th, 2024 AT 2:00
P.M.

Sincerely,

Yvonne Dake-Okewole
Project Manager

The provisions of the Agreement shall apply to all subconsultants in the same manner as the Consultant.

E. TIME OF PERFORMANCE:

1. The City and Consultant recogni ze that time is of the essence as to this project and that City may suffer damages which are difficult to determine and accurately specify, such as lost grant funds, additional c ontract administration expenses , if the Services are not completed within the time specified in the approved Project Schedule. Consultant and City agree to liquidate damages with respect to Consul tant's failure to achieve completion of the Services within the times provided in t he Project Schedule. Consultant acknowledges and agrees that the liquidated damages are intended to co mpensate City solely for Consultant’s failure to meet the deadline for completion and shall not excuse Consultant Crescent, Broadview, & Victoria

from liability from any ot her breach, including any failure of any of the work to conform to any requirements provided by local, state or federal laws, rules and regulations.

2. In the event that Consultant fails to achiev e completion of the work within the time frame designated in the Project Schedule, Consultant agrees to pay City the following: $ 150 per day for each calendar day that completion of the work is delayed.

3. Consultant acknowledges and agrees that the foregoing liquida ted damages have been set based on an evaluation by City of damages that it will incu r in the event of the late completion of the work per the Project Sc hedule and Scope of Serv ices. Consultant and City agree that because of the nature of the Project it w ould be impractical or extremely difficult to fix the amount of actual damages incurred by City due to a delay in completion of the work. Accordingly, City and Consult ant have agreed to such liquidated damages to fix Consultant’s costs and to avoid later disputes. It is understood and agreed by Consultant that any liquidated damages pay able pursuant to this Agreem ent are not a penalty and represent a fair and reasonable estimate of compensation for losses to be incurred under the circumstances existing as of the effective date of this Agreement.

4. It is further mutually agr eed that City shall have the right to deduct liquidated damages against progress payments. In the event t he remaining unpaid Contract Amount is insufficient to cover the full amount of li quidated damages, Consultant shall pay the difference to City.

5. Permitting or requiring Consultant to continue and finish the Services or work, or any part thereof, after the deadline for completion shall not act as a waiver of City’s right to receive liquidated damages hereunder or any rights or remedies otherwise available to City.

6. The time period(s) specified for performance of the Services rendered pursuant to this Agreement shall be extended because of any delays due to unforeseeable causes beyond the control and without the fault or negligence of Consultan t, including, but not restricted to, acts of God or of the public enemy, unusually severe weather, fires, earthquakes, floods, pestilence, and other natural catastrophes, epidemics, quarantine restrictions, riots, strikes, freight embargoes, wars, litigation, civil disturbance or disobedience, sabotage, restraint by court order or public authority and action or non-action by or inability to obtain the necessary authorization or approv als from any governmental ag ency or authority, and/or acts of any governmental agency, including City, which by th e exercise of due diligence such Party could not reasonably have been expec ted to avoid and which by exercise of due diligence has been unable to overcome, if Consultant shall within ten (10) days of the commencement of such delay notify the City’s Project Manager in writing of the causes of the delay. The City’s Project Manager shall ascertain the facts and the extent of delay and may extend the time for performing the Services for the period of the enforced delay if, in the judgment of the City’s Proj ect Manager, such delay is ju stified. The City’s Project Manager's determination shall be final and conclusive upon the Parties to this Agreement.

In the event of delay, however caused, Consultant's sole remedy shall be an extension of this Agreement pursuant to th is Section and Consultant sha ll not be entitled to recover damages against City.

Sanitary Sewer Improvement Project

Page 10 ends

The project involves approximately 15,000 linear feet of piping, ranging from 8 inches to 12 inches (not including laterals). It cove rs the southern parts of Muller S t. and Crescent Way, sections of Lincoln Ave between Muller and Crescent, as well as Broadview St., Victoria St., Agate St., Empire St., Archer St., and Broadway. There is also a short segment on Penhall Way. The pipeline on Victoria St. is divided into four sections with vary ing flow directions. Each section discharges into separate pipes on Broadview St., Agate St., Empire St., and Archer St. The flows continue into siphons downstream of these streets, with each siphon discharging into Broadway.

V. GENERAL PROJECT REQUIREMENTS AND SCOPE OF WORK

The Proposal should reflect a thorough understanding of the City’s values and vision. Incorporating all the necessary guidelines, policies and requirements, all collectively complying with the West Anaheim Master Plan of Sanitary Sewers (WAMPSS) and related City of Anaheim Design Standards and Specifications.

All available related master plans of sanitary se wers are available in t he City’s website under the following link:
http://www.anaheim.net/583/Storm-Drainage-Sanitary-Sewer-Master-Plan

Exhibits A, B, C, D, E, F, G, H , I and J are included for reference.

The following is a general descrip tion of the anticipated services, project components, and tasks.

Relative to the project’s completion schedule (Secti on VI), Consultants are expected to submit a detailed work plan/approach, including schedule and specific work tasks, through the RFP submittal.

The selected Consultant will also be required to submit a final work plan to the City for approval prior to execution of a notice to proceed for the project.

The items of work presented should not be considered exhaustive. Consultants should expand the scope of work based on their experience and knowledge as they see appropriate and include these efforts as optional services.

Proposed services shall include, but are not limited to the following items:

1. The design may include siphons, jacking, bori ng, casing the sewer line, and sewer pipe bedding calculations as needed. Hydraul ic calculations for the exis ting and build-out sewer flows shall be included and substantiated by calculations.

2. Perform all necessary research to establish the precise location of all utilities based on the most recent available records.

3. The design may include siphons, jacking, bori ng, casing the sewer line, and sewer pipe bedding calculations if needed.

4. Perform all necessary research and send out reques ts to all utilities even when they have no franchise, and outside agencies to establish the precise location of all utilities based on the latest available records. Consultant shall keep a matrix of all Utility Companies contacted and their responses, including date and time. Perform potholing as necessary to determine feasibility of proposed solutions. Potholing should be surveyed by city forces; consultant shall be responsible Crescent, Broadview, & Victoria
Sanitary Sewer Improvement Project

Page 11 ends

to coordinate. Submit a potholing report detailing the utilities found and not found and their 3- dimensional location. This report shall include all useful details such as pipe size, material, encasements, etc…

5. Develop all preliminary feasible alternativ e alignments and diversions from or into the selected sanitary sewer improvement. The alternatives should be evaluated further to determine their feasibility. All improvements are designed to address the recommended build-out sewer needs with the preferred design capacity. Current City capacity criteria of max d/D are 0.67 for pipes with diameters < 12” and 0.75 for pipes with diameters > 12”. The preferred City design capacity of max d/D are 0.5 for pipes with diameters < 12” and 0.6 for pipes with diameters > 12” if possible.

6. Provide field topographical survey work as required to identify the existing facilities like median islands, curb & gutter, sidewalk, right of way, water, sewer, street light/pull box, etc. The survey work shall comply with the City survey requirements listed in Exhibit B.

7. Provide Preliminar y Design Report (PDR):

a. Evaluate various construction methods (i.e. trenchless, open cut, pi pe bursting, etc.) and potential alignments.

b. Conduct a hydraulic analysis of the current piping system’s flow characteristics to evaluate alternatives and recommend the most efficient operational strategy. This analysis will explore options such as eliminating all four siphons and rerouting flows from Victoria to Brookhurst.

Since laterals are connected to the pipes le ading to the siphons, the analysis involving the options to eliminate the siphons will take into account the lateral flows being conveyed to Victoria.

c. Present a matrix of the different alternat ives in order of pref erence including cost comparisons of the different alternatives based on the current economic environment.

d. Recommend a preferred method and alignment.

e. The selected Consultant may be asked as an optional service to provide flow monitoring task.

All alternative alignments must be substantiated using flow monitoring (for at least 14 consecutive days) to determine the actual ex isting flow condition. The Consultant will determine hydraulically suitable locations to install flow monitors, calibrate and maintain the flow monitors, collect flow data, and prepare a comprehensive report about the findings.

Propose a “not-to-exceed” dollar amount.

All related design requirements needed for the preferred method and alignment shall be completely performed to warrant the feasibility of the recomm endation(s) made, including but not limited to redesigning/relocating conflicting utilities/facilities, etc.

8. The consultant will review the closed-circuit television (CCTV) videos provided by the City and generate a comprehensive condition assessment report of the pipes. This report will include, Crescent, Broadview, & Victoria
Sanitary Sewer Improvement Project

Page 12 ends

but is not limited to, an overall summary of the pipe conditions, photos highlighting the locations of lateral connections, and identification of defects such as cracks and blockages, along with an assessment of their severity

9. No potholing to be done prior to 50% submittal of plans and specifications. Consultant shall utilize the services of Dig Alert to notify utility companies to mark locations of their underground utilities. Consultant to ensure all companies have marked their utilities. At PDR, Consultant to provide pothole services for all utility crossings and potential conflicts with other projects. At the 50% submittal of plans and specifications, potholing will be required to locate active and abandoned utilities within the project site. Potholes shall also identify the existing pavement structural section (thickness of asphalt concrete, Portland cement concrete, asphalt base, base materials, native, etc.). Potholing shall adhere to the City and other agencies permit requirements and per Item G of the General Information section VII, Page 14, inclusive of this RFP. The City shall issue a permit for work within the City’s Right-of-Way and the fee will be borne by the project at no additional cost to consultant. Note: All potholes in roadway shall include final restoration adhering to City’s Standards with hot-mix asphalt. The cost for hot-mix shall be included in the proposed fee for potholing. All work within the City Right of Way are subject to permit application and requirements. All USA marks shall be removed by the consultant at the end of potholing work. The cost of USA removal shall be included in the proposed price for potholing. Pothole permitting shall prepare and acquire approved plans showing pothole locations, duly dimensioned, referencing from known visible features. Traffic control plans shall be provided and approved prior to the permit issuance. In addition to the estimated potholes required to locate active/abandoned utilities within the project site as aforementioned, an additional five (5) days of potholing work (approximately thirty (30) potholes) shall be included in the proposal to address unforeseen underground field conditions. The use of this task budget requires the City’s Written Approval.

10. There are numerous pipelines, utilities and structures that may be in the path of the work.
