COOPERATIVE AGREEMENT NO. C- 3- 2751
1 Segment 3: SR- 91 between Acacia Street and La Palma Avenue ( PM 4. 2— 6. 6), SR- 57 PM 15. 5 to PM 16. 2; and
2 3 WHEREAS, this Cooperative Agreement defines the specific terms, conditions, and 4 funding responsibilitiesbetweenthe AUTHORITYand CITY for completionof final design and 5 construction associated with PROJECT, including provide staff resources for coordination and 6 support to the PROJECT, herein referred to as " CITY SERVICES"; and 7 WHEREAS, AUTHORITY is the sponsor and the primary funding agency for PROJECT; 8 and
g WHEREAS, AUTHORITY has contracted with WKE, Inc. to develop the plans, 10 specifications, and estimates ( PS& E) and construction support for the PROJECT; and 11 WHEREAS, AUTHORITY is the lead agency for right-of-way ( ROVV) acquisition and 12 CALTRANS shall serve as the lead Agency for PROJECT construction; and 13 WHEREAS, PROJECT requires portions of CITY Right of Way ( ROW) along Frontera 14 Street for State Highway purposes pursuant to the California Streets and Highway Code; and 15 WHEREAS, the costs for the following elementsof pavementcannot be quantifiedand 16 pricedat this time, as they will be developedby AUTHORTYuponCITY acceptanceof Traffic 17 Management Plan ( TM P), to assess and evaluate the actual post-construction impacts to CITY 18 streets, on a case-by-case basis, as a resultof PROJECTsigned, long-termdetourswithinCITY 19 jurisdiction, as well as the costs of mitigating such impacts. 20 WHEREAS,
