CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: JANUARY 28, 2025
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: CEQA DETERMINATION FOR TWO IMPROVEMENT
PROJECTS INVOLVING TWENTY-SIX UNCONTROLLED
CROSSWALKS
ATTACHMENT (Y/N): YES ITEM # 05
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Motion, determine that the two (2) improvement projects involving 26 uncontrolled crosswalks are Categorically Exempt from the California Environmental Quality Act (CEQA) pursuant to Title 14, Sections 15301, 15302, 15303 and 15304 of the California Code of Regulations (CCR).
DISCUSSION:
The City of Anaheim has identified 26 uncontrolled marked crosswalks, where sidewalks or designated walkways intersect roadways without traffic signals or stop signs, in need of active transportation and pedestrian safety improvements. Many of these crosswalks serve schools and parks and are located along designated safe routes to school (11 schools and 19 parks are within 1/4 mile of these crossings). The improvements will consist of the following:
ADA-compliant curb ramps
Solar-powered rectangular rapid-flashing beacons (RRFBs) Lighting improvements
Other safety measures including high-visibility crosswalks, yield lines, parking restrictions, and updated signage/striping.
In March 2023, the City was awarded $224,640 of Highway Safety Improvement Program (HSIP) funding to improve 12 uncontrolled crosswalk locations. The City was awarded an additional $1,112,000 in June 2023 through the Active Transportation Program (ATP) program to improve an additional 14 uncontrolled crosswalk locations for a total of 26 locations.
CEQA Determination for Two Improvement Projects Involving Twenty-Six Uncontrolled Crosswalks January 28, 2025
Upon review of the CCR, staff recommends that the City Council determine that the Project is Categorically Exempt from CEQA pursuant to Title 14, Sections 15301, 15302, 15303 and 15304 of the CCR. These sections allow for the replacement, repair, maintenance, or minor alteration of existing public facilities, involving negligible or no expansion of use beyond that existing at the time of the Lead Agency’s determination. Additionally, the sections address minor alterations to land and the annexation of small parcels necessary for project implementation.
After determining that this Project is Categorically Exempt from CEQA, the City will file a Notice of Exemption (NOE) with the County Clerk, which starts a 35-day statute of limitations for challenges of the decision.
IMPACT ON BUDGET:
There is no budgetary impact associated with the Categorically Exempt determination for this Project. Funding for this Project is provided from Active Transportation Program (ATP) restricted funds and Highway Safety Improvement Program (HSIP) grant in the Department of Public Works’ FY 2024/25 budget.
Respectfully submitted,
Rudy Emami
Director of Public Works
