8. CEM Construction Corporation, Montebello, CA….………………...…...Bid Withdrawn One bidder submitted a letter requesting to withdraw their bid due to a clerical error. After review by the City Attorney’s office, it was determined the error to be justified under California Public Contract Code Section 5100 et seq.

GRBCON, Inc. submitted a bid protest due to Big Ben, Inc. not including site photos in their bid proposal. It was determined that this was an immaterial variation waived by the City. Failure to submit the site photos was an immaterial variation that did not affect Big Ben Inc.’s performance obligations as described in the bid documents and did not provide an unfair advantage over the other bidders.

The bid price reflects the current bidding environment, appears to be reasonable, and is within available funding. Liquidated damages for this Project shall be $5,000 per calendar day.

Construction is scheduled to begin in the 2nd Quarter of 2025 and should be completed in the 4th Quarter of 2025. Every effort will be made to minimize impacts on local businesses, churches, residents, and the traveling public.

This project supports Anaheim’s Strategic Plan Goal C - Invest in Infrastructure and Amenities, specifically Strategy No. 4 – “Improve, enhance, beautify and maintain major street corridors”; Strategy No. 8 – “Invest in the expansion and maintenance of the paving program to achieve a Pavement Condition Index (PCI) of 75+/-”, and Strategy No. 13 – “Address deferred and ongoing maintenance needs”.
